This Depakote birth defects lawsuit was filed on October 17, 2011 in the St. Clair County Circuit Court in Illinois, and the case number for the lawsuit is 11-L-0583. The case was filed by plaintiff Rhealyn Alexander on behalf of her daughter, who was born in October of 2007 with spina bifida, which is a condition that’s the result of a neural tube malformation that occurs during the first trimester of pregnancy.
Plaintiff Alexander states that she was taking Depakote during the first trimester of her pregnancy to help her treat a seizure disorder and that her daughter was born with spina bifida and neural tube defects. The plaintiff alleges that these birth defects were the result of Depakote side effects. She further alleges in her Depakote birth defects lawsuit that Abbott Laboratories was negligent and that the manufacturer knew of the risks of Depakote side effects that could develop in unborn children of mothers who used the medication during the first trimester of pregnancy but that Abbott Laboratories failed to warn physicians and consumers of these risks. The plaintiff is seeking an unspecified amount of damages from Abbott Laboratories as compensation for her daughter’s medical expenses, the plaintiff’s lost income and the expenses associated with court costs and fees.
