    APNewsBreak: Feds target pot dispensaries

    SAN FRANCISCO (AP) — Federal prosecutors have launched a crackdown on pot dispensaries in California, warning the stores they must shut down in 45 days or face criminal charges and confiscation of their property even if they are operating legally under the state's 15-year-old medical marijuana law.

    In an escalation of the ongoing conflict between the U.S. government and the nation's burgeoning medical marijuana industry, California's four U.S. attorneys sent letters Wednesday and Thursday notifying at least 16 pot shops or their landlords that they are violating federal drug laws, even though medical marijuana is legal in California. The attorneys are scheduled to announce their coordinated crackdown at a Friday news conference.

    Their offices refused to confirm the closure orders. The Associated Press obtained copies of the letters that a prosecutor sent to 12 San Diego dispensaries. They state that federal law "takes precedence over state law and applies regardless of the particular uses for which a dispensary is selling and distributing marijuana."

    "Under United States law, a dispensary's operations involving sales and distribution of marijuana are illegal and subject to criminal prosecution and civil enforcement actions," letters signed by U.S. Attorney Laura Duffy in San Diego read. "Real and personal property involved in such operations are subject to seizure by and forfeiture to the United States ... regardless of the purported purpose of the dispensary."

    The move comes a little more than two months after the Obama administration toughened its stand on medical marijuana following a two-year period during which federal officials had indicated they would not move aggressively against dispensaries in compliance with laws in the 16 states where pot is legal for people with doctors' recommendations.

    The Department of Justice issued a policy memo to federal prosecutors in late June stating that marijuana dispensaries and licensed growers in states with medical marijuana laws could face prosecution for violating federal drug and money-laundering laws. The effort to shutter California dispensaries appears to be the most far-reaching effort so far to put that guidance into action.

    "This really shouldn't come as a surprise to anyone. The Administration is simply making good on multiple threats issued since President Obama took office," Kevin Sabet, a former adviser to the president's drug czar who is a fellow at the University of Pennsylvania's Center for Substance Abuse Solutions. "The challenge is to balance the scarcity of law enforcement resources and the sanctity of this country's medication approval process. It seems like the Administration is simply making good on multiple statements made previously to appropriately strike that balance."

    Greg Anton, a lawyer who represents a Marin Alliance for Medical Marijuana, said the 14-year-old dispensary's landlord received an "extremely threatening" letter Wednesday invoking a federal law that imposes additional penalties for selling drugs within 1,000 feet of schools, parks and playgrounds.

    The landlord was ordered to evict the pot club or risk imprisonment, plus forfeiture of the property and all the rent he has collected while the dispensary has been in business, Anton said.

    The Marin Alliance's founder "has been paying state and federal taxes for 14 years, and they have cashed all the checks," he said. "All I hear from Obama is whining about his budget, but he has money to do this which will actually reduce revenues."

      Yet they have no problem with the use of Methadone and Seboxum for a new high to supposedly "ween" you off your illegal prescription drug addiction. Unfortunately big pharma has to make the stuff and sell it at 10 to 25 dollars a day for the addicts, and Marijuana can be grown by anyone willing to work it right and learn how to grow it right.

      Besides, the drug cartels and the justice system don't want it legalized...no profit in that! No money for the drug lords, and no jobs for all the police and lawyers who prosecute. Not to mention the income from the fines.

        Despite taking in over 18 BILLION dollars a year in taxes from the sales of alcoholic beverages the country still pays out over 200 BILLION dollars a year in health care and social services do to alcohol abuse. The feds fear that legalizing marijuana will only make things worse. I think not, when's the last time you ever heard of a party being ruined on account a few guests got too stoned and became rowdy?

      Let me see..The trial attorney asks a US attorney on the stand, "If Prop 215 has been on the books over 15 years, and your previous attempts at 'enforcement' of federal laws has been spotty and capricious at best, AND your boss, the Attorney-General, recently announced a moratorium on enforcement of such laws, then why now? Suddenly? The inconsistency of your department's approach to anti-cannabis laws is really a campaign to target the weak and medically-needy as well as placate the President's political opponents, is it not?..Speak up, the Court can't hear you."

      does'nt our govt. have more important things to do than chase down medical marijuana business'???? Granted...they are mostly a "front" for businesses that sell pot to just about anybody. Was in one in the 1990's in San Francisco and almost everyone getting pot was doing so on a doctors prescription for "stress" or "depression'. Neither of which pot does anything for except maybe make it worse. However I'd think our federal gov't has way bigger problems than whos smoking weed. Once again its about power and MONEY...the politicians have much more power given by those who sell the drug ILLEGALLY than those who sell it legally. Anything illegal goes for a MUCH higher profit magin. And thus why marijuana continues to be and will continue to be illegal.

        You are so right, many never smoked pot, but after being involved in a t-bone broadside airborne rollover and suffering multiple breaks and surgeries,therapy and a body left to suffer and unable to get medication that will actually not ruin more organs in body or give relief , just a little to help live through a day rather then pure hell of agony. , They want to make money no matter what. Easy money, you tell them who you are and what hell you have been through so they can take your money for a card so that they can go and bust people who are trying to help others, when drugs are coming in through Canada, not the Mexican borders etc. Its a pile of #$%$ they can tell when a person is radioactive, and can xray through and entire vehicle and this is who they go after? Sadly doctors have to worry about getting in trouble for writing too many prescriptions and people thinking everyone is trying to take drugs so they under prescribe. If people had the right medicine, they may be able to be productive again. Instead people only live through years of hell for experimentation for doctors to cut them up and make life worse,rarely better, too bad they don't tell you before they cut you up with promises of being able to live normally. Its just wrong, they need to give drugs that can be addictive, and don't ruin your body, and if some people take them just because they want to and they die, oh well.

        You need to read more son, pot does wonders for depression unless someone takes it to extreme and gets paranoid off it by sitting there smoking bowl after bowl. People with depression have insomnia almost always, they go hand in hand as well as anxiety. Marijuana makes anxiety go away, it also helps have a full night rest and this has been proven in thousands of patients. In addition, I have never met someone that smoked weed and went home and beat there wife, but I know more then I can keep track of that drank beer and went home and beat there wifes. If Marijuana should be illegal, then so should booze. The CIA runs drugs including pot, that is how they get funding. The funding to the CIA is capt and they came up with a plan to make there own money to support what they do, which a lot of it is corupt. Sounds weird I know, research it, news clips on you tube, CIA plane crashed coming out of the United States, can't remember what courntry it crashed in but there was several hundred pounds of cocaine and the CIA agents were all dead, the people from this country took photos and it was put on that countries news which can be viewed.

      aside from all the pot heads that got their medical marijuana id cards, there is positive proof that marijuana significantly helps people that have cancer to keep getting sick when going through their chemo therapy. they are able to keep their food down & the chemo doesn't take away all the nourishment in their bodies. this was the original intention of the medical marijuana laws. then somebody up & made it into what it is now.

      also, obama wants to hold onto anything he can get his hands onto that will hopefully give him some good marks since he's campaigning again. i say ' no, no, no' - let the people have their marijuana for medical purposes. for pete's sake, don't punish the people who truly need the pot over the stoners that just want to get it.

      and another thing - these pot dispenseries are paying taxes to the state of california. i don't see what the problem is!!! and for people who can't smoke it - they have lots of great baked goods available & ready for shipping. cookies, "magic brownies" & all kinds of great stuff. these items are a god-send for people on chemo-therapy. and so what if other people want the stuff. i've never heard of a drive by shooting over some pot. this whole thing is just a crock of u-know-what - a last ditch effort by obama to leave his mark b4 he gets ousted. he wants to shake things up in every possible manner that he can bcuz he knows he's going down. i say good riddance to the guy & the sooner the better.

      This is #$%$...I work a low income hotel where meth and other hard drugs run wild and there hasnt been any law enforcement in here to bust anyone. but lets drop the hammer on pot. how stupid. the amount of harm pot does compared to: Meth, Booze, Heroine, and even spice....HMMMM, you do the math!!

They should work on the items that cost this country the most, like illegal immigrants that these states are so generously willing to give an education to just like they were Americans and charge the same tuition fee to an Illegal.

      If the Feds want to stop drugs they should stop medicating our kids for ADHD. Do they know the long term effects of the ADHD meds?

      People have been smoking pot for thousands of years and there is no proof that is does more than make people hungry and tired.

      If the US would make it legal everywhere and control it like liquer that would go a long way to balance the budget. They would save money on the court system and have time to try real crime. They would save money on the prison system and have space for real criminals. Thet would raise money from taxes on the product and from the employees that produce and distribute the product.

      They should also forgive people (remove the conviction) who have served time only for pot so they can actually get a job and pay taxes (since many employers won't hire cons)..

      so when is enough, to much? why are we standing around screaming about this instead of doing something about it? oh I know, all us pot heads are to passive and relaxed! to the US gov I say this; I am an adult, I make my own choices, stay out of my pockets and my yard! who is anyone on this earth, to tell me at the end of a long day I cannot smoke one to relax? should I use pharmicutical drugs instead? Then I would be using up a doctors time just to write another script and charge some insurance company an outragous fee. but its just fine to go to the corner store and buy some man made booze that is taxed. for that matter I can make my own booze too.
