    Cherokees told to take back slaves' descendants

    TULSA, Okla. (AP) — A federal order for one of the nation's largest American Indian tribes to restore voting rights and benefits to about 2,800 descendants of members' former slaves threw plans for a special election for a new chief into turmoil Tuesday.

    The federal government sent the sternly-worded letter to the Cherokee Nation after it sent letters last week kicking the descendants out of the tribe and stripping them of benefits including medical care, food stipends and assistance for low-income homeowners.

    The tribe also barred the descendants from voting in a Sept. 24 special election for principal chief. The Cherokee Supreme Court ordered the special election after it said it could not determine with certainty the outcome of a close and hotly contested June election between incumbent Chad Smith and longtime tribal councilman Bill John Baker. The results had flip-flopped between the two during weeks of counts and recounts. Baker had twice been declared winner, but so had Smith.

    The federal government said that unless the descendants, known as freedmen, were allowed to vote, the upcoming election wouldn't be valid.

    "I urge you to consider carefully the nation's next steps in proceeding with an election that does not comply with federal law," Assistant Secretary for Indian Affairs Larry Echo Hawk wrote in letter Friday to acting Chief S. Joe Crittenden. "The department will not recognize any action taken by the nation that is inconsistent with these principles and does not accord its freedmen members full rights of citizenship."

    Crittenden said the special election would take place as scheduled.

    "The Cherokee Nation will not be governed by the (Bureau of Indian Affairs)," he said. "We will hold our election and continue our long legacy of responsible self-governance."

    The election has drawn national interest because while the tribe is based in Tahlequah, many of its 300,000 members live outside Oklahoma.

    The freedmen have asked a federal judge to restore their voting rights before the special election, and a hearing is planned next week in federal court in Washington.

    The tribe never owned black slaves, but some individual members did. They were freed after the Civil War, in which the tribe allied with the Confederacy. An 1866 treaty between the tribe and the federal government gave the freedmen and their descendants "all the rights of native Cherokees."

    More than 76 percent of Cherokee voters approved a 2007 amendment removing the freedmen and other non-Indians from the tribal rolls, but no action was taken until the tribe's Supreme Court upheld the results of that special election last month. Cherokee leaders who backed the amendment, including Smith, said the vote was about the fundamental right of every government to determine its citizens, not about racial exclusion.

    But the Department of the Interior said Tuesday that it still believes the expulsion is unconstitutional because it violates the 1866 treaty.

    Marilyn Vann, president of the Descendants of Freedmen of the Five Civilized Tribes, said she hopes the federal order will result in the election being delayed.

    "The freedmen people still have rights in the tribe such as voting," Vann said Tuesday. "We'll have our day in court."

      So in other words, our government kicked slave descendants off the welfare because they are not "Cherokee?" But when the Cherokees say slaves are not descendants and do not have the right to vote in their elections.......our government says their election is not valid????? Who is our government to say who is Cherokee and who is not!

        This is not about cherokee descendants that are mixed with african americans, they can still vote in elections and recieve benefits. It is about descendants of slaves that have no cherokee blood at all AKA "freedmen" being excluded from tribal affairs.. I think it was very kind of that tribe to include black people into thier tribal agreements in the first place. My tribe never included slaves and they do not have this problem today.

      Fed's butt out! This is the Cherokee people and nation which the Fed's murdered, stole from and uprooted from their homelands in the Eastern US. I and my family have a number of American Indian and especially Cherokee ancestors and come from the mountains where the Feds stole land by condemnation to build the Blue Ridge Parkway and many national forests lands additions. The Feds need to butt out of the Cherokee nations government and criteria to belong. They had best focus on the KKK and NAACP where race is the primary criteria for membership.

        Want the feds to but out? Reject all government funding and opt out of the agreements that grant you exclusive gaming rights in many states. Then you'll have total independence.

      Its 2011, Cant we just stop all this stupidity and finaly merge as a nation. It #$%$ me off when an indian comes into my store, and flashes a tax free card and buys a #$%$ load of merchandise that is not for them. and I am supposed to just smile as they walk out the door. I dont want to pay taxes but I have to. Is that fair to me? I didnt steal anything from anyone. I didnt take anything from anyone. They live in america, Granted we basically took the whole country from them. But thats pretty much what everyone did hundreds of years ago. Keep living in the past. You think the indians who had this land got it peacfully when they desided it was thiers? Probably not. The only difference is. Everything we did here is documented. Its 2011. We are all americans Weather you think you are or not. You live in america your an american. If I had my way, and the indians dont want to merge and finally become a true nation. I would cut them off from the rest of america. Thats your land. Live there dont bother us. Dont leave your Reservation. Dont buy land OUTSIDE the reservation and claim Treaty law. The treaty was there to protect you and your rights while your on your reservations. Stop infecting us with your stupidity and idiocy. Merge with the country and get over old hatred.       The U.S. federal govt. has NO standing to order any native American tribe to recognize anyone. Who the hell do they think they are. Do they try to tell Mexicans or Canadians how to run their govt. No and the Native American tribes should "rightly" tell Mr. Obama and Eric holder to "#$%$ OFF".

      1871 Indian Appropriations Act declares ; the U.S. no longer recongizes or , delegates treaties sign by the U.S. & Indian tribes / nations within the borders & territories of the United States therefore making them wards of the state.

      Many argue this makes a way for the Fed. gov. to gather even more Native lands ,inclosing them to internment. Out sight & out of mind ?

      US Government is actually going against Martinez vs Santa Clara Pueblo, they can not tell tribes who they can and can't enroll. Could also be a violation of the Hatch Act in which the federal government is interfering in tribal governments or trying to get involved in tribal sovereign matters. Just a thought... Just the continued genocide of the US in trying to wipe out the American Indian Nations...

It really is'nt any of there concern but yet again they want all the control, it is time we ignore what they say and do as we #$@% well please, they say they are being fare and want us to again agree with there dicisions, I say no it is time we stand up again against the pale face and fight for what is ours as they have taken our lland and contrled us for way too long now! Why are they so concerned with what they can do and take from our people but yet do nothing to help feed people in our country instead we feed all the rest of the world what about that. They have plenty of other things to busy therselves with other than telling us what to do anymore!!!

      I don't know where the person(s) got their information but they are sadly mistaken, I have no memories of having slaves.

      Just because the government is running out of welfare money does not mean that you get to collect from MY NATION cause YOU SAY SO,

      We where and are a self sufficient Nation there was never a need for slaves we took care of our selves. and even if there was what makes you eligible for money,

      Did we travel to Africa and kidnap you, NOOOOOOOOOOO we did not, The bottom line is I never owned a slave Nor did my Native american family, why do I pay for You, (Riddle me this BATMAN),
