Inspection finds restroom, water and food permit problems at a Kendall produce seller

Monday’s problems with hot water, human waste and sewage disposal caused a state inspector to stop “all open food processing/handling” and all use of “food-related equipment and utensils” in the food service area of a Kendall produce market.

This bad start to the week happened to Francis Fresh Market, 12790 SW 157th Ave., which also didn’t have a valid food permit.

These and other violations wound up on the report by Florida Department of Agriculture Inspector Catalina Ordonez. Unlike restaurant inspectors, Ag Department inspectors don’t have the power to shut down an establishment for a failed inspection. But they wield the power of Stop Sale Orders on food and Stop-Use Orders on equipment and areas.

Ordonez made use of those powers:

“The food establishment is operating without a valid food permit and has not met all permitting requirements.”

In the food service area, there was “no hot water available in the establishment at hand sinks and ware wash sink.” This got a Stop Use Order slapped on “all open food processing/handling in the food service area, all food-related equipment and utensils in the food service area.”

“No handwash sink installed at the food service area where open foods are prepared and ware wash sink is installed.” This would have drawn a Stop Use Order, but the hot water problem already took out everything that affected.

“No restroom installed on the premises of the food establishment that prepares open foods.”

“No faucet provided at the wash compartment of the three-compartment sink.” Again, the Stop Use Order this would’ve drawn would be superfluous.

“No well permit issued by the Department of Health for this food establishment was provided during inspection.” Stop Sales hit all the prepackaged food items in the area. The above Stop Use Orders took care of the rest.

The citation: “Sewage is not disposed through an approved facility that is a public sewage treatment plant or an individual sewage disposal system that is sized, constructed, maintained, and operated according to law.” The violation: “No septic permit issued by The Department of Health for this food establishment was provided during inspection.” The punishment: The Stop Sale and Stop Use Orders.

“Raw shell eggs, containers of honey, and pork rinds found in a retail cold unit and on the counter within customer reach were unable to be determined to come from an approved source, with no valid permit or manufacturer information provided by establishment.” Stop Sales on the honey, pork rinds and eggs, which would’ve been tossed anyway for not being kept at a warm enough temperature.

“Multiple bags with beans, lentils, pork rinds packaged on site were found not labeled with the name of the product, manufacturer name and address.” Stop Sales on all this food.

“Live flies flying throughout preparation area.”

“No chlorine test strips available to test the concentration of the sanitizer in the food service area.”

Stop Sale Orders: Beans, lentils, pork rinds, honey for not being labeled with the manufacturer’s name and address. Raw shell eggs for that lack of information and being kept at too warm a temperature.

Stop Use Orders: All open food processing/handling, food-related equipment and utensils in the food service area for various problems.
