    8 US soldiers charged in death of bullied comrade

    NEW YORK (AP) — Even before the Army sent him to Afghanistan, supporters say, Pvt. Daniel Chen was fighting a personal war.

    Fellow soldiers at a base in Georgia teased him about his Chinese name, crying out "Chen!" in an exaggerated Asian accent. They called him "Jackie Chen," a reference to the Hollywood action star Jackie Chan. People would ask him repeatedly if he was Chinese, even though he was a native New Yorker.

    At one point Chen wrote in his diary that he was running out of jokes to respond with.

    Then he was sent overseas, and the hazing began: Soldiers dragged him across a floor, pelted him with stones and forced him to hold liquid in his mouth while hanging upside down, according to diary entries and other accounts cited by a community activist.

    On Oct. 3, the 19-year-old Chen was found dead in a guardhouse in Afghanistan with what the Army said was apparently a self-inflicted gunshot wound.

    On Wednesday, the Army announced charges against eight soldiers in his death, saying Chen was a victim of illegal hazing. Five of those accused were charged with involuntary manslaughter and negligent homicide. The alleged offenses also included maltreatment, assault and threats.

    The military would not discuss the exact circumstances surrounding Chen's death. But family members and community activists said they suspect the bullying may have driven him to suicide.

    "Whether suicide or homicide, those responsible for mistreating Danny are responsible for his death," said Elizabeth OuYang, a community activist who is representing his parents, Chinese immigrants who live near New York City's Chinatown neighborhood.

    Attorneys for the defendants could not immediately be located. The sister of one of them had no comment. Other relatives could not be reached.

    Eugene Fidell, an expert on military law and former president of the National Institute of Military Justice, said bullying has been a recurring problem for the military.

    "If there was brutality within the unit, that's a betrayal of the bond of brotherhood," he said. "That is, in theory, the underpinning of what holds a military command together."

    He added: "Can I imagine somebody being bullied in the military to the point of taking his or her own life? Yes. These people are young people. You're at an age of vulnerability as well as strength."

    In 2010, three Army sergeants were punished after Pvt. Keiffer Wilhelm of Willard, Ohio, killed himself 10 days after arriving in Iraq with a platoon based in Fort Bliss, Texas. Wilhelm's family said he was being bullied and forced to run for miles with rocks in his pockets.

    Two sergeants were imprisoned for six months and three months, respectively, on charges of cruelty and maltreatment. The third was convicted of obstructing justice and given a one-grade reduction in pay.

    Activists said Chen's case has highlighted the military's poor treatment of Asian-Americans, who remain a tiny percentage of new recruits even as the percentage of blacks, Hispanics, women and other groups has grown.

    Pentagon officials would not comment Wednesday on the specifics of the case. But Pentagon spokesman Navy Capt. John Kirby said hazing is not tolerated.

    "That's what this uniform requires. And when we don't, there's a justice system in place to deal with it," Kirby said. "That's what we're seeing here in the case of Private Chen."

    The details of Chen's alleged hazing came from Facebook and email messages, discussions with cousins and a few pages of Chen's journal released by the Army, OuYang said at a Chinatown news conference.

    Chen's relatives said they were encouraged by the charges.

    "We realize that Danny will never return, but it gives us some hope," Yen Tao Chen, his father, said through a translator.

    Chen was assigned to the 3rd Battalion, 21st Infantry Regiment, 1st Stryker Brigade Combat Team, 25th Infantry Division, based in Fort Wainwright, Alaska.

    The Army identified the soldiers charged as 1st Lt. Daniel J. Schwartz, 25, of Maryland (no hometown was given); Staff Sgt. Blaine G. Dugas, 35, of Port Arthur, Texas; Staff Sgt. Andrew J. Van Bockel, 26, of Aberdeen, S.D.; Sgt. Adam M. Holcomb, 29, of Youngstown, Ohio; Sgt. Jeffrey T. Hurst, 26, of Brooklyn, Iowa; Spc. Thomas P. Curtis, 25, of Hendersonville, Tenn; Spc. Ryan J. Offutt, 32, of Greenville, Pa.; and Sgt. Travis F. Carden, 24, of Fowler, Ind.

    VanBockel, Holcomb, Hurst, Curtis and Offutt were charged with the most serious offenses, including involuntary manslaughter, negligent homicide, and assault and battery.

    Offutt's mother, Carol Tate of Sharon, Pa., told The (Sharon) Herald that she has known about the charges for a while and has talked to her son.

    "I think there's a lot of things that really haven't been brought up," she said, but declined further comment.

    Schwartz, the only officer among the accused, was charged with dereliction of duty.

    The two most serious charges, involuntary manslaughter and negligent homicide, carry prison sentences of up to 10 years and three years, respectively, under military law.

    The soldiers are still in Afghanistan but have been relieved of their duties and confined to a different base, the military said. The next step is a hearing to determine if there is enough evidence for a court martial. The proceedings are expected to be held in Afghanistan.

      I spent 3 1/2 years in afghanistan and ANYTIME i would notice any sort of hazing or horsing around that could be interpreted as such i would immediately remind the guys that there are men out there who want to kill us and make sure that we don't go home back to our families. we need to rely on each other to go back home. the guy who you pick on or give shi* to today could be the guy who is responsible for you living to see another day and making it back to your loved ones. We're supposed to be brothers in arms, i am heart broken and feel for Chen and his family. Those 8 cowards need to be hanged in my opinion.

        No, they did a lot more than just speak words. They brutalized him and a lot worse and THAT is what set him off. My only regret is he didn't shoot those #$%$ dead instead. Sure, his life would then be ruined like theirs but it would have been the better and justified punishment. I served in the Corps. for four years and saw firsthand behavior like this, and it didn't go unpunished. If it were up to me they'd all be drawn and quartered live in front of the soldier's family and friends. Besides, the military is sh -- tting bricks because the world outside of theirs is fully aware of what's really going. For example, the U.S. military serves and defends the wealthy and elite exclusively, and no one else. Fact. That's how it's always been. And don't even bother trying to call me a liar because I saw and heard a lot of this b - llshit firsthand. One soldier is dead and eight are now f -- c ked for life. No one won. Semper fi? No.

This young man had your back, you depended on him, you abused him and you have embarrassed your families from now till eternaty. I personally wished right now I could beat your #$%$ to the point that you beg for your life. Who is the ENEMY you power riddon phonys? What about the CREED. These are not young kids, they are grown men sworn to uphold the dutys of an officer of the United States Army !!!!!!!!!!!!!!! More so I know how the storys will go among you thugs, blame blame blame blame...... And you thought your were FRIENDS, This is a travesty, The only blessing is that you guys may have just saved a bunch of lives currently within the ranks.       As a Marine Corps Cpl. and NCO in training the first thing I remember learning is "mission first, people always." There were times, many many times when you had to subject your people to hardships necessary to accomplish the mission. But you ALWAYS took care of your people in the best way you could. That meant ALL your people. They always ate first, got water and rested before you got yours.
      If the allegations against the NCOs listed in the article are true they violated this first law of NCO leadership. If true they have no business being NCOs and little more business being in any position within the U.S. Military. They violated a sacred trust and there is no forgiveness or rationalization.
      An NCO is a special rank of responsibility. It deals directly with the people within a command. Officers deal with logistics, tactics, strategy and administration. You will never find this formalized in any military regulations or directives. But in practice this predates Ceasars legions and continues to this day. It is a trust and tradition that may never be betrayed without the most dire of consequences.
      The old practice of "drumming" them out would be completely justified. They should be stood in front of the regiment, their buttons, insignias of rank and organization ripped and cut from their uniforms, their NCO swords broken and then they should be paraded out the front gate, never to be allowed to return to any U.S. Military base. Of course they must lose all honor, rank, privileges and benefits and their names erased from the regimental roster and all military records. And this after serving the sentence of incarceration as given by a General Court Martial. They deserve shame, scorn and to be shunned by every warrior of any rank or organization.

      These were not some young punk teens doing this. Each one of those accused is of an age and a rank that indicates some level of maturity should have been reached. If found guilty, I hope the Army comes down on them with the full weight of the UCMJ and then let them face civil trials as well. There is not place in the military for this type of behavior. And, if in fact they were responsible for "hazing", they should consider themselves lucky that Pvt. Chen was honorable enough not to "take them out" like he could have. What a disgrace to the uniforms of all service members!

      I have served in the military for 22 years and see those doing the hazing as a sign of their own stupidity. It is really to bad that this young man who probably enlisted out of a sense of pride in his country ended up believing that suicide was the only way out. As a parent I would be extremely distraught if one of my boys took his life because of being harrassed. Someone in PVT Chen's Chain of Command should have recognized the signs that this young Soldier was being maltreated and took action against the offenders and their immediate chain of command. Only now that he is gone from this world is those who mistreated him being investigated. As for those who have served our country who think that Hazing weeds out the weak, you are wrong, for the Hazers are the ones who are truly weak! Remember the golden rule Leviticus 19:18 "Do not seek revenge or bear a grudge against anyone among your people, but love your neighbor as yourself. I am the LORD."

      this is a blow to the US military. That private may have saved some of his comrades during a engagment with the enemy. Seems like our own military is its own enemy. These so called soldiers should be treated without any respect with a prison sentence and disonorable discharge. Our taxes are being wasted on A Holes like this. The military better get its #$%$ together or recruiting is going to be gone.

      A 32 year-old Specialist? That alone tells you the quality of that group of soldiers. Absolutely none. If you're 32 and only Specialist, your personal failure is well documented.       Hell yes there is enough evidence. Those 8 traitors are not Americans in my opinion. To do that to a fellow soldier is disturbing. They need to take those 8 cowards and drop them off in taliban country with a handgun loaded with only 1 round and tell them if they make it back then they will win a court martial and free ride back to the states. Hopefully they will use that 1 round on themselves.
