Labor board drops high-profile Boeing complaint

WASHINGTON (AP) — The National Labor Relations Board dropped its high-profile lawsuit against Boeing on Friday, but the political fallout continued as Republicans said the case was a mistake to begin with and a top agency official defended his conduct.

The board moved to end the case after the Machinists union approved a four-year contract extension with Boeing this week. Under the deal, the union agreed to withdraw allegations that the company built a nonunion plant in South Carolina to retaliate against past union strikes in Washington state. In return, Boeing promised to build the new version of its 737 airplane in Washington state.

"We've treated this case just like every case that comes to us, and it's ended the way most of our cases have ended," Lafe Solomon, the board's acting general counsel, told reporters in a conference call.

Solomon said he had always preferred a settlement and called the outcome typical at an agency that sees 90 percent of its cases settle.

Sen. Lindsey Graham, R-S.C., said it was hard for him to celebrate the dismissal of a case "which never should have happened." He called on Congress to investigate whether the union and the board collaborated against Boeing.

Solomon had come under intense criticism from Republican lawmakers, South Carolina officials and GOP presidential candidates for bringing the case. Republicans and business groups claimed the board was setting a dangerous precedent by interfering with legitimate business decisions about where to locate workers.

Solomon said Friday that he was simply following the law and might do it again if faced with similar facts.

"This case was never about the union or the NLRB telling Boeing where it could put its plants," Solomon said. "This was a question for us of retaliation, and that remains the law. If we were ever faced with a similar pattern, we might well issue a complaint."

President Barack Obama, in response to a question from a reporter about the case, said simply: "I'm glad people are going to be working."

Obama had declined to take sides in the dispute because the labor board is an independent agency. In comments this year, the president said companies need to have the freedom to relocate, though they must follow the law when doing so. Obama had urged Boeing and the union to work out their differences.

But the president and the board had come under withering attack from GOP White House hopefuls running in South Carolina, an important early primary state, who pointed out the agency was run by Obama's Democratic appointees. Those attacks continued Friday, with former Massachusetts Gov. Mitt Romney taking the administration to task.

"Thanks to President Obama's appointees, the NLRB has become a rogue agency that tramples on the rights of American workers and businesses, injecting job-killing uncertainty into the economic climate," Romney said in a statement.

GOP presidential hopeful Newt Gingrich called the outcome a victory for right-to-work states. He condemned the lawsuit as "a politically motivated assault on the rule of law by President Obama and his big labor allies."

Solomon said the Boeing complaint was always about the loss of future jobs in the Seattle area. The new deal between Boeing and the union resolves that issue, because there is now job security in Seattle and job security at the North Charleston, S.C., plant, he said. Both sides say the agreement ushers in a new era of labor peace after years of acrimony.

Boeing spokesman Tim Neale said the company continues to believe the complaint was without merit and should have been dropped.

"Boeing is grateful for the overwhelming support we received from across the country to vigorously contest this complaint and support the legitimate rights of businesses to make business decisions," Neale said.

Graham said he would continue to place an indefinite Senate hold on nominations to the labor board as a way to keep it from making any more key decisions. Starting next year, the NLRB will have just two members instead of the usual five after a Democratic appointee's term expires. The board needs at least three members to rule on cases.

This is the reason why corporations outsource jobs.I'd rather build my factories in China and India then build them here and deal with Unions and Government regulations.

The problem you have is both India and China have unions, ie. there have been many strikes at the car plants in India and Chinese unions brought several parts manufaturers to a stop with labor disputes. Maybe you can go back to slavery to feed your greed.

They out source jobs to make more profit so they can pay less taxes.

As long as you do exactly what the unions want, corporations will be allowed to remain in business. Obama will see to that.

Blackmail plain and simple...unions are destroying the competitiveness of this country and are succeeding. No wonder companies don't want to invest in the US.

Extortion as a viable contract negotiation tool? On a government level?
Ya just gotta love these people.

More good American jobs lost to ignorant third-world serfs willing to work for less.

What kind of Drugs do you take ?? SC is in the USA ... You and Obama need to go to Rehab together !!

SC was the first state to secede from the Union. They were kept in the Union by force, and that was a mistake made by a Republican President. They were and are still traitors and supporters of slavery. The wealthy powers that be keep the ignorant white trash from standing up for themselves like free men by stoking their racism. That is why they are still ignorant third world serfs, begging for the Right To Work For Less..

Just like with the morning after pill decision this administration will back off of the radical agenda to get reelected. It is too late; they have already shown everyone who they really are, and only a fool would trust them.
      • Rational Monkey 5 mths ago
The radical agenda of following and enforcing the law.

The union and the NLRB are just doing their part to help the re-election campaign, with the public outcry they knew it was a losing proposition anyway.

It's an election year. Obama can't have his union thugs causing anymore flare-ups.
Especially when his poll numbers are worse than any President in history at this point
      in their Presidency.

More jobs headed overseas, and fewer jobs here. Will the last union member turn out the lights please.

This reminds me of the old initials USSR. Remember the U was for Union. Socialism is taking over this country, and this is just more proof. First the unions destroy domestic auto manufacturing and now they are after the aviation industry. After they bankrupt all of the major companies in this country, who do they think will pay them. O, that's right the liberals have convinced them that the government is there for them.
    • Russell  •  Atlanta, United States  •  5 mths ago
This has nothing to do with anything other than buying off the Unions. Pay them. They don't care about health, working conditions, nothing other than the dollar. High and mighty piss ants.

Bunch of idiot responses here and from Lindsey Graham. Boeing broke a long standing labor law, and the Repubs were trying to bully the NLRB into letting Boeing get away scott free with their crime. Businesses like Boeing who take billions of taxpayer dollars, without paying any taxes themselves, should not be allowed to break the law. More proof that the GOP doesn't care about working Americans, they only care about corrupt corporations.

Just another example of our pos president paying off the unions for election money, and moving his socialist agenda further down the road...This country is closer to another revolution than anyone thinks. Now congress is passing a law that lets the military shoot American citizens. Putin will be running for president in 2016.

Unions - the bane of American progress
    • Yrag  •  5 mths ago
The unions gave Obama permssion to drop the war on Boeing after Boeing had no choice but to pay the Obama-sponsored shake-down. The unions own Obama--plain and simple and the sad part about it is that he knows it and allows it.
    • Donna F  •  Dallas, United States  •  5 mths ago
Pretty idiotic to say that Boeing doesn't pay taxes when GE and Jeffrey Imelt make a habit of ignoring tax laws and neglecting to pay taxes even when they take in billions a year. But Obama's pals aren't expected to pay taxes or obey laws...

Not politically motivated? Sure, sure and neither is Obama's delaying his decision on the Keystone Pipeline Project. Sheeeeks. Sarcasm intended.
