    Abortion referendum in Mississippi would redefine 'personhood'

    A ballot measure expected to pass in Mississippi this week would define "personhood" as beginning at the moment of fertilization or cloning. Abortion rights groups are fighting the measure, which could end up in the US Supreme Court.

    Abortion rights in Mississippi are being tested with a referendum on the ballot Tuesday asking voters to amend the state constitution to redefine the term “person” to include “every human being from the moment of fertilization” or cloning.

    Opponents charge the change – which both sides say is likely to pass – is a backdoor way to outlaw abortion that could put the 1973 Roe vs. Wade decision in jeopardy. Redefining “personhood” under Mississippi's Bill of Rights will likely lead to court battles that may end up before the US Supreme Court.

    The strategy is being used in several states this year, according to Personhood USA, an Arvada, Colo. organization that provides assistance to state efforts. Besides Mississippi, petitions to put a personhood amendment on the 2012 ballot have been filed in Ohio, Nevada, and California, and there is petition activity in every other state as well.

    “Passing these laws in the state and building the base is the very thing that will give credibility and traction to the federal efforts … we’re essentially building political capital. Pass or fail on the ballot, we are churning up, literally, a movement,” Keith Mason, president of Personhood USA told Bloomberg News.

    So far, the ballot initiative made it past the Mississippi Supreme Court, which in September dismissed a lawsuit filed by the American Civil Liberties Union of Mississippi, Planned Parenthood, and the Center for Reproductive Rights by saying the court could not rule on the constitutionality of the initiative before an actual vote was established.

    However, opponents say they are less worried about the constitutional implications of the measure than they are about what it could mean if it became law. They say the broad language could make abortions or certain birth control methods illegal and that contraceptive pills may potentially be outlawed.

    The state’s medical community also says it is under threat. They say certain surgeries performed following pregnancy complications will be outlawed because they would put the unborn at risk. The Mississippi State Medical Association, for example, is warning that doctors could be charged with murder or wrongful death for “employing techniques physicians have used for years.”

    Also at risk is in vitro fertilization because it involves the freezing of leftover embryos. The American Society of Reproductive Medicine states that the measure will “thwart the ability for those who suffer from infertility to seek treatment appropriate to their disease.”

    Groups supporting the amendment say Planned Parenthood and the ACLU are engaging in what they call “scare tactics.” One group, Yes on 26, says opposition groups “have a major financial and ideological interest in abortion remaining legal in the state of Mississippi.”

    They insist that the amendment will not ban hormonal contraceptives or ban in vitro fertilization. Instead, they say, the amendment will outlaw destroying unused embryos. They admit that the personhood movement’s overall goal is stopping abortions, even in the case of rape or incest.

    Even if voters give the amendment a green light, it will likely face a more difficult time in federal court, where several cases preceding it suggests the fight may be an uphill battle. Similar but less restrictive measures than the one in Mississippi were struck down in federal court in the past, including two in Louisiana and Utah from 1991 that included exceptions for rape and incest.

    Most Mississippi state lawmakers support the amendment, as does Gov. Haley Barbour (R), who told the Associated Press he voted for it by absentee ballot because he will not be home Tuesday.

    Comments Gov. Barbour made last week that suggested he had concerns about the personhood movement were used in robo-calls sent by Mississippians For Healthy Families, an opposition group.

    In an appearance on MSNBC, Barbour said he believes “life begins at conception.”

    “Unfortunately this personhood amendment doesn’t say that,” he said. “It says ‘life begins at fertilization or cloning or the functional equivalent thereof.’ That ambiguity is striking a lot of pro-life people here as concerning.”

    On Friday, Barbour asked the organization to stop using his comments to suggest he was voting against the amendment, a tactic he described as deceptive.

      According to Nancy Pelosi your problem is that you have a conscience.

      The abortion lobby constantly tries to portray themselves as "pro-choice." But as far as choosing NOT to abort, nothing could be further from the truth.

      *** They don't want you to have a choice whether to pay for abortions or not.

      *** They don't want nurses and doctors to have a choice about whether they must participate in elective abortions or not.

      *** They don't want medical schools (including those in religious institutions) to have a choice whether they must teach abortion procedures.

      And when pro-life members in Congress proposed the "Protect Life Act" that would preserve the choice of taxpayers and doctors to abstain from promoting abortion . . .

      Well, according to Pelosi, it's "savage" to allow those choices.

      Pelosi stated "I'm a devout Catholic and I honor my faith and love it, but they [pro-lifers] have this conscience thing."

      Pelosi may have meant it as an insult to you and me, but she is actually right.

      Our conscience tells us it is morally wrong to kill unborn infants and to force taxpayers to pay for it.

      So - after this law is passed - if you have an abortion, participate in an abortion in another state and go to Mississippi, you'd be guilty of murder. And there is no statute of limitations for murder.

        Murder is a state offense, so if the murder was committed outside of Mississippi, the state would have no jurisdiction. But within Mississippi, you are right.

        IT IS MURDER........... !!! In any state..and esp in your 'state" of mind!! New digital imagery of very early pregnancies are showing that it is no longer really considered a fetus..but a 'baby...a HUMAN being. Abortion would then be subject to Murder...as it should be.

        This vote is not telling anyone how to live. They are just defining when a person becomes a person which is a good thing. The laws that protect each and every person that already tell us how to live will still be in force. Personally I don't like the fact that Liberal have decided that I have to live in such a way that part of my income has to go and support people who don't want to work but are perfectly able. As a society we have already decided how we treat other people. The question being asked is who is a person or not.

      Since the elite of the Republican party only care about wealth, tax cuts and lining their own pockets, it took me a while to realize why they're also anti-abortion. Then I realized it is the perfect way to unit their base. It makes them seem caring about human life, yet doesn't cost them anything to forbid a certain practice. It is a costless opposition that gets the poor and middle class Republicans who are religious to vote against their own economic interests to take away their own Medicare, Social Security, welfare, unemployment benefits, etc all in the name of saving the unborn while still providing big tax cuts for the rich. Meanwhile, actually caring about human beings who are outside the womb costs money. To provide single mothers who couldn't afford to have children in the first place with medical care, job training, food stamps, public education for their kids--all this the Republican elite oppose. And yet their poor and middle class base don't seem to care. They also don't care when kids born to unhappy, impoverished teenage parents end up abused. Fixing those problems actually costs money so the elite oppose that while demanding that the poor have their children anyway when they get pregnant and denying them medical coverage for birth control too.

      In the case of an ectopic pregnancy (where the fertilized egg implants in the tube), the tube will eventually rupture and the embryo will die - there is no way to save it. When this happens, the mother's life is at great risk. Will the surgical removal of the pregnancy be outlawed? Will the mother have to wait until the embryo dies of natural causes (the rupturing of the tube) and put her own life at risk? If so, this law is ridiculous.

      People tried Prohibition back in the 1920's and look what happened?? It failed miserably. And that just goes to prove my point... you can come up with stupid laws to regulate behavior but in the end, people will do what they want to do. People will trave across state lines to abort the fetuses or they will use coat hangers, or drugs to rid themselves of unwanted pregnancies. So cry in your bibles, bible thumpers.. because ultimately you can only control your own behavior... not the behavior of others!!!

      I would go so far as to say that under certain circumstances, dead beat dads and welfare moms or abusive parents should be given a sentencing option of sterilization that would reduce or eliminate jail time. These people don't need or want any more kids. Let's address that problem and nip it in the bud, reducing, by millions, the number of abortions that would even be sought, much less performed.
