    Judge won't halt anti-whaling group's activities

SEATTLE (AP) — A federal judge in Seattle declined to immediately restrain the activities of a Washington state-based anti-whaling group Thursday.

Judge Richard Jones said he would issue a written ruling later, but that he's inclined to deny a request for a preliminary injunction made by Japanese whalers against the Sea Shepherd Conservation Society.

The whalers — the Institute for Cetacean Research — said the Sea Shepherd group has attacked and rammed their ships off Antarctica during the whaling season, and asked the judge to order them to stop. Some of the clashes have been shown on the "Whale Wars" reality TV show.

Sea Shepherd activists use stink bombs and other nonlethal means to interfere with the whalers. The group argues that its activities are supported by international law, that the court doesn't have jurisdiction in the Southern Ocean, and that it's the whalers who have rammed its vessels.

"It is a victory for the Sea Shepard, for environmentalists. It's a victory for the whales," said Charles Moure, an attorney with the Seattle firm of Harris & Moure representing the Sea Shepherd.

In a federal lawsuit filed in Seattle on Dec. 8, the institute argued that the whalers are "entitled to be free from attack by what are essentially self-proclaimed pirates with a base in the state of Washington."

Japan's whaling fleet kills up to 1,000 whales a year, an allowed exception under a ruling by the International Whaling Commission. Japan is permitted to hunt the animals as long as they are caught for research and not commercial purposes. Whale meat not used for study is sold as food in Japan, which critics say is the real reason for the hunts.

Activists launched or threw glass bottles containing paint or butyric acid in one attack last year, the captain of a whaling vessel said in an affidavit translated from Japanese.

"A crew member could be blinded in such an attack," said Tomoyuki Ogawa, captain of the Nisshin Maru. "These attacks also cause fear in the crew, thus interfering with the prompt and accurate carrying out of orders."

Sea Shepherd president Paul Watson said in documents that his activists have never injured any whalers. He accused the whalers of attacking activists with concussion grenades, long-range acoustical devices, bamboo spears, heavy nuts and bolts, water cannons and prop foulers.

Each hunting season runs from about December through February. Sea Shepherd has sent boats to the waters off Antarctica for the past several years in an attempt to thwart the hunt. The two sides have occasionally had violent clashes, including a skirmish in which a Sea Shepherd boat was sunk after its bow was sheared off in a collision with a whaling ship.

Moure filed a motion to dismiss the lawsuit, but the judge has not ruled on that request.

Would a federal judge have jurisdiction over international waters?
      • Bob 3 mths ago
It would if it involved a corporation with headquarters within it's jurisdiction.
      • Robert 3 mths ago
he can prevent them from ever leaving a US Port too.
      • Michael 3 mths ago
Maritime law is already on the books and is thousands of years old..... international waters are not lawless

They can harvest it from Paul Watson.

The only thing they're "researching" is new ways to serve up whale meat.
      • Dave 3 mths ago
        It's delicious.

Why would they need 1000 whales for research? Using that for an excuse is deplorable from a civilized nation. Quit killing these sea giants they have a hard enough time existing with all the pollution and garbage in the water.

all 750,000 of them...really hard exisiting as their population swells to unsustainable levels.
    • Pasta Mon  •  3 mths ago
I,000 whales per year, every year, for research? Yeah, right,
    • Michael  •  3 mths ago
So if international waters are lawless (which they are not) then these protesters anr also fair game for the whalers...... sounds like it is "game on" for the the Japanese....

Have they sunk any of your shipps from being rammed NO.So pny up the money for the Ady Gil you cheap #$%$oles.Antartic isnt a country that is in the U.S so they should have say there unless they plan on polinges the waters like they are tring to police the planet. In that event then they should ban the Japanese & everyone else from ALL whaling since they found a loophole to use to feed the pathetic appetite. The sea sheppard needs a bigger vessel to ram #2 and sink it on pride alone.Take on stand on defending their own just like the whales.
      • Just Sayin 3 mths ago
The Ady Gil ran right in front of the Shonan Maru 2 who tried to avoid the collision, and Pete Bethune has been arrested for numerous drug charges in the past. You know he was higher than a kite the time of the accident and you have seen Paul Watson cast him aside like garbage when he no longer was useful in his self proclaimed whale saving crusade. You can clearly see the Maru turning to the left to avoid the Ady Gil coming from the right. I hope Watson get's ate by a whale.

If u read the story above it says, Japan kills up to 1000 whales every year for "Research" and have done this for YEARS...Yet what benefit do we get from this research?? And where is this "Knowledge" that have learned about these whales from this research? This is a Law/Rule that people take full advantage of to make HUGE profits from whale meat., Notice how they said: Whale meat not used for study is sold as food in Japan..Whale meat in Japan is like hamburger meat to Americans..And that is why they hunt these animals..And by 2030 - 2040 the whales population will drop dramatically.. I'm all for the Sea Shepherd Family stopping the Japanese from killing these animals... Go Sea Shepherds .. May God keep you in safe passage.

There are 750,000 Minke whales in the southern ocean. Japan harvests 1000 of them. I would think the ecoterrorist Sea Shepherds would be better off fighting a battle for an endangered species and not one that is currently eating itself out of food due to over population.

I will say it is fun watching the three stooges like antics of these buffons. They are truely clueless.

Paul Watson is an absolute nut. I watched one episode where he faked that he was shot by the Japenese scientests doing the research. After that, I have no respect for this wacko. I hope he gets ate by a whale.

I have watched these guys harass the whalers for years. If I were captain of one of the whaling ships, the US courts would not be involved. I would put the Sea Shepherd ships in the bottom of the ocean.

I hate humans and I love whales. Just sink their death boats.

Time to return to the roots of history - In the days of fighting sail, a Letter of Marque and Reprisal was a government licence authorizing a person (known as a privateer) to attack and capture enemy vessels and bring them before admiralty courts for condemnation and sale.

The Japanese need to send these maritime hippies to Davy Jones' Locker.
    • Susan  •  3 mths ago
I can't imagine anyone calling Capt. Watson and their crew pirates. I totally believe what they are doing. Hope they can save the whales before they are hunted to extinction. that really sucks the things that are being said about them. I watch Whale Wars and wish they could do more. they have several ships and hopefully they an do some good.
    • A Yahoo! User  •  3 mths ago
Good! Too bad they don't sink the idiots.
    • Pauline  •  St Paul, Minnesota  •  3 mths ago
Sounds like the Japanese will be forced to sink and harm some Americans. And it will end up being on the Judges shoulder.

Bet Vagas already has odds for it.
