    Dad says Oscar-nominated film glorifies convicts

    LITTLE ROCK, Arkansas (AP) — Todd Moore isn't sure whether he'll watch the Oscars this weekend, when a documentary about the murder of his son and two other Cub Scouts could win an Academy Award.

    Moore and his ex-wife, Diana, believe "Paradise Lost 3: Purgatory" glorifies the three men convicted in the Arkansas boys' deaths and asked the Academy of Motion Picture Arts and Sciences to bar it from consideration for an Oscar.

    The academy refused, saying the film met the basic eligibility requirements and was being viewed and evaluated by members.

    "It would not be possible for the Academy — its leadership, executives, or administration — to insert itself into this process without risking the integrity of this longstanding procedure and of the awards themselves," wrote Rob Epstein, who chairs the Documentary Branch Executive Committee, in the letter dated Dec. 13. The Associated Press obtained a copy of the letter this week.

    Epstein thanked the family for writing with such candor and said he could only begin to imagine the anguish they've suffered.

    "I would not trivialize your pain by asking for your understanding, but I do hope this has clarified the organization's role in the Awards process," he wrote.

    The film, directed by Joe Berlinger and Bruce Sinofsky, is the third in a series of HBO documentaries about the killings of Michael Moore, Stevie Branch and Christopher Byers in West Memphis. The three men convicted in their 1993 deaths, Damien Echols, Jason Baldwin and Jessie Misskelley, entered a plea deal last year that cut their prison term to time served and let them still claim innocence.

    "They're probably going to wind up winning," Moore told the AP on Friday. "Hollywood seems to glorify people like this."

    Berlinger, one of the film's directors, has expressed sympathy for the Moores, but said they're directing their anger at the wrong people.

    "They should be upset with the State of Arkansas, not the many independent journalists and filmmakers who have examined this case and have come to believe in the innocence of The West Memphis Three," Berlinger said in an email.

    Not all of the slain boys' parents share the Moores' point of view. Branch's mother, Pam Hobbs, has said she asked the state to reopen the case after seeing new evidence in "West of Memphis," a documentary about the case that premiered at the Sundance Film Festival last month.

    Echols, Baldwin and Misskelley were convicted after Misskelley unexpectedly confessed and implicated the other two, describing sodomy and other violence. Misskelley, then 17, later recanted, and defense lawyers said he got several parts of the story wrong. An autopsy found there was no definite evidence of sexual assault, and Misskelley said the older boys abducted the Cub Scouts in the morning when they had actually been in school all day.

    After the first "Paradise Lost" film aired in 1996, a number of celebrities joined an effort to free Echols, who had been sentenced to death, and the other two, who were sentenced to life in prison.

        no one knows for sure who is innocent and who is guilty. the three guys just might be guilty. no one is 100 % certain. they let them go b/c lots of ppl were angry over the possibly they were innocent.

      The step-father of one of the boys should have been looked at closer than he was. I did not see the HBO special but have seen several documentaries. His body language gave me chills.

      From watching 2 of the films, they were originally brought about to bring world wide attention to the plight of these 3 men and to aid in their fight for justice. Having been to West Memphis ONCE and experienced the crooked way of the judicial system there ( i was driving thru the state and was a victim to their illegal ticketing practice of removing speed limit signs from the interstate), i fully believe the 3 men were innocent. Although i do feel for the family, the ONLY way West Memphis, AR will clean up their act in the judicial system IS with this kind of exposure. I have heard countless horror stories of people, even cops, who live in that area tell about how the citizens, both black and white, get railroaded there. The judge that presides over the majority of cases there, from traffic to more serious offenses, is a criminal himself. I wish the Justice Dept would grow some balls and force that state to clean up their act!

        i got a speeding ticket in that area on the interstate once. i was friendly with the officer. i joked at the end when he handed me my ticket and told him something like, "well, i'm not going to say thank you, but..." and the guy got all nasty and said, "HEY! I DIDN'T MAKE YOU GET ON THE GROUND!" i should think NOT! i WAS speeding. i DIDN'T deny it, and i WAS NOT RUDE! i'm a 5'2" tall woman who was friendly, despite the circumstances and tried to make a joke with the guy and he got hostile. if they can say things like this to a cooperative person, i can only imagine how they behave when there is a serious crime involved. i will never forget it.

        you should have went down to marvell arkansas the biggest speedtrap in the state the entire town is supported by the crooked stuff going on there. i was traveling through there with 3 other officers and in plain clothes going to tunica to do a tad of gambling. the local yokel. pulled up after we had pulled into a self service station that every light was on even the pump lights etc. he was giving us the evil eye n asking us why we'd pulled into a closed service station. hey it did'nt look closed.we were going in to get soft drinks and such while on way to destination. when we'd seen the tiny little closed sign we'd turned around to get back in vehicle. any way he'd asked for id etc when the badges started coming out . he was flabbergasted. so much for harassing us and giving out summons etc. things could have gotten very hairy had situation happened to normal cirizen's this guy should be taken off the streets.tall fellow black 6'4'' or so. watch out for his actions if ever stopped there.

      While the movie industry does have a First Amendment right to make movies, I do feel the industry should move cautiously on subjects like this one! It isn't just a story or potential fillm, it dealt with lives lost, and those lives lost had families who are still dealing with the pain! One of my sons was murdered a few years ago, and I wouldn't want any movie made about the circumstances surrounding his death!

        Yes, I too am sorry for your loss but if the wrong person (or persons) were convicted and put in jail for their murders and the only way to fix the situation was to call attention to it by making a documentary or doing a news story, personally, I would want to do that. I would want the real killer or killers brought to justice not just whoever happens to be handy or the easiest to railroad into confessing. That doesn't do anyone any good because the real killer or killers are more than likely to kill again.

      It has all but been proven the cops were sloppy and the 3 boys convicted did not do it. It has also been shown that the step father, Todd, should have been at least a person of interest based on details that came out about how he lied. Funny he's the only one objecting.

        Get your facts straight! Todd Moore is not the stepfather of Michael Moore and has NEVER been a person of interest. You are confusing this man with Terry Hobbs,stepfather of Stevie Branch. Amazing how you can sit back and state who is guilty and who is innocent and yet you have no idea who anyone is!

      I have worked 14 years trying to exonerate an Innocent in Texas where Prosecutors fight DNA and truth is trampled on by one Boss Hog type after another.
      Imagine, most of these inmates have not seen night darkness since they entered, prison never cuts off the lights. Innocent and in prison is sad. I have changed my pro death penalty stance, I had to, DNA is a good thing.

      It helps for grief and anger to have a target but it sounds like these men did not commit the crime. All this energy should be put to trying to finally convict the right people.

      It is entirely possible that these 3 were wrongly convicted in the first place. It wouldn't be the first time and it won't be the last. it is too bad that the victims' families cannot get closure by the conviction of the actual killer or killers

      the movie should win awards because as a documentary it was truthful and very informative. there is no way to make the families of the murdered boys feel better but there is also no way for these 3 wrongly convicted men to get their lives back. its a lose for everyone

      CSI:Miami did an episode that was ripped from this story. The thing is that this type of story does make good TV and movies, but this is not the first time a movie was done and it will not be the last time a movie was done about someone or some people wrongfully accused of something.

      I feel for the family, and I am not going to try and walk in their shoes, they did what they felt was right, they wrote to the Academy and were turned away, but they did what they felt they had to do, and got it out there of their displeasure.

      There's serious doubt as to the guilt of these men. I would think that, of all people, the parents of any of the victims would not want innocent people jailed while the real killer(s) may still be out there, scot-free.
