    Family of slain Yale student sues university

    HARTFORD, Conn. (AP) — The family of a Yale University graduate student killed in a research lab just days before she had planned to get married in 2009 sued the Ivy League school Tuesday, claiming it had failed to adequately protect women on campus for years.

    The wrongful death lawsuit was filed in New Haven Superior Court by lawyers for the family of Annie Le, a 24-year-old Placerville, Calif., native whose strangled body was found stuffed upside-down in a wall at the Yale lab building on Sept. 13, 2009. That was the same day of her scheduled wedding and five days after she disappeared. Prosecutors also said there was evidence of a sexual assault.

    Yale officials said in a statement Tuesday that the lawsuit had no merit and no additional security measures could have prevented the killing.

    An animal research technician who worked in the same building, Raymond Clark III, was sentenced to 44 years in prison in June for murdering Le. He apologized for the crime at the sentencing hearing, but offered no explanation.

    The lawsuit claims that before Le's killing, Yale had for years failed to take adequate steps to protect women on the New Haven campus. It also claims school officials should have known that Clark posed a potential danger to Le's safety, because he had previously demonstrated aggressive behavior and a "violent propensity towards women."

    In April, the U.S. Department of Education's Office for Civil Rights confirmed that it was investigating complaints by Yale University students that the university had a sexually hostile environment and failed to adequately respond to sexual harassment concerns.

    "Yale's persistent tolerance of sexual harassment and sexual assaults on campus caused students to file (the) complaint against Yale University," the Le family's lawyers, New York-based Joseph Tacopina and Stamford, Conn.-based Paul Slager, said in a statement Tuesday. "And, just five days before she was to be married, Annie Le was a victim of that environment."

    The lawsuit, which names Yale University and its medical school, only says it is seeking an unspecified amount of money greater than $15,000, which is standard in Connecticut when lawsuits are first filed. The damages and legal fees sought by the plaintiffs could total in the millions of dollars.

    The Yale statement said the lawsuit "serves neither justice nor Annie's memory, and the university will defend against it as appropriate."

    "Yale had no information indicating that Raymond Clark was capable of committing this terrible crime, and no reasonable security measures could have prevented his unforeseeable act," the statement said.

    The building and labs where Le and Clark worked were accessible only to people with security cards that had to be swiped through security boxes.

    A spokesman for the Le family didn't return a phone message Tuesday.

    Relatives previously have said that what should have been a joyous wedding suddenly turned into mourning the loss of a woman whose research included finding new treatments for chronic diseases. She was a doctoral pharmacology student who worked on a team that experimented on mice as part of research into enzymes that could have implications for the treatment of cancer, diabetes and muscular dystrophy.

    Lab workers told police that Clark was controlling and viewed the lab and its mice as his territory.

    Clark pleaded guilty in March to murder and attempted sexual assault under an agreement with prosecutors. The sexual assault plea was entered under the Alford doctrine, where the defendant doesn't agree with the allegations but concedes the state has enough evidence to get a conviction.

    Prosecutors said there was evidence that Clark tried after the killing to generate an alibi, scrub the crime scene and even fish evidence out from behind the wall. Clark appeared happy in surveillance video taken before the killing, but later he was alone with his face in his hands at a time authorities believe was after the killing, authorities said.

    Authorities said Le had broken bones and that her underwear had been disarranged. She was 4 feet 9 inches tall and weighed 89 pounds, while Clark was 5-foot-9 and 190 pounds.

    Prosecutors also cited DNA evidence, including Clark's semen and a pen under Le's body that had her blood and Clark's DNA. Court papers describe a bloody crime scene and Clark's efforts to scrub floors. Investigators say Clark tried to hide a box of cleaning wipes that later was found to have traces of Le's blood.

        welcome to the liberal state of CT. Two men raped, murdered, and set on fire the entire family in Cheshire CT and only one got the death penalty...the one who set the fire. I grew up there and glad to be rid of that type of political #$%$ The case was so awful my entire family has been forever affected

      I don't know about suing Yale, and don't care. What bothers me is that no one is talking about the person most responsible for Ms Le's saftey, Ms. Le. I am not blaming the victim, what I AM saying is that woment need to accept that generally speaking they are smaller, weaker, and less aggressive. Because of this you need to be smarter, and frankly most of you are. If you cannot beat your attacker in one on one combat, and odds are you can't, you need a "force multiplier" and the most effective one is simply a handgun. Even extensive martial arts training, a time consuming and expensive practice, cannot assure your safety, if it could then that is what police would use, rather than guns, tasers and clubs.Police and security cannot be everywhere so society cannot assure your safety, that means you have to be the one who does so. Petition your legislature to make it easier for woment to get the firearms training they need, and the permits to carry that are needed to defend themselves. I know I will get a storm from people who oppose guns at all costs, and even some who will claim that law enforcment do not want civilians to be armed, all of which is irrelevant, I am betting that had Ms. Le been armed and trained in the basic use of a fire arm as needed in a urban setting, we would be talking about an assailant who was shot or frightened off and she would be with her husband.

      If the family wants to sue the party responsible for their daughter's death then they should go after the estate of the confessed murderer, Raymond Clark. The only reason they are going after Yale is that Yale has deep pockets and some greedy lawyer smells an opportunity for "Jackot Justice" and he will skim off at least 1/3 of any award. I would not force Yale to pay the ridiculous parents one effing cent. The homicide was NOT Yale's fault; it was the fault of Raymond Clark!!!!!

        Yale does prohibit folks from carrying the means to protect themselves. From their policy on violence on campus:

        "The University specifically prohibits the possession of weapons by any faculty or staff member, student, or visitor..."

        Would not this anti self protection policy therefore imply that they have the responsibility to provide a safe learning/working environment?

Unless you are capable of mind-reading, I think it's presumptuous of you to say "the only reason...." without at least prefacing your comment with "in my opinion"...And calling Annie's parents "ridiculous" is just plain rotten - these parents are dealing with the horrific murder of their daughter. They have every right to sue and I think (in my opinion) that their lawsuit has more merit than at least 80% of lawsuits being filed on a daily bass. Let the courts decide. Finally "in my opinion" you're a moron.

      After that tragedy was brought to light, I had no idea Yale had such a sordid reputation. So many people attended and graduated there, of such hight esteem, reads like a popular who's who. They say the campus is dangerous, located in a dangerous city. What Yale? They say the professors are always on the lookout for sex. The allure is the prestige and education, I'm sure. Other than that, sounds like any other larege state campus.

      If CHL holders were allowed to carry on campus, a lot of this sort of crime would simply vanish. The great thing about a gun free zone, in the eyes of a criminal, is that you know no one will be able to defend themselves in the zone. It's like shooting fish in a barrel.

      if you are a white washed asian, just becareful, god has a way to punish people like you, you will most likely died from a horrific death like so many in the past. but then again most of these white washed asian are a dime a dozen, there are so many yellow hoes in this world, cheap cheap $10. LMFAO!!! i remember one of my roommates went to asia and got this yellow hoe pregnant, when the baby was born, it has slanted eyes, he just dumped the botch and left her. LOL!

      Albeit without question a horrible tragedy, unfortunately this lawsuit is completely misdirected without any merit whatsoever. The Le family is not doing the spirit of there daughter any favors by trivializing her wrongful murder with really what amounts to be a ridiculous case. While there is most certainly anger in all of there hearts over the loss of their loved one, they should elect a more healthier effective way upon which to vent it rather then wasting the legal systems resources.

      I know this falls on too many deaf ears, individuals with little brain power. But I will say it again. Keep race out of this. It has NOTHING to do with it. Maybe we should go back and have another Civil War. From the looks of it, those men in that war died in vain. Shame on the predjudice in this country!       Clark was a Yale employee. As such, the University could be liable under Vicarious Liability. The Le Family has a case.
