    Judge upholds firing of Ohio teacher in Bible case

    COLUMBUS, Ohio (AP) — A judge has upheld the firing of a central Ohio public school science teacher who was accused of preaching religious beliefs in class and of keeping a Bible on his desk.

    Knox County Common Pleas Judge Otho Eyster said in his two-page ruling Wednesday that he found clear and convincing evidence that the Mount Vernon school board was right in dismissing John Freshwater early this year.

    A request by the former Mount Vernon Middle School teacher for Eyster to conduct additional hearings "is not well taken," the judge wrote.

    The school board in the community about 40 miles northeast of Columbus first tried to dismiss Freshwater in 2008 after investigators reported that he preached Christian beliefs in class when discussing topics such as evolution and homosexuality, and was insubordinate in failing to remove a Bible from his classroom.

    Freshwater appealed to an outside referee, a state hearing officer, utilizing a right of teachers facing firing in Ohio. The hearing officer recommended in January that Freshwater's contract be terminated, and the school board formally fired him within days.

    Judge Eyster noted in his ruling that he reviewed the 6,344 pages of transcript and approximately 350 exhibits from the referee's hearing.

    Freshwater also was accused of using a science tool to burn students' arms with the image of a cross, but that allegation was resolved and not a factor in his firing.

    Freshwater said Thursday that he's considering his next step.

    "At this time I am reviewing all of my options and speaking with (The) Rutherford Institute and my personal attorneys," he said in an email to The Associated Press.

    The Rutherford Institute is a Charlottesville, Virginia-based civil liberties group which has been involved in the case. Attorney and institute president John Whitehead said Freshwater has 30 days to file an appeal and said his group is ready to move in that direction.

    "The lower courts are very difficult to get by because they do uphold local school boards almost unanimously," Whitehead said. "We'll have a better chance in an appeals court which will have more distance away from the school board and the local community."

    An attorney for the school board said she had no comment.

      When I was a kid. I lived in a place where everybody was very religious. But, I was taught regular things like math, English, geography, history, science and the like in school. Religion was taught in Sunday school.

        Columbus is not southern. I was schooled (public) in the Cincinnati area and none of that religious teaching took place - 50s and 60s. Might get by in the south - less educated population.

      We had a class when I was in school that had 6 teachers, each from a different faith that did not force religion but explained the history of their faith and how it influenced the world around us. I have no issues with history of religion being taught as long as it is done properly. If people could understand their neighbors better then maybe we have more respect for our neighbors.

      I teach in a public university. I teach the constitutional right of freedom of religion. I also point out that it only is with smaller government that freedom of religion is possible. But that is all I say about it. I do not push my own religion. (Instead I just push the value of smaller government. Academic freedom.) A government agency is supposed to be in everyone's best interest. Anything else would be discrimination.

        Smaller government = less tax dollars being spent on people doing things that are unnecessary for the good of the People. This says little about the relatively small cost of Emergency Services.

      I am a Christian. But I ask a simple question: For those who say that the US (& Europe) was great because of Christianity and is now going under because of the lack of it, how come then that the Asians who're coming up are LARGELY Hindi, Buddhist, and communist? And yet Japan, which is largely Buddhist, is also going down - as if to be sure that the Buddhists shouldn't make similar claims. How come Africa, which is increasingly Christian is either stale or receding? I just think, we might be susceptible to simplistic or dogmatic reasoning by offering such quick but unverifiable reasons to explain what made the U,S (or Europe) a great nation (or continent). Honestly, I think there's more to what makes nations great. Otherwise, the "Christian" claim would be verifiable elsewhere.

        Rome also fell after adopting Christianity. Not that Christianity itself cause the fall, but as you suggested of many other historical and current examples, it certainly wasn't helpful enough to stop the fall.

      That sort of teaching is better suited for a private school. School is where kids should learn language, math, history and science - not be indoctrinated into a teacher's religious beliefs. They may be exposed to the teacher's and other students' philosophies and belief systems and thus learn tolerance, but the person who decides whether they pass or fail should NOT have his religious book in plain view on his desk, implying that those who do not follow his faith are somehow lesser in his eyes

      People have to understand that if you allow any teacher in a public school to teach Christianity, then it opens the door for every teacher to teach whatever religion pleases them. So, any public school teacher would be able to teach Islam, Mormonism, Judaism, Jehovah's Witness, Buddhism, including devil worshiping and every other religion under the sun.

      The teacher deserved being fired. Teaching Christianity and being an exhibitionist in his religion is a foul deed inconsistent with the separation of church and state. Good riddance to all teachers like him.

      Reading about teachers like Mr. Freshwater makes me really appreciate my high school biology teacher, Mr. Baker, who announced at the start of the year, "I'm here to teach science, not Sunday School."

      Tom. He would have fired the teacher also. If you want to learn about the Christian religion, there are churches on every corner. Also, if I wanted to learn about Christianity, I would want to learn from someone with an education in Christian theology and not some windbag teacher. Public schools have no place for the teaching of religion. Just which religion would you teach? Catholic, Baptist, Pentacostal, Methodist, Jewish, Islam, Hinduism or Buddhism? Mormon parents certainly would not want their kids being taught Baptist theology. I doubt Pentacostal parents would be happy about Buddhism being taught in the school where their kids go.

      The issue here is that an employee defied his employer. The employer exercised it's right to dismiss a rogue employee, it's really that simple. Employers have a legal right to dismiss employees who do not do as the employer wishes. Case closed.

      Formerly US was a Christian country. But now some states such as Connecticut and some others bacame so-called Israel colonies with jewish national traditions. It seems they are going to occupy Ohio too, hence it following the blame of Christian teacher with Bible
