French court upholds Scientology fraud conviction

PARIS (AP) โ€” A French appeals court on Thursday upheld the Church of Scientology's 2009 fraud conviction on charges it pressured members into paying large sums for questionable remedies.

The case began with a legal complaint by a young woman who said she took out loans and spent the equivalent of euro21,000 ($28,000) on books, courses and "purification packages" after being recruited in 1998. When she sought reimbursement and to leave the group, its leadership refused to allow either. She was among three eventual plaintiffs.

"It's a severe defeat for the Church of Scientology, which is hit at the very heart of its organization in France," Olivier Morice, a lawyer for the National Union of Associations Defending Family and Individual Victims of Sects, told reporters after the decision.

Karin Pouw, a spokeswoman for the church in Los Angeles, denounced Thursday's decision, calling it a "miscarriage of justice."

She said the group would appeal the decision to the Court of Cassation and plans to bring a complaint to the European Court of Human Rights. Another complaint is pending with a U.N. special rapporteur.

About 50 Scientologists โ€” holding signs saying "No to a heresy trial" and "No to justice under pressure" โ€” protested outside the Paris court hours after the decision.

During the appeals process, the prosecution had asked for the church to be fined at least euro1 million ($1.3 million) and its bookstore euro500,000. But the appeals court on Thursday instead ordered the same fines as the trial court, euro400,000 ($530,000) for the church and euro200,000 for its bookstore.

Five members of the church who were convicted in the first trial were ordered to pay fines ranging from euro10,000 to euro30,000. Four of them were also given suspended sentences between 18 months and two years.

In the original trial, prosecutors had tried to get the group disbanded in France, but the court declined even to take the lesser step of shutting down its operations, saying that French Scientologists would have continued their activities anyway.

Pouw said Thursday that the church was continuing its missions without any restrictions.

"The environment in the court was so prejudicial that defense attorneys walked out of the proceedings in protest, refusing as a matter of conscience to participate in proceedings that had degenerated into a charade," she said by phone.

While Scientology is recognized as a religion in the U.S., Sweden and Spain, it is not considered one under French law.

Founded in 1954 by science fiction writer L. Ron Hubbard, the church teaches that technology can expand the mind and help solve problems. It claims 10 million members around the world, including celebrity devotees Tom Cruise and John Travolta.

Belgium and Germany have been criticized by the U.S. State Department for labeling Scientology as a cult or sect and enacting laws to restrict its operations. France also considers Scientology a sect.

In this one particular instance I'd have to say that France has more common sense than the US does.... kinda like a broken clock being right twice a day kinda thing.

The scientology cult in the US was so successful with their litigious nature that they took over an anti-cult outfit called Cult Awareness Network (CAN). Now CAN can warn the public about all the cults out there except one!

I am embarrassed that the US recognizes Scientology as a religion. They obviously have infiltrated our State Dept. if we are lobbying for them with other nations. Scientology is a criminal organization that uses illegal methods to control and exploit its members. I had a friend who died because of Scientology.

Well, certainly we do not in Europe. Quite the opposite. :)

      Very good job.
At least in France people are not being fooled by the scientology rubbish!
The same should be done in the USA.

The U.S. State Department seems to be on par with most of our federal departments -- inept, clueless, and just plain wrong about 88% of the time. I hope that France, Belgium, and Germany hang tough and resist this bizarre cult. What sort of idiots fall for this lunacy? Cruise is a typical Hollywood dimwit, but Travolta is highly intelligent and should know better.... wonder what he is getting out of it? A man that canny must have an angle.

The cult of scientology, A failed sci-fi writing pedophile is the cults founder. Providing beards for gay actors Travolta, Cruise, Danny Masterson etc.. robbing the none famous cult members of everything not nailed down.

they just dont have the history of christianity and those cults spun off from that fairy tale.

SCIENTOLOGY IS NOT A RELIGION. I can say this because in the UK, it is not considered a religion... my own belief is that it is a nasty little organisation led by lunatics.

In France they are thieves and con artists, in the US they have tax-exempt status.

For those who think other religions are just as bad - you clearly have not researched the facts. Some cults might be bad, including the Washington Times' owners' cult (Moonies), but most religions do not have SECURITY DIRECTORATES whose job is to protect the religion's reputation BY ALL MEANS NECESSARY. Further, find a religion that copyrights its beliefs and will NOT publish them? Further, they use EXTENSIVE BLACKMAIL to trap people and get their money. It is a horrible organization. And effective. Very effective - do not get too much of their attention or your life will become hell.

ay thats why crusie and travolta are about to go and wait for the mother ship.(thought it was funny) ,, and from what I've seen and read it's just susposed to be an idea..not a religion... weird..

I guess Xenu isn't protecting them.

I find it odd that when they describe Scientology, all that is mentioned is a belief that technology "can expand the mind and help solve problems". They mention nothing about Xenu, the evil galactic overlord. Give Xenu his due Yahoo!!! He captured aliens, dumped them in a volcano in Hawaii, and trapped their souls in the bodies of our caveman ancestors for Pete's sake!

I think that is copyright infringement. You may be getting a letter from a Scientology lawyer. ;)

What a joke. Scientology is nothing but a fantasy of L Ron Hubbards , designed solely for the purpose of stealing money. It should have it's tax exempt status removed , without question. As far as the stupidity of it's followers, that's their problem.
      • brian 3 mths ago
That can be said about any religion.
      • Joshua 3 mths ago
Brian, all religions are a fantasy of L Ron Hubbards, designed solely for the purpose of stealing money? That guy is good!
      • skw1rl 3 mths ago
Hubbard once stated (and this is paraphrased, so bear with me) that an easy way to make money is to start your own religion....

Kudos to France for having the smarts to call them out on what they are - a Cult! Common sense will guide you - nobody needs to follow a cult and if they do, they are weak-minded. Do unto others as you would have them do unto you - follow the basic rules of life and you will be fine. What is the matter with all these people who blindly and stupidly follow something as fake and baseless as Scientology, or any other strong-willed religion that does not want to help those less fortunate... it's all a power trip to those religions... nothing more. These fake religions can't get you into heaven any sooner than anyone else - so why waste your time and dollars on them? And if you have to pay them with your hard earned dollars and time, then there's something wrong with YOU!!!

Scientology is a fraud. It does not deserve, in any way, shape or form, to be regarded as anything but a cult like sect. It the only "religion" who asks money for "salvation" and won't let you leave the organization. That is the definition of cult! Come and get me, you freaks!

Don't most religions expect you to give money? Thought so.
      • frank 3 mths ago
Give money yes, but you do not have to, and you can leave whenever you want.
