A lawyer with Weitz & Luxenberg’s defective medical devices litigation group, Samberg was appointed this week to the Plaintiff’s Steering Committee of a lawsuit against DePuy Orthopaedics, Inc. The appointment adds another litigator to the list of Weitz & Luxenberg attorneys selected for leadership positions in major lawsuits involving metal-on-metal joint replacements.

Samberg was appointed last week to the committee along with lawyers from 16 other firms by Hon. Ed Kinkeade of the Dallas division of the United States District Court, the firm said.
The complaint, which sets forth the grounds for the multidistrict litigation, alleges that thousands of patients across the country who received DePuy’s Pinnacle hip implants experienced problems attributable to the devices malfunctioning years before they should have.
According to the complaint, the implants in question contain a metal-on-metal ball and socket component that fails prematurely, causing a variety of complications and often requiring revision surgery.
“This case is significant because of the number of people affected and the severity of the mechanical failure involved,” said Samberg. “The Pinnacle hip system has some models with metal surfaces that, due to poor design, can create some very serious risks for our clients. The metal can corrode, for instance, releasing cobalt and chromium into the body.
“The Plaintiff’s Steering Committee’s job is to generate trial strategies and generally act on behalf of all the clients in the suit. There is a lot of medical data about these hips failing, and molding it into a manageable form will be a big part of the task.”
Samberg is a seasoned associate in Weitz & Luxenberg’s defective devices practice, representing patients and consumers injured by defective drugs, medical devices, and other products. He was also appointed to the Science Committee of the DePuy Pinnacle lawsuit.
In being appointed to the steering committee, Samberg joins two other Weitz & Luxenberg lawyers recently selected to lend their leadership to large-scale lawsuits involving metal-on-metal joint replacements.
Rob Gordon, a senior attorney and member of the firm, was appointed in October 2011 to the Plaintiff’s Steering Committee of a lawsuit involving a knee implant manufactured by Zimmer Holdings, Inc. (Zimmer NexGen Knee Implant Products Liability Litigation, MDL 2272, filed in the United States District Court for the Northern District of Illinois, Chicago).
Ellen Relkin, a lead litigator with Weitz & Luxenberg’s defective devices practice, was appointed in January 2011 as co-lead counsel of the multidistrict lawsuit against DePuy involving their ASR hip implant, which was recalled by the Federal Drug Administration in August 2010 (DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation, MDL 2197, filed in the United States District Court for the Northern District of Ohio, Toledo).
