Wichita contractor fined $25K after taking payment, failing to build deck for customer

A Wichita construction and remodeling business has agreed to pay over $25,000 in restitution and court fees after the owner failed to build a deck for a customer.

The Sedgwick County District Attorney’s Office investigated Juan Guzman, who owns Guzman Construction, after receiving a consumer complaint, the DA’s office said.

They allege Guzman violated the Kansas Consumer Protection Act after a customer contracted Guzman to build an enclosed deck, but failed to do so after accepting a down payment, a news release from the DA’s office said.

“Guzman admitted to violating the KCPA and entered a consent judgment to settle the matter,” the DA’s office said. “As part of the agreement, he [Guzman] agreed to pay $15,800 in restitution to the consumer.”

A consent judgment is a settlement that resolves a dispute between two parties without admission of guilt or liability.

An additional $10,000 was added to cover civil, penalty, court and investigative fees. Guzman agreed to not do any work that he does not have the license to perform and will get any required permits for future work, the DA said.

He agreed to be placed on a 40-month probationary period with the DA’s consumer protection division.
