    Judge dismisses suit on federal stem cell research

    WASHINGTON (AP) — A lawsuit that had threatened to end the Obama administration's funding of embryonic stem cell research was dismissed Wednesday, allowing the U.S. to continue supporting a search for cures to deadly diseases over protests that the work relies on destroyed human embryos.

    The lawsuit claimed that research funded by the National Institutes of Health violated the 1996 Dickey-Wicker law that prohibits taxpayer financing for work that harms an embryo. But the administration policy allows research on embryos that were culled long ago through private funding.

    U.S. District Judge Royce Lamberth, chief of the federal court in Washington, last year said the lawsuit was likely to succeed and ordered a stop to the research while the case continued. But under swift protest from the Obama administration, the U.S. Circuit Court of Appeals here quickly overturned Lamberth's injunction and said the case was likely to fail.

    Lamberth said in his opinion Wednesday that he is bound by the higher court's analysis and ruled in favor of the administration's motion to dismiss the case.

    "This Court, following the D.C. Circuit's reasoning and conclusions, must find that defendants reasonably interpreted the Dickey-Wicker Amendment to permit funding for human embryonic stem cell research because such research is not 'research in which a human embryo or embryos are destroyed,' " Lamberth wrote.

    Researchers hope one day to use embryonic stem cells in ways that cure spinal cord injuries, Parkinson's disease and other ailments. Opponents of the research object because the cells were obtained from destroyed human embryos. Though current research is using cells culled long ago, opponents also fear research success would spur destruction of new embryos. Proponents say the research cells come mostly from extra embryos discarded anyway by fertility clinics.

    President George W. Bush also permitted stem cell research, but limited the availability of taxpayer funds to embryonic stem cell lines that were already in existence and "where the life and death decision has already been made." Obama's order removed that limitation, allowing projects that involve stem cells from already-destroyed embryos or embryos to be destroyed in the future. To qualify, parents who donate the original embryo must be told of other options, such as donating to another infertile woman.

    The Obama administration's rules expanded the number of stem cell lines created with private money that federally funded scientists could research, up from the 21 that Bush had allowed, to around 100 so far.

    The lawsuit was filed in 2009 by two scientists who argued that Obama's expansion jeopardized their ability to win government funding for research using adult stem cells — ones that have already matured to create specific types of tissues — because it will mean extra competition.

      How are we going to advance as a civilization if we allow ourselves to be hobbled by the superstitious beliefs of western religion. It is true that the 'Dark Ages' was sponsored by the catholic church, and that every advance humankind has made, was made over the protests of bible thumpers everywhere.We would be such an advanced civillization at this point in time, if it weren't for the wild-eyed zealots running amuck boo-hooing everything that would make humankind's existence on this planet that much easier.Apparently religion's agenda includes suffering, ignorance and other such nonsensical folderall. Why should we suffer simply for the sake of some #$%$#39;s belief in superstitious fairy tales?Isn't time we acted as the adults we are, than the feeble minded dolts that religion wants us to be as (sic)?

        I like your idea that the Catholic Church "sponsored" the Dark Ages! That's a great image. I can see a pope heading up an advertising campaign. You're absolutely right; I don't know why people can't grow up and begin to think for themselves. Their bible has nothing to tell us about reality in the 21st century.

        Get intelligent. The Dark Ages were the time following the fall of the Roman Empire when any learning, books, etc. were kept going by... wait for it... the Catholic Church! (Monasteries.) Read Stanley Jaki about the history of science. It was promoted by Christian people in Western Europe. There is no dichotomy between faith and science. Catholics believe that the God who made the universe is of course the God who lets it run according to its own inherent laws, which are unsderstandable by human reason. Look at Catholic physicists, astronomers, and biologists. Stop being an intolerant moron. BTW, we Catholics do also say that the universe has moral as well as physical laws, so we oppose gross violations of human rights.

      Are stem cells same as babies? There's no question that stem cells can develop into other types of cells that can collectively form a baby body, but does it automatically mean stem cells are the same as babies? If A can develop into B which then becomes C, can we say A is the same as C?

        OTCnet, i know you're trying to be smart here. but there's a big difference between embryonic stem cell (where it comes from) vs. adult stem cell vs. just pain 'stem cell' - in any argument, you must be specific. stem cells do not become babies, even if it's from an embryo. The embryo collectively becomes a baby, not it's individual cells, but to use the individual cells means the DEATH of the embryo. Get it?

      China is ahead of us when it comes to embryonic stem cell research. Americans are travelling there to get cutting edge treatment. Its just sad. Bible thumping conservatives want us to believe that under their leadership they will take America back to the best in the world, yet all their actions hamper every advance we try to make. You're not going to advance our country by burying your head in the bible.

      The life of every mammal starts at conception; however does that mean that they immediately acquire the right to life?

      Whether you are an atheist or theist the issue boils down to that. I believe a human does not acquire the right to life until the 20th week others disagree. Just the same way I disagree with the government with the fact that an individual acquires the right to drink at 21 when I think it should be 18. The point is that the government already assign rights depending on any human state of development (age), same with the fetus.

      Very recently a man with terminal Cancer of the windpipe was saved & cured when Stem cells were used to create a replacement.Are the bible thumpers thanking GOD for this or cursing the research & treatment that made this possible?The stem cell research also promises kidney & Liver treatments that might not need donor organs& not have any rejection problems.This is WONDERFULL you

      No embryos are being killed. The cells have been stored for years. The judge did exactly what he's supposed to do - dismiss the case. I wish people understood how this research is done, and how it can benefit all of us.

      adult stem cells are in your body they just need to be jump started to work, if your a believer in god then it should be proof positive for you when the bible says you can heal yourself.
