obama domaIn a huge victory for gay rights supporters, President Obama has decided the Defense of Marriage Act is "unconstitutional" and has ordered the Justice Department to stop defending the law in court.
Obama had previously stated his opposition to DOMA, which denies federal recognition of same-sex marriage and permits states not to recognize same-sex unions performed in other states. But the Justice Department had continued to defend the law in the court—most recently in January when a federal judge ruled DOMA violated the rights of states to set their own marriage laws.
In a statement today, Attorney General Eric Holder said Obama had concluded the law is "unconstitutional."
"Given that conclusion, the president has instructed the department not to defend the statute in such cases," Holder said. "I fully concur with the president's determination."
