    The Law Firm of Pond Lehocky Stern Giordano Settles $3 Million Dollar Workers' Compensation Case

    Pond Lehocky Stern Giordano Managing Partner, Sam Pond, recently obtained a $3 million settlement for a union construction worker, who was catastrophically injured at the age of 31 while working as a construction flagman directing traffic on the highway. The work injury caused him to become a C4 quadriplegic. The victim was married with a 6-month-old child at the time of his injury.

    The settlement occurred in the case of Tuski vs. Liberty Construction, which was heard in the Workers Compensation Office of Adjudication (Bureau Claim Number: 2251404) after years of negotiations. The insurance company initially offered less than one million dollars. Attorney Pond says, "The complexities of the case, including the funding of a Medicare fund, the Social Security offset, the reduced benefits as a result of the third-party lien, the client's future lifetime medical needs, and the possibility of an attack by the insurance company on the claimant's medical treatment, all had to be weighed and factored into getting value for my client."

    According to the claim heard in the Workers Compensation Office of Adjudication, the claimant had stopped several cars the day he was injured. The driver of the last car in line ignored the order to stop. He sped around a line of vehicles and struck the claimant, who witnesses say was thrown 15 feet into the air and about 60 feet from the point of impact.
