    Gay marriage in California on hold for review

    SAN FRANCISCO (AP) — Same-sex marriage in California is on hold as supporters of a ban on gay marriage said Tuesday they will ask a federal appeals court to review a recent decision that struck down the voter-approved law.

    The 9th U.S. Court of Appeals issued a 2-1 ruling two weeks ago that overturned the ban on gay marriage, saying the ban known as Proposition 8 violates the civil rights of gays and lesbians. Supporters of the ban insist that marriage should be between a man and a woman.

    A legal counsel for the Protect Marriage Coalition said supporters of the ban chose to appeal to a bigger appeals court panel instead of going directly to the U.S. Supreme Court, even though the 9th Circuit is considered to be liberal in its rulings.

    "There is liberal and then there is insanity, and there is just no way the entire 9th Circuit would sign off on a decision like this," legal counsel Andy Pugno said.

    Same-sex marriages will remain on hold at least until the 9th Circuit decides to accept or reject the rehearing petition.

    Proposition 8 amended the California Constitution to outlaw same-sex marriages five months after the state Supreme Court threw out a pair of statutes that limited marriage to a man and woman. Voters approved Proposition 8 in 2008 with 52 percent of the vote.

    The 9th Circuit panel ruled Proposition 8 was unconstitutional because it singled out a minority group for disparate treatment for no compelling reason.

    The justices concluded that the law had no purpose other than to deny gay couples marriage, since California already grants them all the rights and benefits of marriage if they register as domestic partners.

    The lone dissenting judge insisted that the ban could help ensure that children are raised by married, opposite-sex parents.

    "Today's petition shows how far the anti-marriage proponents of Proposition 8 will go to ensure that gay and lesbian Americans remain second-class citizens," said Chad Griffin, president of the American Foundation for Equal Rights, which sued to overturn the California ban.

    The appeals court focused its decision exclusively on California's ban, not the bigger national debate, even though the court has jurisdiction in nine western states.

    Whether same-sex couples may ever be denied the right to marry "is an important and highly controversial question," the court ruling said. "We need not and do not answer the broader question in this case."

    Six U.S. states allow gay couples to wed — Connecticut, New Hampshire, Iowa, Massachusetts, New York and Vermont — as well as the District of Columbia. California, as the nation's most populous state and home to more than 98,000 same-sex couples, would represent the gay rights movement's biggest success so far.

      If the "VOTERS" approved it why is this a question for any court? Clearly that means there were more supporters than non-supporters of it being legalized. Isn't that what voting is for? So that the people have a say? If the voters do not have a say why hold the #$%$ polls anyway.

        First, the constitution strictly states that no majority (heterosexuals) may supersede the rights of a minority (homosexuals). Second, the votes were sabotaged. It was discovered that a large group of mormons paid a vast number of voters to vote against gay marriage equality. It had to be tossed out.

Two consenting adults who love each other and want to commit to each other legally for the rest of their lives should not be placed on hold. You say gays want special treatment, but look what you are doing, you as a heterosexual are the one asking for special treatment.

      As a Grandpa in my life I have only know on case where a woman decided she was a lesbian and divorced her husband, yet in my entire graduating class there are only five couples still married. So how do you say gays are destroying marriage when you have already ruined it with your own divorce. Oh, I see you need someone to blame for your short comings. Go get comfort from your priest then follow him to the gay bar at night as they say the church is against gays. Just the exact same thing Jesus would do, hate a minority.

      OK, open question to all those who claim that all gay people have made a choice to be gay.
      The implication of that is that at some point in their life the now gay person had attraction to the opposite gender as well as the same gender (otherwise how would a choice have been possible.) At this point, the now gay person decided that they would be with their same gender.

      Does that sum up the argument of choice accurately enough?

      Now, the open question - If the gay person had this choice, when was it that you made the choice for heterosexuality? When in your past did you view the same gender and the opposite gender with desire and decide that you would only be with the opposite gender?

      This now puts you in a position of having to admit that at some point in your life you had homosexual tendencies or that you never made a choice for your sexuality? If you've never made the choice why do you insist that others might also not have made a choice.

What do you care about people who don't affect your marriage anyway? I couldn't imagine voting against someone else's pursuit of happiness and financial security when it doesn't affect me.       Marriage equality is being approved in more states than ever. I'ts hard to believe that the state that has the most same-sex couples is having difficulty legalizing marriage. 16,000 couples were allowed to marry in a five month period before hate filled voters outlawed it. The constitution says that once rights have been granted to a minority group, they cannot be taken away by the voters. Those hate filled people who want to disriminate based on religious beliefs are going to have to accept that dicrimination is immoral and unconstitutional. Government and courts, not churches decides who is allowed to get married

      Why are all these anti gay marriage posts always using Christianity as the reason to not approve anything gay? Being gay is not whats in question. This is a LEGAL situation that will NOT involve anything regarding the bible or its approval or lack of approval of homosexuality. That is NOT the issue! The Bible will not stop gay marriage! If you want to stop gay marriage you have to provide actual evidence that it will somehow give a negative impact to the rest of society. There isn't any evidence and there will NEVER be any evidence to support that and thats why fighting gay marriage is a losing war. You can create as many bumps in the road as you want but the law will always prevail and the USA laws demand that all people be treated equally. Case closed.

      I know this comment will get thrown back at me, but...that's the dumbest thing I've ever heard.

      If you want to ensure that children are raised by a married couple, step 1 would be banning divorce for couples with children. Step 2 would be some kind of regulated breeding to stop people from having kids out of wedlock. Banning gay marriage does absolutely nothing to ensure that children are raised by an opposite-sex married couple. It doesn't even prevent a same-sex couple from raising children.

      If you want to ban gay marriage you have a right to make that argument. But a little bit of logic would be nice.

      On another note, it's awesome that these anti-gay marriage people (let's cut the nonsense- it's not about "protecting" anything) have infinite resources and choose to use them on this issue. There's absolutely nothing more pressing that could be addressed with all this energy, all this cash being given to lawyers?
