returned to court today in her continuing custody battle with ex-boyfriend Gabriel Aubry over their three-year-old daughter Nahla.

Berry, 45, was seen entering the Family Courthouse at 8:30 a.m. in downtown Los Angeles, where she was expected to ask for a restraining order, restricting Aubry from seeing their daughter Nahla until an investigation targeting him is resolved.

A rep for the actress did not respond immediately to a request for comment.

Aubry was being investigated by the Los Angeles Police Department for child endangerment and criminal battery, after Berry and a nanny accused him of pushing the nanny while she was holding their daughter.

The nanny also filed a restraining order against the 34-year-old Canadian model, saying she feared his "dangerous and aggressive" behavior. A judge denied that restraining order, saying there was not sufficient evidence.

Aubry also sought a restraining order against the nanny and asked the judge, in effect, to fire the nanny, who works for both of them but is paid by Berry.

Last Friday, Berry and Aubry, who share custody of Nahla, met with the Department of Children and Family Services. According to TMZ, social workers recommended that Aubry take anger management classes, and the website said he agreed. In addition, sources told  TMZ that social workers recommended counseling for Nahla as well.

The incident which touched off the latest battle involved the couple's 3-year-old daughter and her nanny.

According to TMZ, which obtained a copy of the police report, the altercation started after the nanny went to Aubry's house to pick up Nahla, and discovered the girl had not gone to school. When the nanny asked Aubry why, she said he flew into a rage, cursed at her and pushed her out of the door while she was holding the Nahla.

In the police report, she quoted Aubry as saying ""You're the f**king nanny. Who do you think you are? You are a nobody. You don't need to f**king know anything."

"According to her, he went off.  He just flew off the handle, started screaming at her in front of the child," TMZ's Harvey Levin told ABC News.
