France: Ex-head of breast implant firm charged

MARSEILLE, France (AP) — French authorities have filed preliminary charges against the former head of a now-defunct company accused of supplying potentially faulty breast implants affecting thousands of women.

A judge in the southeastern city of Marseille placed Jean-Claude Mas, the founder and former chief of Poly Implant Prothese, under investigation for "involuntary injury," defense lawyer Yves Haddad said Friday.

The judge's decision to release him on euro100,000 ($130,000) bail caused indignation among women who regard themselves as his victims.

"It's an upteenth insult to the victims that he's still free," Alexandra Blachere, who heads an association of PIP implant recipients, said on BFM-TV.

Mas was arrested Thursday. He was ordered by investigating judge Annaick Le Goff to stay in France and not meet with any other former PIP executives, the lawyer said.

The suspect PIP implants have been removed from the marketplace in several countries in and beyond Europe amid fears that they could rupture and leak silicone into the body.

The preliminary charges mean investigating magistrates have strong reason to believe a crime was committed but give them more time to probe to decide whether to recommend it go to trial.

Mas, 72, was arrested at his residence in a Mediterranean coastal resort town as part of a judicial investigation into manslaughter and involuntary injury. PIP's former No. 2, Claude Couty, was also detained.

Police investigators searched the Mas residence and held him for questioning for seven hours before he was transferred to Marseille to meet with the investigating judge.

Mas did not speak to reporters after being released on bail.

"Mr. Mas was finally able to express himself before the judge. He is relieved to have been able to do so," Haddad said. "The magistrate judged that for now there's no reason to charge him for manslaughter because for the moment, there's no sign of evidence of this crime."

"Calm must return to this case," he added.

On the sole charge of involuntary injury, Mas risks a maximum one year in prison if convicted. That isn't sufficient to allow Le Goff to order him held in custody before trial.

In an Oct. 13 transcript of his accounts to investigators in Marseille — a copy of which was viewed earlier this month by The Associated Press — Mas claimed the victims were after money.

According to the account, Mas insisted the silicone gel presented no health risk and said the victims "were filing complaints just to receive money ... they are fragile people or people who are only in it for the money."

A lawyer representing some 50 French women said Friday his clients are horrified at the idea that Mas may end up enjoying the Rivera sun.

They "don't see Jean-Claude Mas in a villa, his feet in the water, on the French Riviera," Laurent Gaudon said.

The arrests ended weeks of speculation about whether investigators would be able to assemble enough evidence to detain Mas — whose location was known to authorities — or any other possible suspects on legal grounds.

Mas had run PIP until the company was closed in March 2010.

France's Health Safety Agency has said the suspect implants — just one type of implants made by PIP — appear to be more rupture-prone than other types. Investigators say PIP sought to save money by using industrial silicone, whose potential health risks are not yet clear.

PIP's website said the company had exported to more than 60 countries and was one of the world's leading implant makers. The silicone-gel implants in question are not sold in the United States.

According to estimates by national authorities, more than 42,000 women in Britain received the implants, more than 30,000 in France, 9,000 in Australia and 4,000 in Italy. Nearly 25,000 of the implants were sold in Brazil.

France has a history of ignoring medical malpractice, the most famous being the tainted blood supply (HIV) that they knowingly distributed.

I like the way the Chinese deal with these criminals.

Where were the regulatory authorities who approved the product and are required to conduct inspections of the manufacturers after approval. Another case of lack of oversite by the European authorities

PS: While some people might say, "natural beauty is best." "fake is trashy" etc, I have one more question...

I notice that a lot of these comments often come from women. Why praise those who are BORN with good looks -- looks they did not lift a finger for, looks they got LUCKY with?

To say that good looks are not advantageous is ridiculous, especially for women. Even today a lot of a woman's worth is seen only in her physical appearance, and it seems to just keep getting more and more competitive. Where I live (Japan) it is shocking how underweight so many women are...and almost everyone walks around in heels and full makeup just to go grocery shopping...

Unfortunately, even with most women putting lots of time into their appearance, there are still the "pretty" girls and the "ugly" girls. I know how it feels to be on both sides of the spectrum, and the treatment as an ugly girl is the hardest...Just because someone is not born a natural beauty (plain or ugly), does that mean she (or he) should have to stay that way forever?

The natural beauty gets all the men (or women), the praise, people go out of their way for him or her, higher salary, better grades, better treatment etc...because they got lucky to be born a certain way...just like Paris Hilton was born into money she did not work for...should she receive more praise than someone who worked their way up???

It is sad that so much emphasis is placed on appearances...Unfortunately, if there was no (to the degree it is) advantages to being good looking, plastic surgery most likely wouldn't be so widespread...Nevertheless, what makes me the saddest is that some women can be so judgmental of other women...despite often knowing first hand the benefits of being beautiful and the sorrows of being unattractive...

I wanted to get the last ones out but my doctor said I shouldn't and got Mentor Silicone / saline gel. Not sure how many more people are going to comment on this article, but I often read comments like, "That's the price of vanity," "That's what you get for being so fake" etc.

I have a small chest, no interest in implants (so this isn't about me), but what is up with the nasty comments about women who get implants for aesthetic purposes? For those of you who leave these types of comments: Are these women getting implants hurting you?

Women pay $5,000, $10,000+ for these -- they paid fair price expecting in return the quality advertised. They don't usually advertise, "These will break in your body and poison you after a couple of months." They advertise, "Lasts for up to ten years. Great quality" etc. This wasn't a case of women going to someone's basement advertised on Craigslist...these women were seeing trained and licensed doctors and surgeons expecting that they could trust them. Not only that, even if they tried, it seems even the doctors and surgeons were unaware of the issues in these implants. If people all around you and on tv are eating cheerios, do you really expect to find cyanide in yours when you pick up a box at Safeway?

Imagine tomorrow you buy a new t.v. or computer and it blows up after a couple of weeks? How would you feel if you saved up for a new car and it breaks down after one year while you are on the road? How about you order some clothing online, and when it arrives it's falling apart at the seams?
