    Indiana: Judge blocks right-to-work fines

    INDIANAPOLIS (AP) — A Marion County judge ordered Indiana House Republicans to return fines levied against House Democrats in the right-to-work battle last year and blocked $1,000-a-day fines levied this year.

    Marion County Superior Court Judge David Dreyer ordered Monday that the fines against the Democrats who walked out be returned. Dreyer also issued a preliminary injunction that temporarily halts collection of $1,000-a-day fines levied in this year's boycotts.

    Attorney General Greg Zoeller said Monday that the state will ask the Indiana Supreme Court to review the decision. The state's highest court agreed last month to review the underlying issue of whether the legislature can fine lawmakers and force the state's auditor to withhold those fines from paychecks.

    "We disagree with the trial court's prolonging this internal dispute and the precedent it would establish, and we will respectfully ask a higher court to redirect the dispute promptly and conclusively to the place it belongs: the Legislature," Zoeller said in a statement.

    Mark GiaQuinta, a lawyer for the House Democrats, said Dreyer's orders reinforce the Democrats' argument: House Republicans cannot arbitrarily order the state to withhold money from lawmakers. The 31 House Democrats who signed onto the lawsuit filed by Rep. Bill Crawford, D-Indianapolis, should all see their money returned, GiaQuinta said.

    House Democrats boycotted the House for eight days this session and five weeks last session in an effort to block right-to-work legislation. The move had denied Republicans the number of members needed to conduct any business and also spurred Republican House Speaker Brian Bosma to levy fines against Democrats who walked out.

    Last week, Gov. Mitch Daniels made Indiana the 23rd state to ban unions from collecting mandatory fees for representation when he signed the right-to-work legislation.

        right to work does more than give workers a chioce, it also gives the employer a way, through threats and intimidation,not to join. they will give better work assinments to the non union workers and the union workers will be the first to be laid off. they got a choice to join or not, but the employer has a gun to there head while there making it.

      This is the thing people that you don't understand. In a free market system, you have all the power. You can refuse to purchase goods made in China. You can refuse to purchase iPhones, etc. But you won't. You don't need unions ordering you to pay huge fees so their fat cats can live a life of luxury and buy political power. You just need to refuse to purchase items made in China. We don't need unions to have a middle class. If unions just negotiated wages and working conditions, it wouldn't be so bad, but they negotiate things like you can't fire people who suck, etc., and have ended up causing more trouble than they are worth. People have jobs in right to work states and you union thugs are acting like without unions no one would have a decent job or paycheck and that is just a liberal lie. Just stop giving China your money. It is like the price of tickets to sporting events. You have the power not to purchase them and the prices would go down. But again you don't ever want to deny yourself anything and there ya go!

        This is what really happens when the Right to Work takes affect: The non dues paying workers are offered more money. The bargaining workers drop the union affiliation to get that same raise. The union then becomes decertified. The remaining workers then start getting laid off being replaced by people who make half of what the wages used to be. Now the owners of these companies are making even more millions per year. The workers have to work even more hours (now no time and a half pay) to just buy groceries. This is happening right now doofus. Pay attention. NO MIDDLECLASS!!

        Thats funny ed. I know alot of middle class peopel who have never been in a union. They still have jobs and make well over 20 an hour plus benifits. They spent thier time learning a trade skill. ya they didnt need to go to college to learn liberal arts and gain nothing .

      Abitrarily (?) order the state to withold money from state lawmakers? What a bunch of bunk! The dems walked out, abandoned their posts, were derelict in their duty to serve the people! Even if whats happening is questionable, you don't walk out on your job. Anyone/anywhere else would be fired on the spot!

      We can't allow political ideology to corrupt the judgement of our court officials. The people must demand that they be giving more power to remove such judges from the bench. New laws and procedures must be put into place for public review of judges and the people must be allowed to do no-confidence votes in judges, votes which would immediately remove them from office. These scumbags should not be appointed serving more than 2 years at a time anyway.
