    Congress tries to give president line-item veto

    WASHINGTON (AP) — The Republican-controlled House sought Wednesday to give President Barack Obama and his successors the line-item veto, a constitutionally questionable power over the purse that has been sought by Republican and Democrats alike.

    The legislation, expected to pass, would allow a president to pick out specific items in spending bills for elimination. Currently, the chief executive must sign or veto spending bills in their entirety. The president's choices for removal would then have to be approved by Congress.

    Congress has made several attempts in the past to enact line-item veto bills, saying that surgical cuts to spending bills are useful both in removing wasteful earmarks and in reducing spending. Most state governors have some kind of line-item veto power.

    The House bill, offered by Budget Committee Chairman Paul Ryan, R-Wis., and the top Democrat on the committee, Chris Van Hollen of Maryland, stipulates that all savings from eliminated programs would go to deficit reduction. House Republicans have included the bill as part of a package of measures to overhaul the budget process so as to save money.

    In 1996, a Republican-controlled Congress succeeded in giving line-item veto authority to another Democratic president, Bill Clinton. He exercised that authority 82 times, and although Congress overrode his veto on 38 instances, the moves saved the government almost $2 billion.

    But in 1998, on a 6-3 vote, the Supreme Court ruled that the law was unconstitutional, saying it violated the principle that Congress, and not the executive branch, holds the power of the purse.

    Supporters say the bill has been written to meet constitutional standards. They say that while the president can propose items for rescission, or elimination, Congress must then vote on the revised spending package and then the president must sign what is in effect a new bill.

    Support for the bill appeared to be broad despite the usual acrimony between congressional Republicans and the president.

    "I'm not thrilled about involving this president in budgeting decisions any more than is absolutely necessary," said freshman Rep. Rob Woodall, R-Ga. "But given the nature of our challenges, it's not about this president or the previous president or the next president, it's about the American people."

    "We know that this body has been unable to produce cleaner, leaner spending bills, and I think it can be a constructive step to enlist the help of the president of the United States in removing unnecessary and indefensible pork from spending bills," said Democrat Rep. Jared Polis of Colorado.

    Under the proposal, the president has 45 days within the enactment of a spending bill to send a special message to Congress proposing cuts to any amount of discretionary, or non-entitlement, spending. Legislation to consider the proposed cuts would move quickly to the House and Senate floors for automatic up-or-down votes with no amendments.

    The White House, in a statement, said it "strongly supports" passage of the bill, praising it for "helping to eliminate unnecessary spending and discouraging waste." It said the bill was similar to a line-item veto proposal that Obama sent to Congress in May, 2010.

    One top Democrat, minority whip Steny Hoyer of Maryland, voiced opposition, saying that while he had supported line-item veto bills in the past, he thought the bill was too restrictive in requiring that money saved from a rescission go to deficit reduction and could not be used to fund other priorities.

    The bill, if it passes the House, faces an unclear road ahead in the Senate. Four senators — Republicans John McCain of Arizona and Dan Coats of Indiana and Democrats Tom Carper of Delaware and Mark Udall of Colorado — pushed to have a line-item veto provision considered by the supercommittee which last year was unable to come up with a comprehensive plan to reduce the deficit.

    But the Senate, traditionally more protective of its constitutional powers, has not always been receptive to the line-item veto idea. In 2007 former Sen. Judd Gregg, R-N.H., picked up 49 votes for a line-item proposal, well short of the 60 needed to break a Democratic-led filibuster.

      I think the line item veto should be on evrything. Teh idea that things unrelated to a bill can be tacked on at the end to bully its way through in my opinion is legalized corruption

      This is the only way to stop the pork and special interest krap that gets attached to virtually every bill, forcing either a veto of important legislation or letting the pork get passed as well. Voters should make note of all congressmen who are against this.

      If Congress REALLY wants to give the President a line-item veto, they can do that today with no vote necessary, no controversy and no chance of being over-ruled - just start sending bills that only cover 1 item instead of bundling unrelated things into a single bill.

      4. 60%... Entitlement Spending (Social Security, Medicare, Medicaid, SCHIP, Unemployment)

      BY THE NUMBERS -
      33%... One out of every three Federal Tax dollars is LOST due to fraud, waste and gross mismanagement.
      33%... One out of every three Federal Tax dollars goes UNCOLLECTED due to the illicit drug trade and the growing underground economy.
      40%... Two out of every five Federal Tax dollars is Deficit Spending (BORROWED MONEY).
      And all of the above is growing… every year… EXPONENTIALLY!
      Now is that stupid as hell or what??

      25% / 85%... The top 25% of the American workforce pays 85% of ALL Federal Income Taxes.
      47% / ZERO PERCENT... The bottom 47% of the workforce pays ZERO PERCENT of ALL Federal Income Taxes.
      Now just exactly what 'fair share' percentage of the Federal Income Taxes should that top 25% of the workforce be paying??

      To take our nation from a National DEBT of $15 TRILLION to a National SURPLUS of $4 TRILLION (rainy day fund), in 30 years at 3.50% interest, is going to require Federal Spending CUTS of a TRILLION BUCKS AND Federal Tax Revenue INCREASES of a TRILLION BUCKS.

      Those Federal Tax Revenue increases MUST come from a healthy, vibrant, sustainable and growing economy, NOT Federal Tax RATE increases. We MUST grow the pie BIGGER!!

      Do you REALLY believe that the Federal Government can do a better job of spending, investing OR donating YOUR HARD EARNED MONEY better than you can??

      Do you really want YOUR children and grandchildren ‘investing’ in Social Security or Medicare??

      I didn’t think so.

      We don’t have a tax problem… but we D**N sure do have a spending problem!

        When it comes to politicians, Democrats are STUPID, quite a few Republicans are IDIOTS and NEITHER should ever be allowed anywhere near our economy. Common Sense huh?

        Yes, my friends, there is plenty of ‘blame’ to go around the last 50 years, Democrats, Republicans, Independents and roaming gnomes.

        So what are WE, THE PEOPLE, Common Sense Americans supposed to do? Give POTUS Obama and the Democrats, OR Republicans a ‘stupidity’ pass or something? I don’t think so.

        The truth is we 'Baby Boomers' have no one to blame for this ‘little’ economic mess except ourselves. We're the ones who elected these idiots to office, so knock off the phony 'outrage' and take responsibility. We’ve been warned about this Social Security / Medicare ‘house of cards’ for decades.

        It is OUR debt, NOT our children and grandchildren’s. To pass it on to them is WRONG, it is UNCONSCIONABLE, it is IRRESPONSIBLE, it is PURE D**NED EVIL! And we ‘Baby Boomers’ should be D**NED ashamed of our selves.

        Everyone knows that NOTHING, absolutely NOTHING, would make our economy fly like a ‘bat out of hell’; create millions upon millions of SUSTAINABLE, PRIVATE SECTOR JOBS! JOBS! JOBS!, keep interest rates low AND drive down the price of gas more than going from a National DEBT of $15 TRILLION to a National SURPLUS (rainy day fund) of $4 TRILLION in 30 years.

        During the 2008 campaign, candidate Obama, criticizing President George W. Bush for the $4 TRILLION increase in the National DEBT during his eight year Presidency, said it was a FAILURE OF LEADERSHIP to have to raise the National DEBT ceiling AND that it was UNPATRIOTIC.

        UNPATRIOTIC??! Well that must mean POTUS Obama and the Democrats are skating VERY, VERY CLOSE to TREASON??

        This Republican campaign is very lively and interesting but FIRST, I think we can ALL agree that we need a Constitutional Amendment that would require a 3/5 majority (60%) of BOTH Houses of Congress to increase the National DEBT or increase Federal Taxes/Fees on the American people.

        A simple majority (50%+1) would be required to lower the National DEBT or lower Federal Taxes/Fees on the American people.

        And also, 12 year term limits, with an additional 4 years for the Presidency. Just in case we get a keeper?

        But that is just lip service from those dimwit politicians. Roe v. Wade has a better chance of being reversed than a Balanced Budget Amendment being passed.

        So what do we do? Deficit Spending (BORROWING), or rather DUMPING, TRILLIONS upon TRILLIONS of dollars of National DEBT ‘onto the backs of our children and grandchildren’ is NOT AN OPTION. Barring a Declaration of War, more Deficit Spending MUST be the exception… NOT THE RULE.

        In lieu of a Balanced Budget Amendment we MUST elect a President (and their successors) who, when another National DEBT limit increase is sent by Congress to their desk for signature, will say, “NO… No, I don’t think so.”

        Then our nation’s spending priorities will come into sharp focus… and real d**n quick!

        From here on out, without a Declaration of War, ANY politician who votes to increase the National DEBT limit and dumping TRILLIONS upon TRILLIONS of National DEBT ‘onto the backs of our children and grandchildren’ should be hung by their neck, at the end of a rope, and left to twist in the wind. Let the buzzards take care of ‘em!

        We have both a spending and a revenue problem.
        If we had collected sufficient revenues over the last 20 years and not exploed military spending and discretionary spending we would still be balanced.
        This is long term accumulated debt with irresponsible revenue cuts.

      There would be no need for line item veto if congress would pass single purpose bills. Allowing everyone to tack on the "pork of the day" is what is killing us. If the response is that it would be inefficient, they all could stand to work a little harder and longer.

        I agree with you.
        Instead of pushing for Line-Item Veto, which is something that gets exercised AFTER Congress already wasted a lot of time packaging the pork-laden bills, they should push for single purpose bills that are evaluated on their own merit.

        Opponents would state that this would "clutter" up the legislation process. I think it would be a clean kind of clutter as opposed to the massive cluster@#$@# that they currently create on a daily basis.

      I honestly think this could do more good than bad. It would hopefully discourage law makers from trying to take on addendums not related to the law at hand that either strangle the law or sneak through something undesirable at the cost of getting what you really want done. Yes, it might get abused, but they can always rescind that power. Right now the ability to put pork in bills is by far the greater problem, active abuse that should be curbed and this is a way to do that.

      Remember these three numbers; The US government spends $10 billion a day (2.75 billion more than we take in), we are in debt $15 trillion (and growing by $2.75 billion per day) and we add over $1 trillion of debt per year.

      So when you read that something saved the government $2 billion and you think thats a big number, think again. That $2 billion would cover about an 1-1/2 hours of government spending (8 hour day) and not even eliminate the deficit spending for 1 day.

      While I am at, when you hear someone imply that taxing the rich is going to solve our problems.....the top 1% make just over $1 trillion per year collectively and pay a bit more than $300 billion in federal taxes. If you were to increase their marginal tax rate by 10 points (10%), that would cover less than 2 weeks of government spending. It would decrease the annual deficit by about 10%, which is nothing to sneeze at, but that still leaves more than a $1 trillion annual deficit. Don't be disctracted by the politicians over this tax the rich scheme. Its only there to disctract you from the enormity of the problem. Our problems are far beyond taxing the rich. Just look at the numbers and do the math yourself.

      To put this in perspective, assuming the government increased taxes on the rich, they would still have to cut more than 30% of the annual spending to iliminate the annual deficit. This would still leave the $15 trillion deficit that we would have to address.

      I like this idea. Congress is basically admitting what we have known for years.. it cannot on its own rein in earmarks. Period. Congress (both parties) needs #$%$ spending to be highlighted by someone else, and then it needs to be forced to vote just on the #$%$. No more hiding junk spending as riders in otherwise worthy bills. This is the first bipartisan win-win I have seen since the Clinton years with a GOP Congress.As for executive abuse of power concerns, make the provision sunset every year. Thus, Congress would have the option every year to revoke or continue the power if needed.
