Jury to begin considering fate of Jackson doctor

LOS ANGELES (AP) — After six weeks of listening, jurors in the involuntary manslaughter case of Michael Jackson's doctor will get their first chance to talk about the case Friday.

Their discussions behind closed doors in a downtown Los Angeles courthouse could lead to the conviction or acquittal of Dr. Conrad Murray, whom the panel has heard described alternately as an inept and opportunistic physician or a naïve outsider granted access into Jackson's inner realm.

The seven-man, five-woman panel listened intently Thursday as prosecutors and defense attorneys argued over whether Murray should be convicted of involuntary manslaughter for Jackson's death in June 2009. The physician's attorneys attacked prosecutors and their witnesses, saying they had over time developed stories and theories that placed the blame for Jackson's death squarely on Murray.

Jackson died from a fatal dose of the anesthetic propofol. Murray has acknowledged giving Jackson propofol to help him sleep.

The real reason Jackson died, defense attorney Ed Chernoff argued, was because he craved the powerful anesthetic so much that he gave himself a fatal injection when Murray left his bedside.

"They want you to convict Dr. Murray for the actions of Michael Jackson," Chernoff said.

"Poor Conrad Murray," prosecutor David Walgren replied in his final speech to jurors. "Michael Jackson is dead. And we have to hear about poor Conrad Murray and no doctor knows what it's like to be in his shoes."

Walgren noted that several doctors who testified — including two who were called by Murray's attorneys — said they would have never given the singer anesthesia in his bedroom.

Murray is solely to blame for Jackson's death, Walgren argued, saying Murray had purchased more than four gallons of propofol to administer to Jackson and had been giving him nightly doses to help him sleep.

Walgren repeatedly described Murray's treatments on Jackson as unusual and called his actions on the day of the singer's death — including not calling 911 and not mentioning his propofol doses to paramedics or other doctors — "bizarre."

Murray was essentially experimenting on Jackson, Walgren said. Murray should have known Jackson might die from the treatments, yet he lacked the proper life-saving and monitoring equipment.

"What is unusual and unpredictable is that Michael Jackson lived as long as he did under the care of Conrad Murray in this situation," Walgren said.

The prosecutor repeatedly invoked the singer's children, Prince, Paris and Blanket, and said Murray's actions left them without a father. The children, who range in ages from 9 to 14, were not present, but Jackson's parents and several of his siblings attended closing arguments.

The Houston-based cardiologist's culpability will be decided by jurors, who heard from 49 witnesses and have more than 300 pieces of evidence to consider. They were given lengthy instructions about how to deliberate and interpret the case.

If Murray is convicted, he faces a sentence that ranges from probation to four years behind bars, and he would lose his medical license. The sentence will be decided by Superior Court Judge Michael Pastor and not the jury; the judge will receive input from attorneys for both sides and probation officials if necessary. A recent change in California law means that Murray, 58, might serve any incarceration in a county jail rather than a state prison.

If acquitted, Murray would be free from criminal prosecution, but will likely be pursued by medical licensing authorities in the states of California, Nevada and Texas.

In order to convict Murray, jurors will have to determine the cardiologist was substantially responsible for Jackson's death.

Despite days of scientific testimony about what likely happened in Jackson's bedroom from experts for Murray and the prosecution, Walgren acknowledged that some things about the events in the King of Pop's bedroom that led to his death will never be known.

"The people won't prove exactly what happened behind those closed doors," he said. "Michael Jackson could give answers, but he is dead."

If you're going to wait 20 minutes to call 911, you'd might as well just call the morgue.

MJ was an addict and his doctor was a drugsdealer. The worst combination one can imagine. They are equally guilty. But it never should have ended this way.

Lets not forger to add child molester to that list.

@Christopher and Robert- Jackson was not a child molester. If he were then there would have been many, many accusers coming forward. Think about it. Pedophiles don't molest one child, they have a string of molestations and Jackson had access to thousands of children. He had thousands of kids visiting his ranch so where are all the accusers?

The one kid that his insurance company paid described his genitalia as circumcised (He was not circumcised) and he refused to testify in the Arvizo trial against Jackson. Jackson was a victim of extortion, pure and simple. Open your minds to that fact.

If he had been guilty he would have been convicted because the prosecutor in the Arvizo case threw everything at him possible and had an open coffer of tax dollars to fund his crusade against Jackson and still he FAILED to get him convicted. His house was gone over with a fine tooth comb, his computers confiscated (No kiddie porn on any of them) and the FBI kept a file on him that stretched back for years and they had nothing of him either.

So consider the possibility of his innocence before you condemn this man. If someone accused either of you of molestation and your careers were compromised and your freedom put on the line how would you feel if your integrity was questioned? It could happen to you too and you would want people to give you the benefit of the doubt and not condemn you on hearsay, lies and innuendo. And yet, there would still be people out there just like you insisting you are guilty just because you were accused.

Probation to 4 years...for a life. Humph. What if it were Murrays son, or wife? Would he consider that enough for the actions of a "doctor"? The treatmjents should have never been in that setting and the Propofol should have never been in the possession of the patient. Here is a doctor who flirted with someones life for money. He ought to be hung.

There is nothing in Dr Murray's prior-to-being-employed -by -Michael-Jackson history that supports your POV: in fact just the opposite is true

How true. It's amazing how often people are willing to decide the fate of a defendent based on the bits and pieces they get from the sensationalist media. It's the jury that is there to hear all the evidence and their judgement shouldn't be second guessed by people who have only a smattering.

ANY medical professional who gives a very strong anesthesia drug to someone then leaves the room for a long period of time IS GUILTY of at least medical malpractice, and if the patient dies, guilty of a crime.

If you unintentionally kill someone from your recklessness then it IS manslaughter and a crime. This doctor (and I use the term loosely) left his patient after being given a very strong anesthetic. Even if MJ gave himself another dose, the doctor should HAVE NEVER LEFT HIM ALONE!

There was NO LIFESAVING EQUIPMENT IN THE HOUSE. Even the Pulse-ox did NOT HAVE AN AUDIBLE ALARM! As a retired paramedic this is greatly disturbing to me. I would go to PRISON or a long time if I so neglected a patient.

This doctor didn't even know how to do CPR (and they aren't taught in med school) and yet he gave a drug with a very tiny window of putting you to sleep or putting you into cardiac arrest.

I don't have to wait for a jury to tell me this man is guilty. By his actions he is guilty. The jury may find him "not guilty" by the legal definition, but that DOES NOT MAKE HIM INNOCENT by any means.

listen, jackson was a drug addict for twenty years. we are all born with knowing what is right and wrong. here is what i think, jackson was wrong for buying doctors off and taking drugs,in saying that, the doctor was wrong in doing what he did also. jackson payed for his wrong doing with his life, the doctor needs to pay a price also. HE IS GUILTY!!!!!! AND RECKLESS. never let this man treat another person for the rest of his life! That is what i think.

When someone is paid $150,000 a MONTH to look after someone, and that someone wants to go sleep, most any concoction is likely to be administered. The doc should NEVER be allowed to doctor anywhere, He most likely didn't intend for harm to occur, but negligent homicide is in order here, just like speeding to cause a wreck that kills someone. No intent, but death occurs.

"The physician's attorneys attacked prosecutors and their witnesses, saying they had over time developed stories and theories that placed the blame for Jackson's death squarely on Murray."

Basically accusing them of doing their JOB! It is the prosecutors JOB to accuse, and to make a story outlining the alleged crime and time table and opportunity for it to take place as well as background leading up to it. How would THESE lawyers present a case against some one? THE EXACT SAME WAY! HYPOCRITES. TYPICAL "LAWYERS"!

LEGAL drugs kill more people last year than auto accidents (39,000 in 2009 and counting). And people are afraid to legalize marijuana, LOL. Guess how many people marijuana killed in 2009? ZERO. How about tobacco? Alchohol? OMG the hypocrisy.

Seems to me that just a few years back, the world wanted MJ dead for being a #$%$ pedofile - what is this about? He had the money to get little boys in his bed and the money to get drugs from an MD.
    • B  •  6 mths ago
I've often wondered why MJ had to drug himself so extensively just to be able to sleep. I've heard that people with a guilty conscience often times can't sleep because their demons keep them awake. If anyone had demons, it was MJ.

B may just be on to something. Listen, if the Dr. hadn't give MJ the drugs he would have gotten them somewhere else, that what he did. And yes, his family is just as guilty as this Dr.
    • Rhonda  •  6 mths ago
It's all about medical ethics. He should, really, be made an example of. How much money does it take to buy your ethics? What he did was criminal. He was well aware of what he was doing and he got caught.

Dr Murray was being paid $150,000 a month to TAKE CARE of MJ...not leave drugs all over the bedroom so MJ could OD. Down with Dr Murray. It doesn't matter if MJ was a pedophile (found not guilty), a rock star or Joe from across the street. Drugs should be locked up...period.

The Jackson family knew Michael had a problem and they are guilty for not getting him help. They should be asked the why they didn't do something. Michael may have had taken something Dr. Murray didn't know. Drug addict do this. Dr. Murray may be guilty of greed but he did not have full controll of the situation either. Michael did what he wanted and that was keep himself in Netherland and not face reality.

Hope the jury gives more consideration to the fate of Dr. Murray, than Dr. Murray gave to the fate of Mr. Jackson.

I've seen horrible side effects from Diprivan (propofol) in a controlled environment. Can't even imagine using it in the home setting. With consistent doses, it was only a matter of time before he had a stroke or an hypoxic event. Sorry, but the raw truth is, he was a drug addict in his last days. He was probably hooked receiving Diprivan during all of the surgeries. Probably why his mind was operating at an 8-10 year old level in his last years, brain injury.
    • Aldoro  •  6 mths ago
many of the last few years MJ was obviously using and drugged out. No one can stop a druggie that doesnt want to stop. IF anyone tried they would be kicked out of the inner circle or freezed out. If this doctor didnt perform, he would be fired and replaced. Drug addicts get sober or they end up in the pinebox, psych institute or penitentiary. Now MJ clan wants to get this law suit in their favor so they can win big bucks and collect on medical malpractice or against the taxpayer for a licenced MD. Either way we the people pay pay pay in higher doctor bills, tax write off sby the insurance company who paid up.
