    FCC adopts new rules against 'robocalls'

    NEW YORK (AP) — The federal government is cracking down on "robocalls," those automated phone calls with the tendency to interrupt Sunday dinners and otherwise annoy consumers.

    The Federal Communications Commission said Wednesday that it will now require telemarketers to obtain written consent from people before placing a robocall. Written does not mean handwritten, though — electronic forms are OK.

    The new rules also eliminate a loophole that allowed telemarketers to place robocalls if they had an "established business relationship" with the consumer. Now, they will have to obtain consent even if they had previously done business with the person they want to call.

    Telemarketers will also have to provide an automated way for people to revoke their consent to the robocall by pressing a few keys on their phone during the call. If this happens, the new rules require telemarketer to add the person to the company's do not call list.

    The FCC said it is not changing rules that apply to informational robocalls, such as airline flight updates, school notifications or warnings about suspicious bank account activity.

    The FCC and the Federal Trade Commission already had rules aimed at preventing unwanted marketing calls. But the FCC said despite this, "too many telemarketers, aided by autodialers and prerecorded messages, have continued to call consumers who don't want to hear from them."

      I think telemarketing is outdated and should be banned all together. I like the get tough approach and hope it works, I hate these calls.

        If I get a call from a telemarketer who is a real person. I let them start their pitch. Then I tersely state. "STOP" if they keep going I will ask them again "STOP" usually they do. Then I tell them "I KNOW YOU ARE READING FROM A SCRIPT LOOK AT THE BOTTOM AND TELL ME WHAT WHATEVER YOUR SELLING IS GOING TO COST ME" I don't let them speak again I just keep repeating it. They hang up on me.

      They need to include collection companies. I have been getting calls for people who do not live at my number for over a year now, and they always want me to call them, and I can not hit Zero or anything to get a person. Plus they do not even say who they are calling for.

        @Terry: I don't have roommates and have never had one late payment but I get collection calls for neighbors and distant relatives. When I say I don't know them\they don't live here or what it is about the people on the phone get rude and acusatory. Worse yet is the fact that these people spoof their callerid info so you can't find out who it really is to file a complaint.

        This has happened to me recently, since I got a new cell phone carrier and I got a recycled phone number. I told them to stop calling me and when they didn't, I filed a complaint with my state attorney's office. Guess what? The calls stopped.

      So what. The FCC is not enforcing the rules in place now. I get unwanted calls every day from companies I never dealt with even though I have been on the Do Not Call list since it started. When I ask the caller why he is calling when I'm on the list they are always prevent to not know about the list. Asking to be taken off their calling list does nothing. BTW, if you have not renewed your phone number on the Do Not Call list, it may have dropped off after a couple of years. Mine had at one point about a year ago.

        I have to agree, I get calls constantly, usually a recorded message and I file a complaint within minutes of the calls. Same on my wife's cell phone, on my business phone and my home phone. Nothing seems to be being done about what is already in place. All my phones are listed on do not call.Typical Fed, let's not enforce what we have, let's make up some new #$%$ rules. When that doesn't work we'll write a bunch more rules.

        ROFLMAO....your stupidity amazes me......If you cannot find out who is calling you what makes you thing the FCC can? Morans....Contact your local phone company and block the dam fake number....Problem solved.

      How about passing a law that would make it illegal to use fake numbers on the caller ID?
      I get calls all the time from telemarketers and if you call them back to ask them to remvoe you from their list you get a recording saying the number does not exist!

        B Fast, the law is FCC 47 CFR 64. The law also states that the number used for caller ID has to be registered in a switch, so toll-free numbers cannot be used.

      Require companies to call from a registered number that shows up on a caller ID. I should easily have the option to press a key and the phone company should never forward that call again. I would love to be able to access my phone account and see a list of numbers that I had blocked and manage from there.

      they still will not obey the law since there is little policing of them. For years now I get the same "there are no problems with your credit card......" the robo call is from one company and routes the call to their sister company call center in Florida. Does not matter how many times you use the automated do not call or ask the agents (if they even stay on the line once they know there is no commission to be made). Some months i get daily calls others bi-weekly.

      About time!!!! I get 4 or 5 robo calls a day on my land line and more annoyingly on my cell phone. They won't show who is calling; don't leave messages if you let it ring through to voice mail; and sometimes when you do pick up they have some idiotic recording asking you to press some number; of course it is thieves because they are asking you to press numbers without even identifying who the heck they are.

      Jail isn't quite good enough for the owners of these robo calling mills. There are things made for corporal punishment; public lashings, and this is one of them. Tie them to a telephone poll and let all who wish take one swing.

      You still can't beat an outdated, old answering machine screening those telemarketer or even bill collector calls. I especially love how the old answering machine fools their automated out-dialers every time. Once a dialer hears the answering machine outgoing message, it always connects the call on through to either a "robo" announcement or a live person who finds themself yelling, "Hello, hello!" into the machine. My "robo" for your "robo". ;o)

      Fat lot of good this will do. Most of these calls are to numbers already on the DNC. These crooks certainly don't care, and they don't ever seem to get caught, so why should they?

      This is all really stupid. You get on the DO NOT CALL LIST, and you still get robocalls. But the FCC says that now you can opt out of these calls that you should not be getting at all in the first place. I think that that is about the size of it.

      The majority of calls I get are from charities (who are, I assume, still exempt from most of these regulations), the Red Cross (who really love my platelets), and boiler room outfits that ignore the laws anyway ("This is Rachel/Nicole/Michelle/etc. from Credit Services..."). And one bunch who presumably got my name from a diabetes website who keep wanting to sell me no-name testers and strips - they also smell of the boiler, actually.

      This may keep my credit cards and bank from unsolicited calls to sell me identity protectionm mortgage insurance, refinancing analyses (for pity's sake, I refi'd the mortgage in December - a bit early to see if I "qualify" for a lower rate, innit?). That would be nicem but they aren't that frequent.

      Another law to ignore? I'm on the do not call list and they still keep on calling. I have no intent to do any business with anyone who does not obey the law, I also include the politicians that conveniently exempted themselves. I pay for my phone for my convenience, not theirs.
