CENTENNIAL, Colo. (AP) — The judge in the Colorado theater shooting case has delayed a decision on whether to compel a Fox News reporter to disclose her confidential sources.
New York-based reporter Jana Winter appeared in court Wednesday. In an article last year, Winter cited anonymous law-enforcement sources who said shooting suspect James Holmes sent violent drawings to a psychiatrist before the attack.
Holmes' attorneys contend whoever gave Winter the information violated a gag order in the case. They asked the judge to require her to disclose her sources.
Judge Carlos Samour Jr. said he wouldn't decide whether to order Winter to testify until he rules on whether the notebook will be admitted as evidence.
Winter remains under subpoena until Aug. 19.
Holmes is charged with killing 12 people and injuring 70 at an Aurora movie theater July 20.
