    Judge: Sandusky can see grandkids, have local jury

    HARRISBURG, Pa. (AP) — A former Penn State vice president wants a judge to throw out charges he lied to a grand jury investigating former football assistant coach Jerry Sandusky and didn't properly report suspected child abuse.

    Gary Schultz filed the motions Tuesday. In court records first obtained by The Associated Press, he says his statements to a grand jury that the allegations were "not that serious" and that it wasn't clear a crime occurred are opinions that can't be proved false.

    He's joining a motion filed Monday by co-defendant Tim Curley challenging the failure-to-report charge on the grounds the law was different in 2002, when they fielded a report about Sandusky being in the showers with a young boy.

    The attorney general's office says it hasn't received the filings but will review them when it has.

    Sandusky denies molesting boys.

      I'm confused... is an accused child molester allowed to see children? ... Only if you're rich and know the right people you are, because the law does not apply to you. We just have to send them to a "trial" to make it look fair.

        Because the children he requested to see are family, and they did not claim any wrong doing against them by Sandusky. If he (Sandusky) was doing to family what the non-family victims claim he did to them, there is no way family would allow visitation. I don't disagree with your thinking at all, ok? I agree with you, BUT, this is the only way I "guess" this can be explained.

        So if the average Joe down the street ended up being a 'sicko' and molested his neighbor's daughter he was babysitting, then requested to see his nieces and nephews, do you think your local county's laws would allow it?

      Sandusky is so #$%$ arrogant that he still thinks that he did nothing wrong! However, I am sure that he just may be forced to change his mind when he is CONVICTED by a jury of his peers and a jury composed of his own neighborhood residents. But this man is so sick that I am not sure that he will ever understand what he has done.

        I agree. In his own sick little mind, I do believe that Sandusky does not believe that he did anything wrong with those boys and believe that he is the only victim in this whole mess.

        Lisa S - Agreed - He thinks that HE is the only victim. Add to that that his wife thinks that he is also the victim here..both sick. If he were my husband (GOD FORBID) he'd be so long gone in a snap. Also if he wasn't rich, he'd be in a cell right NOW awaiting trial like any of us without money would be!

        What else do you expect from judges and lawyers? What I am angry, shocked, and disgusted with is the fact that the mothers and fathers of these grandchildren would put their children in the position of being in the same room with this pervert! Wonder how many of them he has "showered" with? Shame on the parents!

        I agree completely! If I was the mother of any of those grandchildren, I'd be telling the judge to go pound sand! He wouldn't be miles close to my children! Thank GOD I am not related to that POS. I'd be so ashamed! I TRULY feel for his children. HIs wife - she's as nuts as he is! She proved that trying to run down that reporter woman last week.

      When one of his daughter in laws comes out and says she will not let him see her kids. Well then the guilty meter just went up a few ticks. I know you should be innocent before proven guilty but this guy has done nothing to persuade me in any way. He readily admits taking showers with these boys and "horsing" around naked in the shower with these boys. Does this sound like normal behavior for any grown man?

      Penn State will try and protect him by coming in with a verdict that is as lenient as possible. A little slap on the wrist, so that it appears that they really care about the victims, but they want to make sure that money keeps coming, so they won't do much. Look at the judge already. He can see his grandchildren, he can go out and look at the school kids as they play in the playground, because he hasn't tried to call to them or make any overtures in their direction (yet), that pretty much tells us how things are going to go. And best of all for him, the trial will take place among his people.

        and why? Because Heaven forbid anything happen to the Penn State football program! If that was NOT the reason, the young guy who caught him in the shower with a little boy YEARS ago would have called the police right then instead of telling the coach BUT HE wanted to protect his job - so how many MORE kids were abused? The WHOLE situation is a horror that never should have happened for as long as it did nor should Sandusky be basically free which in this case all this 'house arrest' is. He should be in a cell with a sink and a toilet - period! Money talks.......

      And the judge ruled..
      "assistant coach's jury will be composed of residents of State College and the surrounding area"..
      fascinating...many of the major trials they look for an outside jury because of all the negative publicity..
      But in this case, it seems the negative publicity ..was the fact that these molestations
      were actually exposed....and not what was done to these kids..
      this is like having the rapist judging the act of rape...
      seen that it seems priority #1 has been......Penn State University..
      and the kids...well...how can they compare with the elite of football..?

      It boggles me that ANYONE accused of possibly harming children- should be permitted around any children? until case is over. I thought I read one daughter in law does not want her kids around him?

      WOW, what kind of idiot judge would allow this #$%$ to come in contact with any child, this is a joke, why not allow a person on trial for murder have a gun, and to think these are the people we look up to and hope they give fair justice. Hey judge why dont you allow your grand child to go visit this guy. YOU NEED TO BE REMOVED AS A JUDGE THATS FOR SURE.

      "No evidence was presented that at any time the defendant made any effort to contact any of the children by signaling or calling to them, or that he made any gestures directed toward them, or that he acted in any inappropriate way whatsoever," Cleland wrote. The inappropriateness is that he is allowed the sick pleasure of watching them! If he had an ounce of remorse or was taking the slightest responsibility for his actions (which pedophiles do not do!), he would time his "porch sitting" to correspond with times that children were not present. Seems to me he would want to do anything that might improve his image, even if it is calculated and phoney as hell!
