Filipino maid wins landmark HK case on residency

HONG KONG (AP) — A Filipino maid in Hong Kong has won the right to apply for permanent residency in a landmark legal victory for hundreds of thousands of foreign maids fighting for equal treatment.

The Court of First Instance rejected arguments by Hong Kong government lawyers that the foreign maids did not have the same residency status as other foreign residents.

Friday's ruling says that the immigration provision denying them the right to apply for permanent residency after seven years was inconsistent with the Basic Law, Hong Kong's mini-constitution. Other foreign residents have the right to apply after that time.

About 290,000 of Hong Kong's 7.1 million people are foreign maids. Most of them are from the Philippines or Indonesia.

You set precedence...and hell of problems will set in.....so the HK govt is appealing...but it's your govt ....sure u can do something ....right???

Round 1 - Maid win, Round 2 - Government win. Just introduce legislature that limits maximum working years for maids in HK to six years and introduce points based system of assessment for eligibility for permanent residence. I doubt the HK government will be so naive to allow 300 thousand maids to be PR.

How long before the mainland Chinese reverse this.

That's a lot of maids, 5% of the population. Are Chinese Hong Hong people THAT busy that they can't maintain their small apartments without help?

im glad that the HK court had the guts to pass the right judgment but the chinese as people are (not all but most) racist by nature...the immigrants will not be accepted there

They are already there. That is the point. Others are granted permanent residency if they've been there for 7 years. There are thousands of filipinos in HK in every sector.

they are everywhere... HK, SG,... full of them... flooded... can u understand the true citizens dun feel at home at all... work permit not enough they want PR!

Based on their law, it is legal to apply and become a citizen if you work there for so much years. They give sweat and tears to work there just like anybody working in Hong Kong. So why these negativity from other comments. Blame it to those who wrote their Basic Law and not those who work honestly for their families.

Another point is that every person is a rationale being and wants to go to greener pastures. Why do other foreigners work in Hong Kong and not their country, even those coming from first world countries? It's because they have a greater returns if they work there. If I say that an American works as a maid in Hong Kong, will they deny them of citizenship because he/she works as a maid or will they give the citizenship because he is from a first world country. Please don't be hypocrites.

Yes, even an american won't be offered PR if she works as a maid. The policy discriminates against skill sets, not races. No matter how long you work as a maid it doesn't change the fact that the skill set is not highly valued. Don't jump to conclusion and accuse HK as hypocritical. It only shows your own shallowness and reflects yourself as a racist hypocrite.

Thank God, i'll watched this case from the beginning of the trial and even feel nervous that the court will denied us again but when i saw the news i was so happy.I worked here in HK since 1991 and on the verge of retiring soon but now i'm not sure if i will go ahead of my plan to retire but still i'm so glad that Ms. Vallejos won this case this time, she's representing us who's qualified to apply for permanent residence here.

foreign maid also can becum PR... hah flooded...
      • Agent 86 7 mths ago
Not too likely. Once they become PR they pay taxes and into the Provident Fund. HK is still an expensive place to live especially as mainlanders push up the price of flats so they can hide their money from Momma CCP.

what is even sadder is that america turned its back on their filipino buddies after ww2. instead of rebuilding that great country we in turn helped rebuild japan. why????? dont know.

because americans love the pakis more than the philippines.2nd of all its all glorias fault he was licking the arse of the chinese and pulled out the philippine troops out of iraq.because of 1 OFW that dosent listen

BuzzMan your history is very correct what is even more sad is that the liberation of Manila or Destruction of Manila (the second most devastated city in WW2 after WARSAW) is result of the ALLIED bombing and artillery in its mission to defeat the Japs. which I believe could have been prevented.

Ask the US of A, But my personal opinion is that this was their act of contrition and repentance brought about by the destuction of 2 Atomic Bombs drop in Hiroshima and Nagasaki.

just goes to show us how bad things are financially in the philippines. these poor people are highly educated too and thats what makes this sad. not all are maids though for many come here to america where they do belong and are employeed as teachers and nurses. been to the philippines 3 times and the people are beautiful and friendly. so american like..........

Good news for those OFWs with seven years of residency in hongkong....Congratulations....

Is this really good? Most of these maids have children back home in Phils......they can't afford to bring the child back home. HK won't take their children, only them. Phils girls just need to learn to close their legs and not be spitting babies out to men that always dump them.

Once you give a Pilipino permanent residency they will bring in an army of relatives. They will apply for every freebie service they can get. Hong Kong will be flooded with them like cockroaches.
