Amish men sent to jail after refusing to put orange triangles on their buggies

The jailed Amish men's mug shots (Smoking Gun)

Judge Deborah Hawkins Crooks sentenced nine Amish men on Monday to up to 10 days in jail after they refused to pay fines for not putting an orange reflective triangle on the back of their horse-drawn buggies.

The men, who belong to the ultra-conservative Old Order Swartzentruber group, said that using the orange triangle violated their religion's modestly rules, which forbid bright colors. They asked to use gray reflective tape and lanterns instead, but the courts refused. The Graves County jail provided them with dark-colored jumpsuits.

The men, who are being represented by the American Civil Liberties Union, are appealing their case to Kentucky's Supreme Court, according to the Courier Journal. They refused to pay the fines because they don't think they should be punished for abiding by their religious beliefs. (Via The Smoking Gun.)

Why does this issue have to get blown out of proportion? The Amish have a religious conviction about not wearing bright colors or adorning their carriages unnecessarily. If safety is the primary factor, why can't white, silver or gray reflective tape be used in a triangular pattern to accomplish the same visibility requirements. The subdued colors would be less offensive to Amish sentiments and accomplish government visibility requirements. There is need for thinking outside the box by both parties.

All of you who want to believe that they should be incarcerated, should think about one thing here in dealing with the Amish Community.
1st and foremost, they do not operate "Motor Vehicles" that is a criteria for enforcement of traffic laws! Additionally it does not warrant the use of a Driver license which is the factor in compliance with the Motor Vehicle Code!
Secondly, There can be no crime by fiction, period! Or have all of you sheeple forgotten that one? If there is no Victim there is no crime!
Lastly and not least, it is against their religious belief and system. I guess that you can only be Muslim for that one to apply though !!!

They were given a fine to pay. They refused to pay the fine. The jail time is for failing to pay the fine just like you or I would have to do if we refused to pay our traffic fine. And traffic laws apply to anyone to travels on public roads, on foot, on bicycles, skateboards or otherwise, even walking. It's not a Motor vehicle code, it's Vehicle code, which applies to ALL vehicles on the public roads, which is why a bicyclist who runs a stop sign can get a ticket just like the driver of a car can, as can the rider of a bicycle or skateboard can be ticketed and arrested for drunk driving as well.

I can understand the thing about bright colors, but why does God want men to have neck beards?

Because of lesser known commandments in the Jewish bible (which the Amish absolutely adore!). Most people only know the first ten or some variation thereof. Same reason Hasidics have their requirements, same verses, just different interpretation. Leviticus, Psalms, etc. discuss hair and clothing. Guess God simply won't grab the two groups and tell them which one is vague interpretation is more correct. Such a gadfly god is!

In case anyone missed it, Last week there was a fatal buggy accident when Amish children no older than 10, pulled out in front of an SUV. I think 3 kids died and 7 were hurt or some similar number. This is a matter of public safety, if they want to operate on the roadway they need to follow safety regulations.

Amish were here first. Remember what Ben Franklin said - "Those who would exchange liberty for safety deserve neither liberty nor safety".

Maybe could drive more slowly around them, respecting them for who they are

Do you mean like slowing down in areas where people for hundreds of years have been using horse and buggies?

You must be one of those people that think the American Indians got what they deserved because they wanted to follow thier own traditions...

sorry cops, and worse for the judge, in this incident. At the least, discuss a fine, agree upon said fine, have them pay if they are able, and let them go. There is not "anyone" in that community that could live the lifestyle that these people have chosen to live. This is 'harrasement" in its simplest form. Shame on the Judge, the police for allowing this to have taken place. Wake up people. Open your eyes when you are on the roads. Put DOWN the frikin ipads, texting devices, etc.
Is there a law that allows me to file a lawsuit against cops that drive while using their in car computers? I have observed this happening an abundant amount of times. NOTHING will be done until someone is maimed, or killed by an officer for this action. Now, I wish I had gone to law school

There are specific provisions for law enforcement and first responders using the tools of their trade. They also go through extensive training on when and how to use those tools as safely as possible while still using them to do their job. There are also exceptions to the cell phone laws for making emergency calls.

If you had gone to law school you would know these things and would not be talking about things you obviously know nothing about.

Man, they sure are scary looking. Is this the worst criminal to come out of that state? Having been raised around Amish people and working with Amish people, they are against having their pictures taken. You can see that in their faces in each shot.

I love the Amish way of life and have nothing but respect for them, but there is the liability issue. If they are rear ended because of not being seen, who will be liable? The Amish for following their religious beliefs? Or the county that they reside in, for not makeing them follow the same "slow moving vehicle laws" that everyone else must follow. If the bright colors bother them, cover them up when your not on the road.
    • Writeon  •  8 mths ago
All of you speaking about the "poor Amish". Why should they have their own set of rules? I live in an area with Amish. They all abide by the slow moving vehicle emblem laws and they still get run into at times. It is difficult, if not impossible to see a flat black buggy on nice day let alone on a dark, rainy night. The Amish around here realize that the placards are for their own safety and the safety of their children. I have yet to see a buggy come out on top in a collision with a car or truck.

Too bad for religion when it comes to Traffic Safety laws. A gray reflector will not work, Coast Guard orange is noticeable over a distance. We cannot compromise religion over our safety on the roads and highways.

I'm sure if they were muslim our prophet in cheif would interceed on their behalf.
    • Alice  •  8 mths ago
Alrighty then - don't really see the point of these men being put in jail. If they don't want to or can't use orange triangles because of their religious beliefs, then why can't they be allowed what they were willing to compromise on? Seems like grey reflective tape and a lantern would definitely do the trick, as far as being able to be seen....
    • Writeon  •  8 mths ago
If you can't abide by the rules, stay off of the road. Usage of the highways is a privilege, not a right. As for using grey, that is #$%$ The National signal for a slow moving vehicle is the orange triangle. Stay off the highway or risk having your buggy shoved up your horses butt.

When stubborn meets up with stupidity that's when the court can collect some badly needed dough.
This time it backfired on the stupid because now they have to pay for up to 10 days room and board --- plus different colored jumpsuits for the stubborn.

These vicious scofflaws must be incarcerated even if several serial killers who obey traffic laws must be released to make room for them.
