    Ginsburg questions 1973 abortion ruling's timing

    NEW YORK (AP) — Supreme Court Justice Ruth Bader Ginsburg suggested Friday that her predecessors on the high court mistimed the milestone 1973 Roe v. Wade case that legalized abortion nationwide.

    "It's not that the judgment was wrong, but it moved too far too fast," Ginsburg told a symposium at Columbia Law School marking the 40th anniversary of her joining the faculty as its first tenure-track female professor.

    At the time of Roe v. Wade, abortion was legal on request in four states, allowed under limited circumstances in about 16 others, and outlawed under nearly all circumstances in the other states, including Texas — where the Roe case originated.

    Alluding to the persisting bitter debate over abortion, Ginsburg said the justices of that era could have delayed hearing any case like Roe while the state-by-state process evolved. Alternatively, she said, they could have struck down just the Texas law, which allowed abortions only to save a mother's life, without declaring a right to privacy that legalized the procedure nationwide.

    "The court made a decision that made every abortion law in the country invalid, even the most liberal," Ginsburg said. "We'll never know whether I'm right or wrong ... things might have turned out differently if the court had been more restrained."

    A similar dynamic is now unfolding in regard to same-sex marriage, which is legal in six states, could soon be legal in a few more, but remains outlawed in most states. Legal advocates on both sides of the issue wonder if the Supreme Court will want to have a say on the matter relatively soon, or let the state-by-state process evolve further. Ginsburg did not comment on that issue.

    On another topic at the symposium, Ginsburg said countries in the Middle East and elsewhere contemplating the adoption of new constitutions have more up-to-date models to consider, in addition to the U.S. Constitution.

    "If you're writing a constitution today, are you going to look back at an 18th century model?" she asked, before citing such newer documents as South Africa's 1996 constitution and Canada's 1982 Charter of Rights and Freedoms.

    Ginsburg noted that most modern-era constitutions have guarantees of gender equality comparable to the Equal Rights Amendment that has been proposed — but never ratified — for the U.S. Constitution.

    "An Equal Rights Amendment is not a cure-all," Ginsburg said. "It takes people who care about implementing the rights to see that it becomes real, and not just on paper."

    Much of the symposium was devoted to Ginsburg's decades of work promoting the equality of women in the legal profession and in American society overall.

    She recalled entering Harvard Law School in 1954 as one of nine women in a class of several hundred.

    "You felt that all eyes were on you and if you gave a wrong answer, you were failing not simply for yourself but for all women," she said.

    After transferring to Columbia's law school and graduating in 1959, she taught law at Rutgers University, then joined the Columbia law faculty in 1972 and taught there until 1980, when she was appointed by President Jimmy Carter to the U.S. Court of Appeals in Washington.

    While at Columbia, she expanded the school's offerings of courses on women's rights and sex discrimination, and also became chief litigator for the American Civil Liberties Union's Women's Rights Project.

    She recounted many of the gender-equality cases that arose during her career — among them writing the majority opinion in the Supreme Court's 1996 ruling striking down the male-only admissions policy at Virginia Military Institute.

    Asked to offer advice to young women starting law careers, she said the biggest challenge is trying to balance work life and family life in a profession that traditionally hasn't embraced that balance.

    "That's changing, but not swiftly," Ginsburg said. "It takes people who care."

    She offered one last suggestion, when asked how today's young lawyers should be battling against injustice.

    "Don't take no for answer," she said. "But also, don't react in anger ... Regard every encounter as an opportunity to teach someone."

      I know she believes in what she is saying, not just the comments about abortion but about the Constitution as well. But she has spent her entire life in the insular world of acadamia and never really lived out in the real world. She is text book and theories, not actual experience. Out here, where it is much rougher and not so black and white, women and girls face the fear of angry parents, being pregnant alone, pregnant with brutal men, pregnant with men who say they will abandon them if they keep their child. The sad thing is they are so afraid, and so without anyone to turn to, that killing their children seems like the only option. And that decision is made before she has a chance to see the baby as anything more than morning sickness and a feeling of panic. Don't forget, abortion and the sale of babies and their body parts is one of the largest industries in the US; they are not in it to help anyone. Look up biological supplies, and you can find slides, organs, even whole fetuses for sale, including the placenta. They are not cheap.

      People just don't get it. I love how so many people have an opinion (including me) on this subject and yet I don't see people lining up to help on a personal level single mothers who already have babies in this world. The next cry is "I do, I pay taxes and they are probably on welfare!". Well guess what, these kids need more than just money, they need time - positive male role models among other things". "Well, where are their fathers?" Some of them do have their biological fathers and others don't. And welfare does not cover all.

      This should be no one's business but the woman, the person who impregnated her, and her Dr.'s. This means that there should be more access to free contraception and education to avoid unwanted pregnancies in the first place.

      How is it anyone's right to say what people can and cannot do with their bodies? It isn't. Get your nose out of their business. Otherwise, get your nose down to the local boy/girls club of America, your local community centers, etc. and find someone to mentor. Donate new clothing and school supplies, pay someone's utility bill and make sure you are donating at least 10% of your time and money every month, this will surely make a difference in a lot of lives for a LOT of children who are already here instead of crying about fetuses who aren't. Children who are living in poverty aren't exactly living a great lifestyle, but instead are dealing with thugs on the corner, hunger (it makes it a tad bit harder to study when hungry; studies have already confirmed what poor nutrition does to a child), having to pull themselves out of extraordinary situations and crummy schools.

      Otherwise it is just blah blah blah blah blah blah blah and self righteousness. For those who already donate time and money, great! For those who don't today is a great day to start! Or SHUT THE FLIP UP and MIND YOUR OWN BUSINESS.

        Honey, seriously?! There is plenty of education on this subject. I went to public school and they started teaching us about contraception in 4th grade...yes, 4th grade! I knew since I could remember to use at least 2 forms of contraception (ie condom/withdrawal for guy and BCP/sponge for woman). The problem isn't lack of education...the problem ishorniness gets in the way of using that education and the other problem is playing with fire (sex) and thinking you won't get burned (get pregnant) if you are careful...you can still get burned even if you are careful!

        It's great that you value women's rights. Some people choose to value not only women's rights, but also the rights of the unborn children, who are having their life ended, who can not able to speak for themselves. Some people believe that everyone deserves rights. Some people believe that no one should be able to end another person's life and strip them of their most basic right to exist. Some choose to value all forms of human life and their respective rights as such.

        We ARE penalized. A woman can get pregnant without the consent of the man, and we pay for the next 20 years. Likewise, a woman can get pregnant with the help of a man (turkey basting aside), but he has NO say in what she does with the the pregnancy or the baby.

      If one does not want to run the risk of getting pregnant, keep your pants on. Make sure your mate is stable and on the same page about raising children before getting pregnant in the first place. this is my version of "Planned Parenthood". These two simple concepts would cut down on the number of single moms and there wouldn't be so many children being born into poverty and UNFIT homes. Liberals think it is ok to run around and have sex at will with anyone they want and claim that there is no god.
      One thing is for sure, I would rather live my life believing there is a god and find out that there isn't one instead of living my life thinking there is no god and find out that there is.
      It is sad to think that most of the liberal posters on here that support the leftist's views will never get to see the gates of Heaven.

      Marriage is for the promotion of responsible child baring. Again, how does that work in a gay relationship?         Your version of the Constitution, Atheists and liberals are screwed as well. Atheists are against god, but our country was founded on the word of god. The constitution does allow for all of us to succeed. Our laws protect all of us from harm equally. We all are afforded the opportunity of an education, and the right to pursue happiness. You do NOT have a right to HAPPINESS, HEALTHCARE, or anything else that you don't pay for yourself. The liberals feel that they have a right to other peoples wealth just because they are too stupid to come up with their own million dollar idea. While the folks that pay for this countries bills are working hard and limiting their family size, the poor sit on their butts and collect taxpayer assistance and continue to have children that they can not afford. How is this allowed to work? I pay huge taxes, help many people every year, and I am self employed. The private sector can do more for the needy than the government ever thought about.
        Ginsburg is a whack job. The notion that we all must be color blind, gender neutral, accepting of others that offend us, be tolerant of behavior that you know that is wrong is absurd. Personal liberty means, mind your own business and look to your self to solve your own problems just like I do. The game of life is all about personal responsibility and be responsible for the commitments that you make. If you can not afford children, don't have any. Simple as that.
        The wealthy are wealthy because they worked for it. I am not wealthy, but I make it a point to not be a burden to others. Meaning, I pay my way, medical and all. I have no insurance. I will continue to support myself and family as long as I possibly can before I become a burden to the taxpayers. I will NEVER support any group of or cause that goes against my belief system, but I will support an individual in need of basic help. I could go on and on about this, but Ginsburg is wrong about our constitution, and the left is destroying this country. Now stop being a cream puff, and man up, and support yourself. That is one right that will never go away.

      I have to wonder why men feel they are even remotely qualified to say anything regarding women's health issues including whether to become or stay pregnant. Guys, if you don't have boobs, a vagina, a uterus, ovaries, tubes and all the rest of it you're not qualified to say diddly. If you're not subject to cervical cancer, uterine cance. ovarian cancer or uterine fibroids you're not qualified to say anything. The subject of a woman's health is matter between her, her doctor and her husband/boyfriend/significant other with the final decision resting with her. Anybody else's opinion isn't worth squat. So, please, if you don't meet the above requirements don't try to proffer an opinion just because you have one. Remember, opinions are like rectums. Everybody's got one and everybody's entitled to one and no woman wants to hear yours.

      You should! It is the longest lasting and most stable govt in history.

      Look at the Nixon years, USA survived. Look at the Great Depression, USA survived. Look at the Civil War, USA survived. Look at two impeachments (Johnson & Clinton), USA survived.

      I'd say it has a proven track record, unlike the newer models.

      Women's control over their own bodies waited long enough. Remember - if you take the word of the Bible, God Himself approves of slavery. Right and wrong isnt a popularity contest. Leaders should have the courage to see past the fashion of the day and do what is right.

      This isnt even getting to the Constitutional basis for abortion - which was legal in every state when the bill of rights was ratified - and so should be protected under the 9th amendment.

      State to state laws do not always reflect the rights of all, in the case of marriage it is not fair to say some couple can legally marry in one state, but another then has the right to say it is not legal. If I marry in Oklahoma my marriage is then accepted in all US states and districts. That is not the case for same sex unions, they are not even allow to marry in some states but are limited to civil unions only. Also insurance companies do not have to allow the spouses coverage depending on the laws.
      This to me is a simply case of equal rights for all, like it not they have the same rights as every other American, the laws should apply the same way. Any state that is replying on a law that says "marriage is between a man and a women" is using an out date law written in a time when Americas could still own a slave or a woman was chattle.
      I am not now nor have I in my life time been chattle, nor do I believe any woman is or should be.
      I may not like the idea that my children can not pray in school or have a Christmas play with Santa in it because of religion beliefs of others, but I live with it.
      I believe that the burning or banning of books is wrong, there are many books that are classic well written books that show at time in history that no others can, but because of a few people who feel they are negative millions will miss out. I feel sorry for those who will never get to read the story of Tom Sawyer or see Song of the South, the road to hell is paved with good intentions.
      However gay marriage or abortions are being used as smoke screen to pull voters away from the issue both parties do not want to address in the up coming elections, and Americans are falling for it. The long and short of it is this any state law that does not protect the rights of all legal Americas should not be allow, state laws should not be used to make any one group strong or more important than other or allow one group to impose their believes on another group. Like it or not every America has the same rights as all the others no matter what!
      I do not like the way many Americas live or love, but until I can tell them who to marry or how many kids they need to have then I will keep my options to my self, in turn if they will need to do the same. But for now I am not drinking the KOOL-AIDE JIM JONES, and in my option neither should they, but if they fell froggy then jump.
