    Dentist who used paper clips gets year in jail

    FALL RIVER, Mass. (AP) — A former Massachusetts dentist was sentenced Monday to one year in jail for using paper clips instead of stainless steel posts in root canals.

    Dr. Michael Clair pleaded guilty earlier this month to a list of charges, including assault and battery, defrauding Medicaid of $130,000, illegally prescribing medications and witness intimidation.

    Prosecutors said Clair sometimes used sections of paper clips when performing root canals in an effort to save money. Some of his patients reported infections and other problems.

    Brenda Almeida said her teenage son's tooth turned black and had to be removed after Clair performed a root canal on him in 2005. She said Clair also performed shoddy dental work on her other two children.

    Almeida, who watched Clair get sentenced in Fall River Superior Court Monday, said she was angry about what she considers to be a light sentence.

    "He put my kids in pain for months ... I hope he rots there," she said after Judge Richard Moses sentenced Clair to a year in the Bristol County House of Correction.

    Prosecutors asked for a sentence of five to seven years.

    Massachusetts Attorney General Martha Coakley said Clair billed the Medicaid program for the costs of stainless steel posts and submitted false claims using other dentists' provider numbers.

    "The defendant physically and emotionally harmed his patients by taking advantage of the trust they placed in him as their dentist," Coakley said in a statement. "Mr. Clair brazenly cheated the Medicaid program and defrauded taxpayer dollars, billing for health care services he did not provide."

    Clair, who had a dental practice in Fall River, now lives in Crofton, Md.

    The judge said he considered Clair's acceptance of responsibility, lack of a criminal record and "certain mental health issues" Clair is dealing with in deciding on the one-year sentence. He did not give any specifics on the mental health issues.

    Clair's lawyer, John Dingee, declined to comment.

    Moses granted a request from prosecutors to order Clair to stay away from his victims and seven people who worked in his office. Assistant Attorney General Toby Unger said Clair's former staff members "have expressed concern for their safety," but did not elaborate.

    Moses sentenced Clair to 2½ years, with all but one year suspended, followed by five years of probation.

    Clair did not speak during the sentencing, except to thank the judge.

    "Thank you, your honor, for your consideration," he said.

    Clair's license to practice dentistry was suspended in Massachusetts in 2006. A spokesman for Attorney General Martha Coakley said Clair is no longer licensed to practice dentistry in any state.

    Prosecutors said Clair was suspended by Medicaid in 2002, but continued to file claims from August 2003 to June 2005 by using the names of other dentists in his practice.

      so screw everyone you deal with, steal thousands from medicaid,put people lives in danger,and get a year in jail . i'm not saying tyhis is right but it seams like the more money you steal and the more you screw everyone the less time you get .for a hundred thousand i sit in jail,think about it free room and board ,medical for free,tv ,a/c nothing to do but take a year vacation,maybe crime does pay

      One time a dentist told me that I needed a root canal after hooking me up to some fancy machine. I told him I was going to get a second opinion and 15 years later my teeth are fine. The 2nd opinion who used to be my childhood dentist told me my teeth were fine and that no root canal was needed.

      So Judge Almeida, (pronounced All Mighta), say your best friend has a heart attack and needs surgery. The surgeon botches the job because he/she is drunk, and your friend dies. The surgeon has never been drunk on the job before this. So you give the surgeon only one year in jail? Your friend lost a lifetime.

      Dentist Clair screwed the patients and public not once, but many times over the years; this was only the first time he got caught. Clair should have to serve consecutive sentences for each and every case of malpractice. Dentists, physicians, teachers, engineers, even lawyers and judges are trained to be professionals whose standards and integrity should never have to be questioned.

      The sections of paper clips inside a properly sealed endodontic treatment will cause no harm. He is a lousy doctor performing bad endodontics that commited fraud many times. He should get more time for that. I have seen many doctors, that have million-dollar offices, do crappy work on a good day.

      Talk..talk..talk..#$%$.#$%$.#$%$..but actually get out there and do something about the horrendous inequity rampant throughout the justice system. Not going to happen!Nothing will change until we get angry enough to leave no doubt that we are past fed up and will no longer allow any of the race, class and income discrimination to continue for another minute. Average and poor individuals would have been sentenced to decades for assault, theft, fraud, etc. this guy caused pain and suffering for personal profit, risked infection and death to those he was sworn to protect, especially children. And yet he is sentenced to 365 days which mean he'll be out in 120 days. The only thing justice seems blind to these days is equal treatment under the law...!

      Dentists scare me. It's as if no one is watching them at all. 13 years ago my small town family dentist diagnosed me with 8 cavities. Never having a single pain in my mouth, I went to get a second opinion. Here I am, 13 years later, still never had a single cavity.

      What is it with dentists and criminal activity? My earliest family dentist who never did bad dentistry, nevertheless went to jail for counterfeiting; Another dentist I went to as a child, specialized in finding cavities, that weren't actually there, to fill. After a while, I told my parents that I thought this guy was just lying in order to get business at the expense of my teeth. Later, other young people I knew corroborated this with their own experiences with this dentist; More recently a dentist referred me to a dental surgeon who proposed an horrific surgery that was not necessary (I declined). Often, there are other dentists in the news who do similar things. One year for this particular criminal, though, is way too light. "Mental problems" is no excuse for doing harm; stealing; intimidating witnesses. This guy was a one-man mafia. Ten years would be fair. One year is an insult to his many victims.

      As a dentist, I have nothing but disgust for this cheater and abuser of our public trust. I knew another one like this--worse really. But he did not get to spend any time in jail, where he should have been for all the hideous abuse and damage he heaped on hundreds of innocent patents!! You would have to have seen it to believe what was done and the permanent destruction on mouths. For money!
