    Judge: No Warrant Needed for GPS Tracking on Vehicles [VIDEO]

    A federal judge in Missouri has ruled that the FBI was in its legal right to use GPS tracking on a man's car without a warrant.

    "The courts that have addressed similar arguments for suppression have held that evidence obtained from GPS surveillance should not be suppressed on First Amendment grounds," Magistrate Judge David Noce wrote. He also ruled that the GPS device did not constitute an illegal search.

      The takeaway message: 'stay off the streets unless you happy with being spied upon'.
      Another federal district court had ruled that, not only was it OK to track people with GPS surreptitiously planted on their cars but that it was also fine for cops to sneak onto private property- your garage or car port, to install said tracking device without a warrant. That should much more have raised an eyebrow than this, but it went nearly unreported.

        Hell why would they need to do that, now that it doesn't violate any Constitutional rights they can just force auto makers or sellers to install GPS on every car sold, and then they can use your registration numbers to track you at anytime for any reason.

      folks that is fine but the law also holds that if something is in your car it is yours. Start selling their devices to anyone who wants them on EBAY and see how fast it stops

        That isn't true, there is an old video of a man that found the tracking device on his car, and the FBI showed up demanding their property back.

        yes and to date he has not given it back and that is what started this whole case he listed it on ebay and if they put something on your car it is yours

      Courts rubber stamp warrant requests so there is no reason why the FBI or similar authority can't take the extra step and get one, and car owners who find such a device attached should keep it as they would any unrequested merchandise delivery. Or they could remove it and attach it to the cat.

      The Supreme Court heard arguements about the same issue in Oct 2011 and has yet to render its ruling. But most of the judges questions inplied they felt a court order was needed to attach a GPS unit on a car, boat, etc. If not, we are just one step closer to Nazi Germany or Commie Russia!

      So can we as citizens put these devices on all cop cars and keep a live data base for everyone to see? Seems fair game to me...

      Also, with GPS tracking on phones, what stops them from using that anytime they want as well?

        And what makes you think they are not using the data from your phone GPS??
        There are several cases pending just on that topic.. Keep in mind an Appeal Court just ruled that the immunity given to the phone carriers for assisting illegal searches was constitutional.

      I definitely do not support using GPS without a warrant. WE already have enough situations where citizens are harassed or briefly detained without probable cause it is. A warrant should be obtained whenever possible.

      Unites States Supreme Court recently heard oral arguments on the issue of warrant-less GPS tracking on vehicles. They will rule that it is an illegal search. This Missouri ruling will be overturned. Wait for the opinion latter this year to see.

      What is the harm in getting the warrant? They followed him around for months, so it's not like he was escaping to Morocco or something.

      Now there will be some companies that make GPS detectors. Then the Feds will be chasing ghosts around the country. I am sure there is also a way to manipulate these GPS trackers and send them on wild goose chases. It is just a matter of time.

      Wonder if Johnny Citizen would get in trouble for placing a tracker on an FBI or police vehicle? That way we could keep tabs on them...

      Excellent. I have the right to remove devices from my property without special dispensation. Self-powered GPS modules are expensive. Now all I need to do is get the kindly police to "legally" install one for me to uninstall.

      Someone should slap a GPS tracker on the judges car and after a month post all the results to the web. As he is paid with taxpayer money it would be informative to find out just how many hours he actually spends at the courthouse.

      I am so happy not to live in the PSA.......the Police State of America....formerly the USA.......my adice is for citizens to get a passport ASAP before the government says you cannot! Hope for the best prepare for the worst !
