    The ACLU and EFF Are Appealing the Latest Twitter-WikiLeaks Ruling

    In an apparent attempt to push the question of Internet privacy up to the Supreme Court, the American Civil Liberties Union and the Electronic Frontier Foundation are moving forward with an appeal to challenge a U.S. district court ruling in November. An ACLU spokesperson forwarded a statement as the organization was processing the paperwork that named Icelandic parliament member Birgitta Jonsdottir and Jacob Appelbaum -- both are referred to simply as "Twitter users." As we noted at the time of the original ruling, the case is technically a part of the United States' investigation into WikiLeaks, but it's really about much more than that. Should the ACLU-EFF appeal fail, there's a distinct possibility that the November ruling could whittle away at the right to privacy online. The New York Times explained in November:

    The case has become a flash point for online privacy and speech, in part because the Justice Department sought the information without a search warrant last year. Instead, on the basis of a 1994 law called the Stored Communications Act, the government demanded that Twitter provide the Internet protocol addresses of three of its users, among other things. An Internet protocol address identifies and gives the location of a computer used to log onto the Internet.

    ACLU staff attorney Aden Fine said, "Our clients want to try to protect their privacy and their First Amendment rights, and the government should not be able to prevent that by hiding court records. Our courts are public. Secret court orders and secret court dockets should not be permitted, except in extraordinary circumstances … This case is just one example of the unfortunate recent trend to make our court processes less open and transparent." This is breaking news and we'll update this post with more information when we get it.

        I don't know. Was it known the user was Icelandic before he got tracked down? Should Twitter have to give up IP addresses without a warrant?

      Lets See; Take our 5th Amendments Rights from us so Hollywood can us the FBI for free instead of going to court like the rest of us have to do to protect our property.       How is it that OUR Constitutional rights, as United States citizens, have been transmogrified and extended to non-US citizens?

      Where, how and by what authority are these rights being Internationalized ?

      And why is it that they are NOT being recognized by our own government for legitimate citizens unless you are extremely wealthy, celebrity, or some agrieved, protected class minority or foreigner ?

      Perhaps the answer lies with a certain minority living in the White House who doesn't appear obligated to meet Constitutional muster to run for the office to begin with !!

      That the ACLU exists is amazing. Most people today are like cattle fighting to get into the pen at the slaughter house because they are told only trashy cattle eat grass. I do not always agree but they are about the only people left who want freedom and rights for the majority.

      What did the ACLU do when Obama enacted a law for the unlimited detention of American citizens accused of terrorism? I guess they thought it OK, as I didn't see them publish anything.

        Your question is really not relevant. You don't have to be a fan of the ACLU to take their side on this issue. Conversely, you can like the ACLU but disagree with their stand on this case.

        I hope they will take on the unlimited detention of American Citizens.. since it is a new law, they may need time to properly prepare the documents and get them filed. If they dont file them correctly, that would be more tragic than taking the time and care to get it right.

      So: the journalism tenents of who. what, where, why, when. What District Court and which Court of Appeals will perhaps get this appeal? Who: the federal judge; the plaintiffs, the defendants; etc

      Sometimes we complain about the ACLU but there are no better defenders of our great Constitution. I hope they win this appeal. There are alot of liberties at stake if we lose.

      The ACLU is the biggest defender of YOUR Constitution... I dont always agree with their position esp when you see a career criminal walk due to a technicality... that really sucks.. but.. i would rather an imperfect system than the police state our government is trying to create... I hope they take this case and fight it!!!

        The problem with the ACLU today is that they cant turn down a case no matter how #$%$ backwards it is. They feel that if they give up just one potential case the rest will come crumbling down after. Some of the issues they have backed in recent years have been questionable.

        Zito.. I agree with you.. but this one really needs to be fought hard... we are a few short steps away from censorship like in China, Russia, etc. These laws will accomplish that.

      It is really easy to tell when you should endorse something or not. If the ACLU likes it , then do not endorse it. It is that simple. They are so opppsit of reality it makes simple. When they say something is bad, then you know it is good, and of course visa versa.

      It's simple, really. These as&h0les are being investigated because of their involvement with the wikileaks and PfC Manning's ripping off the United States.I hope to GOD the Supreme Court DOES visit this, and that they rip EVERYONE involved a new #$%$
