    Charges Dropped Against Alleged Lindsay Lohan NYC Hotel Room Assailant (Updated)

    UPDATE : A WNBC news producer has reported that Christian LaBella has been released by police after assault charges against him were dropped. A harassment report was filed against him, and LaBella also filed a harassment report against Lohan, according to the producer.

    Regarding the report of assault charges against LaBella being dropped and the filing of a harassment report against Lohan, the actress' rep told Access on Sunday afternoon, "It is both distressing and outrageous."

    It looks like more trouble for Lindsay Lohan.

    The actress was allegedly assaulted in her hotel room at the W in Manhattan early Sunday morning by a 25-year-old man she met at 1 Oak nightclub, law enforcement sources told NBC.

    Lohan stated she got into an argument with the man -- identified by authorities as Los Angeles resident Christian LaBella -- (after she brought him and her friend, Claus Hjelmbak, back to her room) over pictures LaBella allegedly took of the actress with his cell phone.

    Lohan attempted to take the phone from LaBella, and told police he then threw her on the bed, scratching her hands.

    The actress said she then ran from the room and down hotel stairs, but eventually returned. LaBella allegedly saw her, gave chase, choked her from behind and threw her to the ground.

    Lohan's friend pulled LaBella off of the actress, and the actress pulled hotel's fire alarm to bring help.

    LaBella was apprehended by police at the hotel and is awaiting charges at the 13th precinct.

    The actress' rep told Access Hollywood Lohan is safe after the alleged assault and did not require hospitalization.

    "Lindsay was assaulted early this morning in a New York hotel," Lohan's rep, Steve Honig, told Access in a statement on Sunday. "While she did sustain some injuries, she was not hospitalized. The assailant was arrested and is currently in police custody. Lindsay has spoken with police and is fully cooperating with the investigation."

    It's the second incident involving police for Lohan in New York City this month.

    Earlier this month, she was accused of hitting a pedestrian as she was behind the wheel of a Porsche. Lohan was arrested and issued a desk appearance ticket after allegedly leaving the scene of the incident.

    Following the incident, Lohan's rep told Access that he believed the claim was "much ado about nothing" and he expected the claims made against the actress to be "proven untrue."
