    Jury: Deputy not liable in Md. stun-gun death case

    BALTIMORE (AP) — A former sheriff's deputy is not liable for the death of a man he shocked with a stun gun as the 20-year-old lay face-down and possibly unconscious, according to a federal jury's ruling Wednesday that said the officer used only enough force to protect himself.

    Retired Frederick County Cpl. Rudy Torres, a 13-year veteran of the force, sighed in relief after the jury forewoman read the verdict at the end of a five-day trial. Outside the courthouse in Baltimore, Torres said Jarrel Gray's death was tragic but that justice had been done.

    "Tasers are a useful tool. They've saved many more lives than they've taken, if they've taken any at all," he said.

    Gray's mother Tanya Thomas, who filed the wrongful death claim along with Gray's father, was unforgiving.

    "I have to go to my son's burial plot to visit him, and I want to know how he sleeps with that," she said.

    Torres encountered Gray and two other men early on the morning of Nov. 18, 2007, after responding alone to a reported outdoor fight in a neighborhood about 45 miles west of Baltimore. He testified that he shocked Gray once after the man ignored his commands to get down and show his hands. He shocked him again, less than 30 seconds later, after Gray fell face-first and still didn't respond to commands to show his hands.

    A medical examiner listed the cause of death as undetermined, associated with restraint and alcohol intoxication. The stun gun was the only means of restraint mentioned in the report.

    Defense attorney Daniel Karp suggested during the trial that Gray succumbed to an irregular heartbeat caused by unaccustomed binge drinking, a condition called "holiday heart."

    Plaintiffs' attorney Gregory Lattimer called the verdict "heartbreaking." His co-counsel Ted Williams said he was troubled by the finding and raised the possibility of an appeal.

    Gray's father Jeffrey Gray declined to comment after the verdict. He and Thomas were seeking $145 million for an alleged excessive use of force.

    Police policy experts who testified at the trial disagreed about whether it was reasonable to believe Gray still posed a threat after the first shock.

    A Frederick County grand jury ruled in 2008 that Torres' actions were justified and that he followed police protocol.

    The 10 federal jurors rejected the excessive force argument. They found that Torres assaulted Gray but decided the deputy was shielded from liability because his actions were in defense of himself or others, and that he only used enough force to protect himself.

    Jury forewoman Monica Oguinn told reporters that the assault finding simply reflected the definition jurors were given by the judge.

    "It was not an intentional act and it was not a wrongful act by the officer to do what he did," she said.

    She said everything unfolded so quickly that Torres had to make split-second decisions for which he couldn't be faulted.

    Last year, the U.S. Justice Department advised police officers to avoid shocking suspects multiple times or for prolonged periods to reduce the risk of potential injury or death.

    The report came after a study of nearly 300 cases in which people died from 1999 to 2005 when police shot them with stun guns. It found that most of the deaths were caused by underlying health problems and other issues. Of those cases, the experts examined 22 in which the use of stun guns was listed as an official cause of death.

    Torres retired from the sheriff's office and now works as a Fairfax County, Va., dispatcher.

    Gray's parents also sued the sheriff's office and the Frederick County Commissioners, but the cases against them were postponed pending the outcome of Torres' trial.

        How about the second shock while the man was face down? Guess that was insurance against him jumping up and drop kicking the deputy right. Like I said before, allow someone to tase you and see if you can respond to a verbal command immediately after. Put up or shut up

      I see nothing wrong with this verdict. The officer showed up at the scene alone, and there were more then 2 people there, he used his stun gun instead of his service revolver, I see nothing wrong with any of the steps this officer took. I am sorry for the families loss, but the officer was just doing his job to breakup an already hostile situation.

        Bull Hockey, you sound like an S O B who in a fight would knock a person out then pick up a brick and bash their head in and cause it justified or knock a one legged guy down the break his good leg and both arms because you didn't feel safe! The only people that get away with excuses like this guy did are cops. If a doctor, bus driver, plumber or baker used an excuse like that they would convict then hang him! Cops like 007 have a license to kill anyone at will for any reason and it's time they were stopped!!

      To all you wonderful citizens that swear up and down that the police are always right and justified in everything that they do, follow this closely. How do you justify stunning a person that had fallen face down on the ground a second time because he didn't follow your commands? Didn't they say the same thing about Rodney King? That he contributed to his beating because he couldn't hold still while 4 or 5 grown men were beating him senseless with night sticks? Interesting decision, similar to the King verdict. Here we are in the 21st century and cops can still kill a black man without consequence. How scary is that? By the way, as I said before, have someone tase you and then ask you to show you hands,,,,good luck,

        Wolfman is right. I don't care if you're a law abiding person and trying to surrender to the police or not. If there are 4 or 5 cops beating you with night sticks you will not be able to just lie there. We had a case here in Oregon not long ago that a black man was walking backwards toward the police with his hands behind his head as he was told to do. For whatever reason one cop shot him in the lower back with a beanbag round. Once he was hit his hand naturally moved toward where he had just been hit and another cop shot him with a rifle. The shooter cop claims it looked like he was going for a gun and was trying to run away. No one was charged with his murder. And it was murder.

      White officers should know, blacks are above the law and are not subject to the same laws as white people. They live in a different culture of values and behaviors, therefore are free to roam at will like wild animals taking whatever they see or want. They are not subject to the same consequencies of guilt and shame as whites, they really don't have a conscience and are not embarrassed by the same types of circumstances, so they should be left alone to do what they want, they are like children and have a less developed level of maturity. Just look at Pres. Obama.

      Welcome to the POLICE STATE of Maryland, where the Police can kill or maim you at their discretion with no recourse. These LOWER THAN #$%$ people called Police officers and Commissioners take it upon themselves to decide who they will assault in the name of Police Duty. The jury in this case seem to believe that if you are unconscious, you can respond to a command. The jury members are as much at fault for allowing this ego-maniac to go free, as he is in MURDERING this person. Police brutality is a major problem now, and with juries like this it will only get worse. The Officer was guilty of assault resulting in death by his own admission. There is NO JUSTICE in this case. The judge and jury were derelict in their duty. This officer should have been charged with MURDER. Tazers and Stun Guns are NOT TOYS, as most Police seem to think.

      If I read the first paragraph correctly, this is a case of murder by police.

      The part about "...the 20-year-old lay face-down and possibly unconscious..." would have convicted the cop in any other state!

      I knew I would find in the article that the officer followed proper procedures/protocols. its what they always say when their jobs are on the line. the guy was drunk, not a criminal, its called wait for back up if you feel threatened. They guy was face down on the ground. how was he still a threat? So if the officer shot him with a bullet, and he was face down, and still doesn't comply with the officers verbal commands, its then protocol to put another bullet in him? come on! These kind of trigger happy officers are all over the country, so people watch what you do!
