Mr. Grand’s appointment follows his extensive experience in other high-profile cases involving defective medical devices and dangerous drugs including pelvic mesh, Vioxx, Fosamax and Yaz. He has supervised the day-to-day management of complex, multi-party mass tort litigation in state and federal courts and multi-district litigation throughout the United States, and has served on discovery and administrative committees in these litigations. He has served as a member of the trial teams that obtained a $47.5 million verdict for Vioxx-related cardiovascular injury in Humeston v. Merck & Co., in New Jersey Superior Court in 2007, and several plaintiff victories in the Chinese-Manufactured Drywall Products Liability Litigation in the United States District Court, Eastern District of Louisiana.
Metal-on-Metal Hip Replacement Implants Spur Litigation
In August 2010, Johnson & Johnson issued a worldwide recall of its ASR metal-on-metal hip implants due to their excessively high failure rates.*** The recall was prompted by a study from the National Joint Registry of England and Wales, which concluded that 1 out of every 8 patients who received the devices had to undergo revision surgery within five years. Although the Pinnacle hip replacement devices were not subject to the hip replacement recall 2010, because they are metal-on-metal implants, they share similar design defects to the ASR hip devices. According to a recent article in the New York Times, more than 5,000 metal-on-metal hip replacement lawsuits have been filed; 3,500 of these hip replacement lawsuits involve hip implants that were subject to the ASR hip recall.****
