    Court overturns Calif. slaughterhouse law

    WASHINGTON (AP) — The Supreme Court on Monday blocked a California law that would require euthanizing downed livestock at federally inspected slaughterhouses to keep the meat out of the nation's food system.

    The high court ruled that the state's 2009 state law was blocked from going into effect by federal law administered by the Agriculture Department's Food Safety and Inspection Service.

    Federal law "precludes California's effort ... to impose new rules, beyond any the FSIS has chosen to adopt, on what a slaughterhouse must do with a pig that becomes non-ambulatory during the production process," said Justice Elena Kagan, who wrote the court's unanimous opinion.

    California strengthened regulations against slaughtering so-called "downer" animals after the 2008 release of an undercover Humane Society of the United States video showing workers abusing cows at a Southern California slaughterhouse. Under California law, the ban on buying, selling and slaughtering of downer cattle also extends to pigs, sheep and goats.

    But pork producers sued to stop the law, saying the new law interfered with federal laws that require inspections of downed livestock before determining whether they can be used for meat.

    The Federal Meat Inspection Act allows a federal meat inspector to examine and then determine whether a downed animal is fit to be slaughtered for meat. It also says states cannot add requirements "in addition to or different than" its requirements.

    About 3 percent of pigs that show up at slaughterhouses are non-ambulatory, the National Meat Association says, but veterinarians normally give the non-walking pigs a few hours to determine whether their problem is disease, or just stress, fatigue, stubbornness or being overheated from the trip to the slaughterhouse.

    A federal judge agreed and blocked the law, but the 9th U.S. Circuit Court of Appeals threw out the hold. The justices overturned that decision.

    Federal law "regulates slaughterhouses' handling and treatment of non-ambulatory pigs from the moment of their delivery through the end of the meat production process," Kagan said. California's law "endeavors to do the same thing, at the same time, in the same place — except by imposing different requirements. The FMIA expressly pre-empts such a state law."

      If animals are going to be produced and slaughtered for human consumption, we OWE them a decent life and a humane death and that includes the trip to the slaughterhouse.

      Heaven forbid if we show an animal some compassion; it simply couldn't be these animals are in shock from fear and the brutality they endure as humans exact wanton cruelty upon them. When God gave us dominion over animals He made us their shepherds, not their torturers. I have nothing against eating meat but I have ALOT against the meat industry and it's rampant cruelty.

        By compassion you mean ensuring the pig is 100% healthy and able to stand on its own BEFORE putting a bullet in it's head and THEN carving it up to eat? Maybe we should have pig psychologists on site to explain though we're slaughtering them it is only because we love them so and they're making a positive contribution to the world... Give me a break.

        roscoe-they don't use bullets. they use a 'captive bolt pistol-basically a pneumatic hammer. often the animal is still alive when they hook it, hang it and drain its blood. If you only knew what is done to animals used for food in this country you would stop eating meat on moral grounds. As far as being fed diseased animals, well that's just instant karma for being willfully uneducated folks. Educate yourselves before you spout arrogant, ignorant opinions.

        Roscoe you are just plain wrong- and selfish. HOW exactly did the animal arrive in that state? I'll tell you how- by inhumane mishandling along the way, which is illegal, not to mention unethical and immoral. Our misdeed and so we have to accept consequences.

      Normally, the states are allowed to go above and beyond what the federal guidelines are, as is the case with minimum wage. After moving from the Northwest down South, I came to realize that restaurant inspections are much tougher in Washington State than they are in Texas. Food handlers permits are required in WA but not in Texas and routine Health Department inspections are more frequent in WA too. I have worked in restaurants in both states and what they can get away with down here was appalling to me. I could see if California wanted to reduce the federal safeguards but what is wrong with adding some? But we have also seen in the case with Arizona's attempt to secure it's border with Mexico that the federal government apparently thinks less is more.

      Downer Cattle are those that cannot stand on their own and are very sick from a number of causes. In Europe Mad Cow Disease was one of the causes for these cows. These animals should never ever enter the food supply. Any government that sought the protection of it's citizens would test every cattle for Mad Cow like in Japan and Australia and not do what it can to protect big business.

      Pigs don't "become non-ambulatory in the production process." They arrive too unhealthy to walk and slaughterhouses want to put them in the food supply anyway. No thanks!
