    APNewsBreak: Indian tribe sues SC over gaming

    COLUMBIA, S.C. (AP) — South Carolina's only federally recognized Native American tribe should be allowed to offer gambling on its reservation because the state lets casino cruise ships operate off the coast, the tribe said in a lawsuit.

    The Catawba Indian Nation's suit filed Tuesday is the tribe's latest attempt to get gambling on its land. When South Carolina started a lottery in 2002, the tribe sued to have gambling machines, but they lost.

    The Catawbas' argument this time is similar to their previous lawsuit, but focuses on a 2005 law that allowed gambling cruises.

    Attorneys for the Catawbas say a 1993 agreement that recognized the tribe gives it the right to have games to the extent they are allowed anywhere else in the state. In 2005, state legislators passed the Gambling Cruise Act, which set rules and regulations for gaming ships that are allowed to operate three miles off the ship's coastline.

    Catawba Chief William Harris argued that gaming is crucial for the tribe, which he said "has no viable operating economic development ventures at present." According to the 2000 U.S. Census, the Catawbas' per capita income was $11,000, and unemployment on the reservation was more than double that of South Carolina, Harris said.

    "Native Americans suffer disparate treatment, but the law is supposed to mean we do not get treated differently by the government because of our race, the color of our skin or our unique beliefs, customs and culture," Harris said in court papers.

    Plans on the reservation include a 220,000 square-foot gaming facility and two hotels with 750 rooms, a capital investment of nearly $340 million by its third year, according to an economic impact study also filed in court.

    Gaming on the reservation would yield more than 4,000 permanent jobs, plus another 4,300 during construction. After the facilities are complete, according to the study, York County would see nearly $260 million in annual economic activity, while the state would reap $100 million in annual gaming fees and about $9.8 million in sales and income taxes.

    Spokesmen for Gov. Nikki Haley and the State Law Enforcement Division, whose chief is named in the suit, did not immediately return messages seeking comment. The tribe is also asking that local authorities be prevented from seizing gaming machines while the lawsuit moves forward.

    The Catawbas have long tried to capitalize on the known economic benefits that come from tribal gaming operations, which in 2009 generated $26.2 billion in gross revenue across the country, according to the National Indian Gaming Association.

    The Catawbas sued the state in 2005, saying the tribe needed to open a video gambling parlor to recoup profits lost at its Rock Hill bingo hall when South Carolina began a statewide lottery in 2002. The tribe also argued that the 1993 settlement allowed them to have video poker, even though the machines were outlawed statewide years earlier.

    At the time, state prosecutors argued that if the Catawbas were allowed to offer video gambling on their York County reservation, the door would open for "unrestricted, uncontrolled and unregulated" video poker in South Carolina, also arguing that the land deal subjects the tribe to state gambling laws.

    A judge ruled in the tribe's favor, but the state Supreme Court ultimately overturned the decision. The U.S. Supreme Court declined to hear the case.

    The 2,600-member tribe was officially recognized under a 1993 settlement, receiving 640 acres. The transfer followed a heated 13-year legal fight about an 1840 treaty that the Catawbas said illegally took away 144,000 acres of their land. The settlement also provided the tribe with $50 million along with restoring its rights as a nation.

      my tribe has a hospital with native american doctors non indians beat the doors down to see them . We have two vocational schools, a college and employ over 5000 natives american tribal members and the state reaps 70 miilion annually non tribal scholarships and the roll money which is divided profits keeps 279000 ill educated disabled and elderly off the food stamp line.The tobacco shops bring in 20 million or better.I don't divulge my state because I hijack all my internet and the FCCwould love to find me becuase I state my mind against thier r ules .I am south of kansas and north of texas.

        Wa-do Native Son. The truth will set us free! And you state the truth. I see the same things here in San Diego. Our local Tribes contribute so much good to the area, especially in the helping of the local Tribes that do not have gaming.

        Casinos pay taxes. They also donate a lot of money locally and employ quite a few people. If people want to gamble, they should be free to do so. The state's are run by id/io/ts and shouldn't have any say in whether a tribe decides to build a casino. There are three Indian casinos near where I live and there has been zero trouble from them. All 3 have donated millions of dollars locally. They don't just employ Indians and crime has not increased at all. So arguments against casinos and gambling are bogus. Why not let the Indians be self sufficient?

        "To the victor, goes the spoils". These Indians were defeated in battle. They lost their land and were forced to adopt the federal rules and regulations. They have through the last century, re-acquired some lands and ethnic recognition. Historically speaking, this was done for the sake of political advancement by politicians plagued with perpetual law suits. The same laws which have held the tribe at bay are now being used to beat the SC judicial system into submission. It would seem that many battles have been fought and waged. Assimilation into the electronic age of gambling by the tribe, is the final end to the individuality of the tribe. Congratulations! You are now as corrupt as all the other politicians you oppose. And you want to be a sovereign nation based on the beliefs of your ancestors? This is not a means to differentiate yourselves from all others in this country! Under the guise of religious beliefs and sovereignty, you are then allowing yourselves to put on the same coat, same hat and parade in the same street with those of which you wish to differentiate your people from. Casino's are not in any ancient Native American religious rituals that I am aware of. Gambling is considered a disease. It will infect the people and soon will remove the ambition of all those who contract it. look to the other reservations and see what I am speaking of. The culture and reason for the recognition is fading fast. Or is that the plan by the US government?

      Can someone in the leagel field please explain this!!! Here in Minnesota, a man tripped over something at an Indian Casino outside on a walk way. He broke his hip. This man went to sue the Casino for his medical cost, he got to court, judge told him hed have to sue someone else, the reservation is a (cant spell this) Soverign Nation, and hed have to take his suite to the tribal council. With that said and done, why can a reservation sue us? One way street? HELP ME UNDERSTAND THIS!!!!

      Except when it comes to opening a casino which nobody else can do. Before you jump down my throat, I have native blood and am sick and tired of the other natives whining. The blame game isn't going to get you anywhere in life. Shut up and improve yourself.

      Forget all the crap about white men wiping out Indians and stealing the land. That's ancient history. But instead, let's focus on our so called freedom. Why shouldn't the Indians be allowed to build a casino? We should be free to gamble if we wish. Nevada and Jersey are not nearly as stupid as the other 48 states that do not allow gambling establishments to be built by anyone, except the ones that have conceded the Indians' right to build casinos. The reasons used to prevent gambling are just plain bogus. We have 3 casinos here built by the Indians. Crime has not increased an iota. The tribes donate millions of dollars locally and hire quite a few people. I for 1 say, let the tribes be self sufficient if they want.

      hey dumb dumb chadine....Catawbas are Siouan people like Saponi, Waccamauw,
      Tutelo, and Monacan tribes. South Carolina violated the Indian Non Intercourse Act
      of 1790 and seized the Catawba's land without an act of the US Congress in the 1840's.
      The tribe was congressionaly terminated in 1962 and restored to federal recognition
      in 1993. Their land was put under state jurisdiction in 1993 due to the land claim
      settlement act they signed after suing South Carolina and winning in court. They
      cannot have gaming unless the state does.

      Some of you guys need to get a clue. Any time a casino is built it helps the economy for us and for non-indians, it provides JOBS and with our economy like it is today there are jobs much needed all over. We don't get nothing for FREE. Not of my people are drug addicts, drunks, or even lazy truth be told all the bad habits that some of my people do have came from a learned behavior outside of our race. We are a proud nation and we don't take nothing that we haven't earned, we treat people they way we want to be treated but most of the non-indians are the ones that keep the prejudice going, as you can read in most of these comments that you have shared.
