To save the polar bears, the government has now claimed that they own all rights to the atmosphere. You will need to submit a written proposal on why you should be allowed to breath, and pay a hefty tax for burning any of the government's oxygen. Air Force One gets an exemption though, because it's vitally important that Michelle Obama gets to go visit France or Brazil whenever she's in the mood.

The polar bear is indeed threatened by global warming, as are we ALL. However, the judge was correct in his ruling, since you would have to apply the SAME ruling to EVERY species, and the forces that are at work against the polar bear are not in the sole purview or responsibility of the US alone.

what makes this judge an expert?

Doesn't anyone understand that when the ice is gone the Polar Bears will turn brown and stay on the land and eat caribou and berries and other land stuff? People will migrate further north and will also be a great source of protein for the bears. People will stop calling them Polar Bears. They will have a name like: That Darn Brown Bear Ate My first Born. The environmentalists will understand and will explain it to the rest of us and all will be ok. Don't worry we will all adapt as evolution plays out as it is so want to do.
In the mean time, I need gas to get to work. Drill me some holes in ANWR and kick those white bears in the butt. Let'em adapt.

"saying that activities outside of the bear's habitat such as emissions from a power plant could not be controlled using the Endangered Species Act" - according to that logic a factory dumping toxic waste into a lake couldn't be controlled because the factory is "outside" the "habitat" of the fish in the lake.
