    EvictionRecords.com now offers the option for eviction and criminal background check expungement requests to be e-mailed as PDF documents. Requests for expungement of eviction records and criminal records via postal mail will continue to be accepted as well.

    In addition to accepting expungement requests via postal mail, to meet the needs of its customers, EvictionRecords.com will now be accepting expungement requests via e-mail to service@EvictionRecords.com. Eviction and criminal records expungement is a civil court proceeding which may seal or destroy one's eviction or other public record. While a few governmental agencies may still have access to all records, public records are the ones relied upon in tenant and pre-employment background screening. Landlords and Human Resource Departments contract background screening companies to search public records for documents that may be pertinent to the renting of an apartment to or the hiring of an individual, including criminal records on a county and statewide level.

    In order to secure an expungement, the individual convicted of a court action must petition the court. While this is no simple task, it is not impossible. Each state has different regulations and requirements in regards to expunging an eviction or criminal record. Once an eviction or criminal record is expunged by a sitting United States Judge, the record is sealed or destroyed, and the plaintiff does not have to claim a criminal record while applying for an apartment or a job. It is important to note that eligibility for expungement is based upon current law within the jurisdiction of the court the original conviction occurred.

    Additionally, there are several conditions put into consideration before an expungement court action can be initiated and these may vary depending on the state and court. One must contact the court for the exact wording of an expungement proceeding.

    A judge will take into account the nature of the crime as well as the seriousness of the act. Major felonies generally will not be excused through this type of court proceeding. Also, any requirements in place as penalty consideration from the criminal conviction will be reviewed. Completion of jail sentence and/or probation requirements are key factors in moving forward. Further, one must have a clean record. Generally a single extraordinary event will be considered. Those that show continued criminal behavior or have court cases pending will face an insurmountable uphill climb and may not be considered.

    Simply put there are a few key elements to be aware of before commencing in a civil court expungement request:


    •     a single conviction with a significant amount of time passed between conviction and request for expungement

    •     no additional criminal activity or court action pending

    •     completing all sentencing requirements as well as probationary requirements

    If the above general conditions are met the consideration for an eviction record or criminal record expungement may be considered. If an expungement is granted public record databases are required to remove all record of the conviction expunged.
