Federal judge delays Utah immigration law ruling

SALT LAKE CITY (AP) — A federal judge is postponing a decision on Utah's immigration enforcement law until after the U.S. Supreme Court rules on a similar law in Arizona.

U.S. District Judge Clark Waddoups (WAH'-duhps) says there are enough similarities between the Utah and Arizona laws to justify the delay. A previous order putting the Utah law on hold will remain in place.

The Supreme Court plans to hear arguments on the Arizona law in April and is expected to issue a ruling in June.

Justice Department lawyers and civil rights groups say the Utah law usurps federal authority and violates civil rights. Utah attorneys contend the law is constitutional and simply mirrors federal law.

The law requires people arrested for serious crimes to prove their citizenship but gives police discretion for people committing lesser crimes.

"Utah law usurps federal authority" Is not the Federal Authority limited by the CONSTITUTION, and State rights are to prevail?
      • ProudAmerican 3 mths ago
Yep, but of course our Dictator in Chief fails to recognize that and his AG backs him.
      • Pete 3 mths ago
        So does all sanctuary cities.
      • Sweet 3 mths ago
The traitors running sanctuary cities should be arrested and sent to Gitmo... or deported to Tijuana.
    • Da Vern  •  Greensboro, North Carolina  •  3 mths ago
Illegal. A word only criminals and our govt. cannot understand the meaning of.
      • Steve R 3 mths ago
Because it describes both of them.

Check Obama's new budget, and hopefully it will not pass. It seems he takes all money away for fighting AGAINST illegals. What a piece of work, does he need votes that badly?
    • Pete  •  3 mths ago
If places like Arizona and Alabama are usurping the governments authority then so are sanctuary cities.
    • Barry  •  Reno, Nevada  •  3 mths ago
Do you ever see the US Justice Department go after Sanctuary cities or a publically funded Dream Act?

Anyone residing, working, and studying in the US without documentation issue by the USCIS, is ILLEGAL, a breach of the federal immigration law or INA (Public Law passed by the US Congress and signed into law by the US President), a deportable offense.

BTW under INA 287(g), local law enforcement were trained by USCIS to apprehend, detain, process, and transfer ILLEGALS to ICE detention center for deportation proceeding.

We all need to send this to Judge Waddoups and state leaders and federal govt. leaders. Thankyou for the info. Also read 14 Amendment Section 3 about Treason and our federal leaders committing treason.....Also read about birthright and see that illegals shouldn't be allowed.I want to know why any of this is being allowed.
      • willie 3 mths ago
Jacal, didn't you get the memo ? Our leaders are above the law and cannot be held accountable ! EVIDENTLY :::::::::
      • Gordo 3 mths ago
Just this week the administration has announced that it is shutting down INA 287(g). That is a sign that it was very successful.

State and local law enforcement officials have the general power to investigate and arrest violators of federal immigration statutes without prior INS knowledge or approval, as long as they are authorized to do so by state law. There is no extant federal limitation on this authority. The 1996 immigration control legislation passed by Congress was intended to encourage states and local agencies to participate in the process of enforcing federal immigration laws. Immigration officers and local law enforcement officers may detain an individual for a brief warrantless interrogation where circumstances create a reasonable suspicion that the individual is illegally present in the U.S. Specific facts constituting a reasonable suspicion include evasive, nervous, or erratic behavior; dress or speech indicating foreign citizenship; and presence in an area known to contain a concentration of illegal aliens.

@ PhilB: You can vere all you want but the law is already on the federal books that visitors to this country must provide proof, when ask, that they are in this country legally. What country doesn't have this?

These headlines are so misleading. Surely they mean ILLEGAL immigration. If you are an immigrant we will welcome you. Not the ILLEGALS though. We don't want you in our country. Go suck off of your POS government.
    • V  •  3 mths ago
I really wish the news media, reporters and our government would stop trying to paint these criminals as something other than the criminals they are. Once again people, An immigrant is someone who enters this country through legal channels, learns and uses the language and follows our laws. An ILLEGAL CRIMINAL, not an immigrant, is a person who enters our country by any other means. Generally, refuse to learn and use English or follow our laws and have been known to demand everything.

LEGAL immigrants are welcome, ILLEGAL criminals are not welcome and should feel free to leave very quickly on their own or be immediately deported when found. Not 1 illegal criminal should be allowed to stay in this country EVER for any reason! If your here illegally based on an anchor baby, make a choice...take the kid with you...OR...sign away all rights to the kid and leave anyway.

I say the police should start a fund. Of that money whenever an illegal is caught they should be bussed to Washington DC and dropped off on the white house and capital lawns. give them water and a sandwich so it will not be seen as cruel and let them go. I am willing to bet after the first month and hundreds of thousands are dropped off there the legislators will change their stance. Especially after the kids of the legislators catch many different disease and get robbed by them. Just a thought. The illegals would get to stay and washington would have lots of cheap labor to do what neds to be done.

What needs to be done is stop the incentives for coming here. Stop sanctuary cities, use e-varify, no automatic citizenship unless the mother is a citizen.

It's high time we have a Court System that ENFORCES THE LAWS WE HAVE ON THE BOOKS and leaves States to help enforce them or establish their own laws. These illegals are sucking the pure life out of this country's economy.
    • Pete  •  3 mths ago
Being in this country without proper papers = illegal
Using false Social Security numbers = crime
Working off the books/ getting paid under the table is tax evasion = criminal
Collecting social benefits without properly disclosing income = fraud
I'm trying to find a way that illegals are not criminals.
    • whyj  •  3 mths ago
      "illegal" immigrants are criminals. period!
