    Australian court clears sale of Samsung Galaxy tab

    SYDNEY (AP) — Samsung Electronics Co. is closer to selling its new Galaxy tablet computer in Australia after a court on Wednesday overturned a ruling that sided with Apple's allegations Samsung had copied its iPad and iPhone.

    The Federal Court's decision is a victory for Samsung in its bitter, international patent war with Apple Inc., and might be just in time for the Suwon, South Korea-based company to capitalize on the Christmas shopping season in Australia.

    The ruling Wednesday said evidence fails to show that the Galaxy tablet infringes Apple's touch screen patent and that Apple Inc. would be unlikely to win if the case went to a trial. It blasted the earlier decision in Apple's favor as "clearly wrong."

    In October, Federal Court Justice Annabelle Bennett granted Apple's request for a temporary injunction against sales of Samsung's Galaxy Tab 10.1 in Australia, preventing Samsung from selling the device in the country in its current form.

    Samsung quickly appealed that decision, and on Wednesday, the court agreed to lift the injunction and allow Galaxy sales to go ahead.

    Still, Samsung will have to wait a few more days before it can begin selling the Galaxy, after Apple indicated it would appeal to the nation's High Court. Federal Court Justice Lindsay Foster agreed to keep the injunction in place until Friday while that issue is pending.

    The battle began in April, when Cupertino, California-based Apple sued Samsung in the United States, alleging the product design, user interface and packaging of Samsung's Galaxy devices "slavishly copy" the iPhone and iPad. Samsung responded by filing its own lawsuits that accused Apple of patent infringement of its wireless telecommunications technology.

    The fight has spread to 10 countries, with courts in several nations — including Germany and the Netherlands — ruling in favor of Apple. It has highlighted the perception that Samsung — the global No. 1 in TVs and No. 2 in smartphones by sales — is more of an imitator of clever technologies than an innovator in its own right. Apple, by contrast, is generally viewed by consumers as highly original and inventive.

    In her October ruling, Justice Bennett said she was siding with Apple in part because she felt the company had a sufficient likelihood of winning at trial against Samsung.

    But on Wednesday, a full bench of the Federal Court argued that Bennett did not include in her written decision any assessment of the strengths of Apple's case, as she was required to do before granting the injunction.

    "In our view, her decision was clearly wrong and should be set aside," the panel wrote.

    The justices also said they believed Apple was unlikely to succeed at trial, writing that current evidence fails to show that selling the Galaxy in Australia infringes on Apple's touch screen patent.

    In a statement, Samsung said it was pleased with the court's decision and said it would soon announce when the Galaxy would be available in Australia.

    "We believe the ruling clearly affirms that Apple's legal claims lack merit," the company said.

    Apple representatives did not immediate respond to requests for comment.

      That doesn't sound like pure opinion-based writing at all... c'mon, show some integrity. Is this an article about the legal battle between Samsung and Apple or an Op-Ed piece from an Apple fanboy?

      Apple is great at packaging technology and the undisputed king at taking advantage of antiquated patent laws to try and stymie all competition by patenting the obvious and conglomerations of things they didn't actually invent. "Highly original and inventive?" Nah. "Overpriced legal powerhouse and maniacal destroyer of competing technologies?" Yep.

      Ultimately Apple's abuse of the legal system to drown competitors is terrible for consumers but great for their pocketbook. It's why you pay $400 for an iPad that should cost $150.

      "Apple, by contrast, is generally viewed by consumers as highly original and inventive." Really? Do you have a pole that indicates this? Even if that was the perception, it is not a necessarily a true statement.

      You should have substantiate the implication that Apple is highly original and inventive compared to say, Samsung. Talking about people's perception while reporting on a court case is a bit cheap.

      I say this as a owner of MacBook and iPad. And I will switch from Droid to iPhone. I have been and will boycott Samsung products. Having said this, Samsung makes a quality product that rivals Apple.

      On the face of it, Apple seemingly engaged in a bit of well-known Sillicon Valley trolling tactics.

      I own a Galaxy 7" tablet, have had a lot of exposure to the iPad, and I own an iPhone 4. The Galaxy is clearly the superior product as far as hardware is concerned. The Android operating system is OK, although I would certainly give it a thumbs up over the Apple operating system, and there aren't as many apps as I would like to see for the device, which is why Apple will win in the short term. But Apple knows it dropped the ball with the latest iPad and the reason for all of these lawsuits is that they know people will ultimately buy a device which performs better, does more, and is cheaper than their mostly useless device. I've seen people who prefer the iPad, and they all appear to be fashion conscious fan boy geek idiots that don't understand that a computer is for more than just playing the latest version of Angry Birds.

      Samsung beat Apple at all most every turn the tablet is superior is all most every one. Samsung Galaxy S II and Samsung Infuse or at less equal to the iphone with out all of the I do not want to play well with any one. Still Apple will rule the tablet and phone for awhile. Apple fan are not likely to leave Apple Yet. The story continues.

      Apple is starting to lag behind in the technology war. I own a Samsung Galaxy Tab 10.1 and I cannot find anything I do not like about it. I also have friends at work that bring in their IPad's and honestly there is a difference between the two.

      I think everyone should sue everyone for something, anything. F'ing courts are so backed up with frivolous things now a days.

        You're talking about two separate countries, with two separate sets of laws and court systems. The United States can't tell another country what they can and can not do, and likewise no other country can tell the United States what to do. This is why Apple started the ball rolling in all of these countries at the same time to begin with. If you plan your strategy ahead of time and have the money put away for it, you can cause your competitors to have to scramble to defend themselves and hit their short term profitability, which in turn can cause money problems in their research and development departments allowing you to get ahead. It was a smart move on their part in the short term. It would be better for them on the long term to simply come up with a better product.

      It's too bad Samsung won the appeal. In my experience Koreans are not inventors but copiers. I believe Apple was wronged by the Australian court, not the other way around as the judge ruled.

      Hopefully Apple will win their appeal to the high court and stop Samsung from capitalizing on their blatant design rip-off.

      Geeks hate apple because they're too stupid to get a job at the Genius bar and apples are so much reliable than the crappy click and pray windows, linux, and android machines that as apple sales go up there's less and less need for "geeks" to fix computers.

        Computers reliable - you kidding? All hard drives fail eventually - usually before you back up your important documents. Apple also suffered from overheating Nvidia cards in the mac Book pro.
