    Authorities reveal past complaint about LA teacher

    LOS ANGELES (AP) — Prosecutors declined to file attempted fondling charges 18 years ago against an elementary school teacher now suspected of taking bondage-style photographs of children in his class, saying that they didn't have enough evidence.

    The investigation came after a 10-year-old girl claimed elementary school teacher Mark Berndt reached toward her genitals during class and she pushed his hand away, sheriff's Sgt. Dan Scott said Thursday.

    The details of the case and other claims by two former students about strange behavior by Berndt surfaced just three days after his arrest.

    The allegations raised further questions about why he wasn't disciplined by school officials, who have been lambasted by some parents for waiting a year to reveal Berndt was suspected of photographing children for sexual thrills.

    Only parents of children identified as victims were told by authorities about the most recent investigation.

    School officials and investigators said proper procedures were followed to investigate and build a case against the teacher.

    Scott said the incident involving the 10-year-old girl occurred in September 1993 but wasn't reported by her mother to officials at Miramonte Elementary School until the following January, after her daughter had seen an "Oprah" show about inappropriate touching.

    School officials notified the Los Angeles County sheriff's department, which submitted evidence to prosecutors. They opted not to file a charge of committing a lewd act on a minor under the age of 14. Berndt was never arrested.

    "Based on what I read, it was a thorough and complete investigation," said Scott, who noted the investigator who handled the case has retired.

    Sandi Gibbons, a district attorney spokeswoman, said in a statement the case was rejected because there was insufficient evidence to prove a crime had occurred. The statement did not elaborate.

    Berndt denied the allegation at the time.

    Earlier, two women who said they were former students of Berndt told the Times that complaints were made about his odd behavior as far back as 1990.

    Los Angeles Unified School District Supt. John Deasy told the newspaper he was struggling to determine how the alleged behavior went undetected for so long.

    "How do I make sense out of the fact that this took place over a number of years and no one seemed to know about that?" Deasy said. "I'm definitely trying to understand how someone could not have known."

    Berndt, 61, remained jailed on $23 million bail on felony charges of committing lewd acts on 23 boys and girls, ages 6 to 10, between 2005 and 2010. He could face multiple life sentences if convicted.

    Using a cheap camera, Berndt is suspected of snapping nearly 400 photographs of Miramonte students, some with a giant Madagascar cockroach from a classroom terrarium on their faces.

    Others were blindfolded or had clear tape over their mouths, and some were given sperm-laced cookies to eat as treats in the photo sessions that were treated like games, Scott said.

    Some of Berndt's students defended him, saying he was a kind and generous teacher.

    Angelica Zuniga, a 16-year-old high school junior, was in third grade in 2003 when she had Berndt as a teacher. She said he never asked her or others to do anything strange or to play any inappropriate games.

    "They're calling him 'monster.' He's just not that kind of person," Angelica said. "He was one of the most amazing teachers out there. He's dedicated his life to us, and I want to stick up for him."

    The latest investigation of Berndt began in the fall of 2010 when a film processor became suspicious about the photographs and turned them over to Redondo Beach police, who on Dec. 2, 2010, handed them over to the sheriff's department, Scott said.

    Berndt, who taught at Miramonte for more than 30 years ago, was removed from classwork in January 2011 and fired within the month.

        Good idea. I'm sure the secretary had a LOT to do with whether or not to pursue charges against Berndt, so go ahead and use foul language, too. I really doubt that they're fielding dozens, if not hundreds of phone calls from people that were actually affected, so absolutely throw your two cents in there.

        You'd have to have some understanding of current politics to understand why it applies to this case. Politics and unions prevent administrators from firing bad teachers. There's a documentary called Stupid in America. I'd recommend you watch it to get a full understanding of the background and breakdown of the US school system.

        You have to be part of a union to understand the ugly side of it. They protect each other no matter what. I know. because I had a relative in a union & I was in one myself. I will not detail the horror of what is covered up, but I can understand the horrific truth that this monster could exist doing what he did for so long.

      He still laughs all the way to jail because the union allowed him to resign and therefore he can collect 4000/month pension. Nice. Another way to screw the parents of these children - not only he hurt their kids but the parents need to pay taxes to support his pension for life.

      This girl is an idiot. Just because SHE wasn't molested or violated, it doesn't mean that he's an "amazing" person and doesn't have fault. People need to look OUTSIDE themselves. If judgments were only based on our direct affect, then no one would be prosecuted, a jury would never convict. Her job is to hear both sides and all the evidence, and see if there is a chance that he is guilty, and then to support the victims. How would she like it if something happened to her, but no one believed her and they supported her attacker, only because the attacker never attacked them?

        There are already "non union Teachers" at much less the cost, they're at private schools, seems like they demand more money from your pocket! And why shouldn't they care about their bank accounts? You certainly won't care about "their" bank accounts or pensions, so, thus, THEY will do what they have to do to get good compensation; Why not? This is a CAPITALIST system, so why should they subject themselves to SOCIALIST ideas that CAPITALISTS like you want to impose on them?... Their education, time, skills, etc., is their product; and, like any other product on the Capitalist Market, it is to reduce the bottom line and obtain the HIGHEST profit.... Why should teachers operate any differently? ...If teachers are sooooo wayyyyyyyyy overpaid, like you say, sounds like that kind of economic package should attract the BEST and Brightest, as in YOU....so, go do it!

      I don't believe for a minute that the investigation in 1994 was thorough enough. If the police had done their job and the D.A.'s office had supported their findings, this pedophile would have been stopped right then and there. And, I also didn't believe for a minute that rumors were not floating around the campus and the district. Here's the problem: nobody took action and a lot of kids suffered as a result. This is what happens when you ignore situations like this.

      Some needs to look into nthat school counselor that dismissed this when report in 1990 as made up stores. This person (counselor) is guilty and I will wager had some connection to this guy. Some one check this counselor out.
