    Help wanted — jobless need not apply

    In 2008, Michelle, a 53-year-old Illinois resident with 19 years experience in information technology, became another casualty of the Great Recession. More than a year later, after a long and fruitless job search, she finally heard from a headhunter who thought she sounded like a great fit for a post he was looking to fill.

    But when Michelle told him how long she had been out of work, the headhunter turned apologetic: His client, he said, wouldn't accept people who had been unemployed for more than six months. Michelle would go on to stay jobless for so long that she ultimately exhausted all her unemployment benefits, and, for the first time in her life, was forced to apply for food stamps and welfare.

    Michelle's tale was recounted at a recent Equal Employment Opportunity Commission (EEOC) meeting devoted to the issue of hiring discrimination against the unemployed. As the commission found, Michelle's experience is far from unique. No one officially tracks how many job openings explicitly bar the unemployed, but several news reports since last summer have uncovered numerous online job postings that require candidates be employed during the application process. One such listing was posted by the cellphone giant Sony Ericsson--a move the company later called a "mistake."

    Job-placement professionals say that over the last year, more and more employers have made it clear they won't consider job candidates who aren't working. "A lot of our recruiters have had clients who have come across this," Matt Deutsch of TopEchelon.com, which brings recruiters together to collaborate in finding jobs for candidates, told The Lookout, calling the practice "unfortunate."

    With the number of Americans who have been out of work for six months or longer at a whopping 6.2 million, and with 4.7 unemployed workers for every job opening, advocates for the jobless say this growing form of hiring discrimination creates another hurdle for the increasingly desperate ranks of the unemployed. "At a moment when we all should be doing whatever we can to open up job opportunities to the unemployed, it is profoundly disturbing that the trend of deliberately excluding the jobless from work opportunities is on the rise," Christine Owens, who runs the National Employment Law Center, told the EEOC.

    Some experts say that discrimination against the jobless, as currently practiced, may violate civil rights laws--a question the commission is now considering. In itself, such discrimination isn't illegal. (New Jersey is exploring legislation that would prohibit job ads telling the unemployed not to apply.) But it is illegal to discriminate on the basis of race or age. And African-Americans and older workers are disproportionately represented among the long-term unemployed--meaning they may be bearing the brunt of discrimination against the jobless.

    The EEOC declined to say whether it's investigating specific cases of potential violations.

    Some employers have said they're unwilling to hire unemployed workers because they believe that if a worker has once been let go, that's a sign that he or she is probably not a great hire. "People who are currently employed … are the kind of people you want as opposed to people who get cut," one recruiter told the Atlanta Journal Constitution in October.

    And as Federal Reserve Chair Ben Bernanke has said, when people are out of work for a long time, their skills can erode, which may understandably make them less attractive to employers.

    But Deutsch said that a bias against the jobless is also a time-saving device for companies that may themselves be making do with less, thanks to the downturn. "If you've got a huge stack of submissions, and you want to get through them quickly, [you can say] 'OK, all the people who are not currently employed, forget them,' " Deutsch explained. "That's gonna cut down on your workload."

    However, aside from the damage that this practice does to unemployed candidates, employers who adopt it may be shooting themselves in the foot, since they're probably screening out qualified applicants who were laid off through no fault of their own. "To think that that's going to bring you all the qualified candidates you want to see is probably not the case," Deutsch said.

      This happen to me, today. I was called by Adecco on behalf of Harris Bank. They were looking for a temporary 3 month contact work, to do Mortgage Loans processing. Which I am well qualified and have well trained for. Well, when they learn that I have been out of work for over two years, the job offer was pulled. This is first time it's happen to my face. Now I understand why I have been unemployed for so long. I thought it was something I did, but it was the Corporate American, and in this case it was Harris Bank....

      If you find a company that is not doing this, tell everyone. Let's support the companies that promote fair hiring practices and let the rest go away.

      This is discrimination and the law should be changed to include this category. There are too many people unemployed to disqualify them merely becuase they have been unemployed for some timeframe.

        Whatever happened to one hand washing the other? Employers need workers, people need jobs. It doesn't matter what your age, color, experience or in-experience, there's going to be some training anyway. Employers shouldn't be so "discriminating", because before the recession, I'm sure alot of them had a high turnover rate. What's really happening here?

      I did apply thousands time for two years but companies always discrimation against me for I am deaf and 53 years old. What is shame? I worked for Bank of America for almost 28 years and laid off on me and can't find better jobs. That is sad.

        dont feel rained on pal...you are not alone. I have had calls from enthusiastic recruiters and then come interview time...not so much. my last interview was as an assistant manager at a dominos pizza. before he asked me any questions the job turned into a drivers position. I am getting by on foodstamps and my college loan overages...but it sucks the balls. good luck and dont let these bastards get the best of you

      I've been out of a job except temp work (a week here, one data entry assignment there) for FOUR YEARS. Where do I go? What do I do? Seriously I need answers.

      I haven't worked since 2007. I have a friend who wasted almost a year of his life in job corps he came back after dropping out with a GED and had a job a little over a few months later.

      Meanwhile I fill out 100's of apps every month send out dozens of resumes and go to every interview within 20 mils I have nothing to show for it....

      There is discrimination. Both age over 50 and the time you have been unemployed. The problem is how can you expect the EEOC to try and pass any type of law when the Federal government can not due any better. TSA Not qualified because I was behind on credit card payment with a company that prides itself on not dealing with the people and proud of it. Or a RR recruiter that says you do know what the work is crimbing up and down on train car as a conductor, ok, I will send your name they may be in contact with you. Laugh, Laugh, Laugh, never head a thing.

      what are we doing to fix this problem as Americans? we need to get laws passed in order to get rid of these unfair practices, so next time you write a letter to the president; and patition, or your congressman who is trying to get elected, ask them what are they willing to do to get your vote.

      Strange, virtually all the whites at the company where my sister worked were laid off.

      The company claims all the employees were selected at random but NOT ONE Hispanic or Black employee was selected. Most of them offered to take a pay cut but they were still laid off.

      She went to a lawyer who told her that there's nothing that could be done. Off the record he told her that as a white person she would have a heck of a time proving discrimination. What a country we live in.

      Conservatives should be against "Jobless need not apply", they always scream "Get a job lazy bum!"....ok so what if we try too but this happens?...This keeps the employed, employed and the unemployed, unemployed. The scary part is, this can happen to anyone. You think you might be safe now with a job, what if you get laid off and find it hard to get a new job? Suddenly it's a year later and you are still out of work....

      Most recruiters are MUCH more subtle that this example. They have orders NOT to continue ANY contact with someone unemployed more than 6 months. They can't be held liable for anything then.

      Here one for President Obama, Vice Biden and Secretary Eric K. Shinseki of Veterans Affairs and being terminated at the Department of Veterans Affairs, Palo Alto Health Care Systems for "No Reason" on January 31, 2008. I was terminated because of "Nepotism" and after 4 1/2 years of services, I was told my services were no longer needed. My Supervisor hired her stepdaughter and told me under the California Law they could terminated me for "No Reason and I wasn't a Federal Employee." Also after being terminated the Lab Manager and Supervisor for 3 years has prevented me from getting a job in the Bay Area because of there negatived comments the government has destroyed my career. These women who worked the Laboratory at Palo Alto has friends in the local labs and has prevented me from getting a job. I am a Veteran Widow living in my car and my experiences as a Phlebotomy is in the toilet. I haven't been able to get a job because of the negatived comments from the Department of Veterans Affairs Laboratory. I bet any mount of money if this happen to someone in their family they would have stop it before it even got started. President Obama the nerve of you and your staff allowing this to happen. I have loss everything my home, health insurance and my career because the government can bad month you and they can not be sues because they are government. I was told me that this was "age discrimination" but this was a "Wrongful termination" and I couldn't sues because I wasn't a Federal Employee this after working 4 1/2 years at the San Jose Health Care System. Also, the IRS said that they can levy my widow check is there anything else you want to do to me. Oh, by the way Vice President Biden when you were on the "The View" the comments about women being beaten up will 3 young males came to my car at 2:00 am and harassing me while I am now because of the government sleeping in my car. "HEY WHERE IS MY HELP" where IS MY RIGHTS or I don't have any rights because of my back taxes. Illegals have more rights and protected the American. Yes, Mr President I think we needs some big changes or the government needs to practice what they preach.

      I think that if I had been laid off a job through no fault of my own, been unemployed for an extended period, possibly seen my marriage break up over it and then seen one of the banks who were deemed too big to fail foreclose on my home and been denied a job simply because I'd been unemployed...

      I believe I'd search out the person responsible for making the decision to reject out of hand the long term unemployed and crack his skull open.

      After being on unemployment for over six months I have scaled back on everything. I decided that when I shop I only get the necessities mainly food, toiletries the important things to stay healthy.Since most foods are manufactured here in the US. or I go to the local farmers market for my produce Do you know close to 85% of the products in Walmart are made in china,malaysia and other countries? Do you ever go into Walmart and observe the layout of the store? Not to mention the qualityof some products has become so poor. I have learned you do not need every new gadet on the market. Use what you have until you cant use it any longer.Besides you wont have to travel and waste gas to get. We are turning into Survivalists in a a new economy called Socialism. As for jobs. Yes I am experiencing age discrimination and being overqualified.It seems one blog was taken down this morning pertaining to people who have been unemployed are lazy.has any one on here seen that blog?

      Unemployed workers, their families, need to band together and boycott goods and services provided by companies who boycott the unemployed for hiring. It should be simple - You refuse to consider qualified applicants who are unemployed - we refuse to purchase suitable goods and services from you, your agents, and subsidiaries. Unemployed does not mean powerless - Picketing such firms should be educational, because there is no one out there who does not have friends or relations who are either unemployed or "downsized." It is simply a matter of identifying such firms and their affiliates. The whole notion of refusing to hire unemployed is arrogant, muleheaded, ill-educated, "nouveau riche," and just plain noxious in a democratic country. We don't need more laws - vote with your feet and with your dollars. Also, these companies should not be permitted to post on publicly maintained websites.

      Employers who dicscriminate against long term unemployed and older workers are selling themselves short and will pay for this practice in the long run. The quality of older workers cannot be match by the younger generation. Older workers grew up with work ethics that is sorely missing in the younger generation. Older workers come to work everyday on time, usually earlier then they need to, so they can complete everything on their desk by the end of the day. By doing this they usually do not require overtime which is costly to the employer.
