    Judge blocks graphic images on cigarette packages

    WASHINGTON (AP) — A judge on Monday blocked a federal requirement that would have begun forcing tobacco companies next year to put graphic images including dead and diseased smokers on their cigarette packages.

    U.S. District Judge Richard Leon ruled that it's likely the cigarette makers will succeed in a lawsuit to block the requirement. He stopped the requirement until the lawsuit is resolved, which could take years.

    Leon found the nine graphic images approved by the Food and Drug Administration in June go beyond conveying the facts about the health risks of smoking or go beyond that into advocacy — a critical distinction in a case over free speech.

    The packaging would have included color images of a man exhaling cigarette smoke through a tracheotomy hole in his throat; a plume of cigarette smoke enveloping an infant receiving a mother's kiss; a pair of diseased lungs next to a pair of healthy lungs; a diseased mouth afflicted with what appears to be cancerous lesions; a man breathing into an oxygen mask; a cadaver on a table with post-autopsy chest staples; a woman weeping; a premature baby in an incubator; and a man wearing a T-shirt that features a "No Smoking" symbol and the words "I Quit"

    "It is abundantly clear from viewing these images that the emotional response they were crafted to induce is calculated to provoke the viewer to quit, or never to start smoking — an objective wholly apart from disseminating purely factual and uncontroversial information," Leon wrote in his 29-page opinion. He pointed out that at least some were altered photographs to evoke emotion.

    The judge also pointed out the size of the labels suggests they are unconstitutional — the FDA requirement said the labels were to cover the entire top half of cigarette packs, front and back and include a number for a stop-smoking hotline. The labels were to constitute 20 percent of cigarette advertising, and marketers were to rotate use of the images. Leon said the labels would amount to a "mini-billboard" for the agency's "obvious anti-smoking agenda."

    The Justice Department argued that the images, coupled with written warnings, were designed to communicate the dangers to youngsters and adults. The FDA declined to comment on the judge's ruling.

    Matthew Myers, president of the Campaign for Tobacco-Free Kids, urged the Obama administration to appeal the ruling that he said "is wrong on the science and wrong on the law." He said a delay would only serve the financial interests of tobacco companies that spend billions to downplay the health risks of smoking and glamorize tobacco use.

    "Studies around the world and evidence presented to the FDA have repeatedly shown that large, graphic warnings, like those adopted by the FDA, are most effective at informing consumers about the health risks of smoking, discouraging children and other nonsmokers from starting to smoke, and motivating smokers to quit," Myers said in a statement. "Because of that evidence, at least 43 other countries now require large, graphic cigarette warnings."

    Congress instructed the FDA to require the labels, following the lead of the Canadian regulations that require similarly graphic images on cigarette packs. The cigarette makers say their products have had Surgeon General warnings for more than 45 years, but that they never filed a legal challenge against them until these images were approved.

    Tobacco companies are increasingly relying on their packaging to build brand loyalty and grab consumers. It's one of few advertising levers left to them after the government curbed their presence in magazines, billboards and TV, and the graphic labels could cost them millions in lost sales and increased packaging costs.

    The cigarette makers that sued the FDA are R.J. Reynolds Tobacco Co. of Winston-Salem, N.C., Lorillard Tobacco Co. of Greensboro, N.C., Commonwealth Brands Inc. of Bowling Green, Ky., Liggett Group of Mebane, N.C., and Santa Fe Natural Tobacco Co. of Santa Fe, N.M.

      If the FDA wants the pictures displayed, they can pay to put up billboards and take out ads. We operate under the Constitution of the United States not the laws of Canada and 43 other countries. I quit smoking some years ago but find the increasing intrusion into the lives of those who choose to use tobacco products a little frightening. We need to look at the tactics of the non-smoking advocates and imagine other ways in which they could be used. Just because in their present form the tactics can be construed as being for the public good doesn't mean they couldn't be used for silencing or misinforming the public in the future.

        Because smoking is the worse legal drug out there - by far. Alcohol and condoms actually do have some health benefits. There are no benefits when it comes to smoking.

        Well, you can look at it like that BUT to be fair smoking helps you lose weight and also relieves stress. You can make excuses for all sins but they all kill. I don't smoke nor drink, nor have any use for condoms (borne again Christian) but NONE of these are good for you! Smoking, Drinking, Sexing....All are dangerous...How bout getting to know Jesus!!

      I hate smoking, however, I hate the intrusion of government into our personal lives more. The court is right, these images are not infmation. what is next, showing fat people on hamberger meet packages, ice cream containers, and cookies. High blood pressure images on salt, chips, and nuts, diabetis warnding on sugar, candy, ....once you open the door it will just never stop.

      I am very happy to read this and not just because I am a smoker, but if the feds and all these "Rob Reiner stop smokers nazi's" got their ways, where would it stop? What would be next? People that are against alcohol would demand that we have "dead-liver" photos on bottles of booze. There would be photos of clogged heart valves on my big mac box, etc. These "people" and or groups should keep these types of propaganda crap in their mouths and or minds instead of trying to tell me what's good and or bad for me when I already know of the consequences. It is my life, NOT yours, so mind your own god#$%$ business ! ! !

      Hey Congress. How about you start focussing on some real issues, instead of trying to regulate our behavior? Just because the only thing 51% of you morons agree on is "smoking is bad for you" or "baseball players shouldn't do steroids", does not mean this is a worthwhile use of your time. This isn't why we hired you.

      How about a law that says "If congress can not pass a budget where spending is within 3% of GDP, then no member of congress is eligible for reelection"? Maybe work on that.

      I am not a smoker. Yet I think that if they push on with this, then they need to be fair across the board. They need to put pictures of livers with cirrhosis, babies with fetal alcohol syndrome, people murdered by drunk drivers, and families torn apart by alcoholism on ALL alcohol products. Why is tobacco demonized, yet alcohol gets a pass? Hypocritical much?

      If they are going to put pictures on the wrappers of cigarettes, then they need to put pictures of fat people on the door of fast food places, the wrappers of ice cream and candy. Including the images of clogged arteries from the fats. They need to put pictures of the effects of perservatives on the products that contain them. If you are going to go after 1 item in this manner then you need to go after any item that has any effect on the human body in the same manner.

This was not the America our founders had in mind. You people who think that government dictates telling us how to live our lives and using the force of law to make us "behave" is a terrible slippery slope we have been going down for years. It amazes me there are so many sheep out there ready to allow freedom to be usurped by our government. I would say, just wait till they want to take away something "you" value, told that it is bad for you. BAAAAAAA!!!! I will never give in. Its kinda funny...the more oppressive the govt becomes, the less inclined SWIM is to obey the law. At this point, SWIM defines his own right and wrong based on his moral code, not on the law as defined by the usurpers of freedom.

      Welcome to the smokers fight. We have opposed for years the picking on the smokers.
      Raising taxes on us and not anyone else banning us from smoking in public. And all others sat back because hey they didn't smoke. Well because of the taxes so many people have quit. The government wants the rest to quit but guess what when they do quit guess they are gonna have to go after someone else. Alcohol most likely will be next. They will tax it and then run campaigns to stop kids from drinking and then put labels on the product warning of the dangers that it causes. Then close the clubs where people go to drink. Then when that is gone they are gonna start on sports. why should it be left to just smokers to burden the weight?
