    Man sentenced for killing wife; she strangled son

    BRENTWOOD, N.H. (AP) — A New Hampshire man was sentenced to 15 to 30 years in prison Friday for beating his wife to death with a flashlight after he came home to find she had strangled their 4-year-old son with a ribbon and tried to kill their 7-year-old daughter.

    Christopher Smeltzer, 39, pleaded guilty to killing Mara Pappalardo, who was hospitalized several times for mental illness. Prosecutors say she was paranoid, obsessed with death and convinced her husband and mother-in-law were plotting to take her children away.

    "When I walked into the room, as soon as I saw my son, I knew something was very wrong," Smeltzer told the court before he was sentenced, his voice breaking at times. "I knew he was dead. And I lost all control. Enraged, I struck my wife. I did something that was not going to bring my son back."

    Smeltzer was charged with second-degree murder in the November 2010 killing at their Auburn home. Prosecutors later downgraded that to manslaughter, saying he was provoked by the sight of the still bodies of their son, Mason, and daughter, Mercey.

    He arrived home Nov. 7 to find Mason with a ribbon around his neck and Mercey with a scarf around hers. He thought both were dead. Pappalardo tied a blue rope around her own neck in an attempt to kill herself, although prosecutors said she died from both strangulation and Smeltzer hitting her in the head with the flashlight.

    Smeltzer did not call 911. Instead, he snipped the ribbon off Mason's neck and removed the scarf from Mercey's. Then he took all the pills he could find — painkillers, sleeping aids and methadone — and lay down on the couch to die.

    He was awakened the next morning by Mercey, who asked if her mother and brother were breathing and requested a cup of tea. He made her one, then called his father and 911.

    Smeltzer, who was wearing handcuffs Friday, wept while talking about how much he misses his son. "I miss my wife as well," he said. "I miss Mara's smile and heart and the way she played with our children."

    He apologized to her family. "I brought more pain and sorrow," he said, adding he wishes every day he had a rewind button.

    Judge Tina Nadeau said if Smeltzer earns a college degree and completes anger management behind bars, his minimum sentence would be reduced to 10 years.

    Before Smeltzer spoke, a court-appointed guardian representing Mercey played a recording of the child reading a letter to the judge in which she said her father killed her mother and Mason. "If he loves me, why would he try to kill me?" she said. "If my daddy gets out, how will I keep safe? Please keep him in jail for the rest of his life."

    After that, prosecutor Jane Young got up and said the recording is contrary to statements Mercey has made in the past, in counseling and interviews. She repeatedly had said her father had taken the scarf off of her neck. She has said she remembers her mother carrying her into the bedroom, but doesn't remember what happened next, Young said.

    Prosecutors said there is no evidence that Smeltzer killed Mason.

        I agreed with that right up to the point where I saw the word "Methadone." Someone (or both?) was using heroin in that home and the children should've been removed long before this happened.

        I do not think that there is such a thing in the U.S. as the temporary insanity defense / plea. I believe it is considered a mitigating factor, and in this case it was rightfully taken into consideration resulting in the reduction of the charge from murder 2 to voluntary manslaughter. I still think that 15 to 30 is a lot considering that he thought that she killed both of his children.

        Methadone is also used to treat chronic pain ... but the mother's mental health history should also have triggered a much earlier intervention.

      Who is this court-appointed guardian for Mercey?? Sounds like they are messing up this poor child's head. All she has left is her father and now they are making her believe that he tried to kill the whole family. Weird!

      the so-called "guardian" for the little girl needs to be IMMEDIATELY incarcerated for child abuse! ... the bast--- has mentally assaulted the child, filling her head with lies for no purpose other than to assist the prosecution! ... it's hard to imagine something more evil!

        If you can believe it, I'm in the middle of something much more evil with my now ex-wife. I do not see any resolution to my problem via the Courts, either. I would gladly share details with you if you are interested.

      Who among us can say they would not have acted the same way. It's a tragidy all the way around. I'm not sure what purpose 15 to 30 years in prison is going to serve. The kid will change her mind when she gets older.

        You don't kill people outside of a war or combat. No sense in killing a wife or a child. Most of you people have not seen combat or death. All this woulda,coulda,shoulda is just garbage talk. Most of you could not handle months in prison. It's no joke, you can die there. It's best to follow the laws. And in this case, dude could have killed both people.

      Wouldn't surprise me if the court appointed guardian for the daughter are the wife's relatives. That would explain why the daughter is changing her story and wants her father locked up. They are polluting her mind with lies because their son-in-law killed their daughter.

      If it is true that this guy walked into the scene as described, it is reasonable to believe that he "snapped" mentally and, of course, was justified to attack his wife who committed this horrible crime against their children. This guy does not deserve the harsh sentence he received.
      Also, the fact that the daughter woke up the father the next day shows she is not afraid of him. If she was, she would have run out of the house then. Now, it is a tragedy that someone coerced her into making such a sad recording to the judge.

      What a tragedy. I would think that most people might react in the same way. This is more a crime of Passion. Temporary Insanity. It is a shame that the dead wifes family is trying to use this little girl as a pawn in their vendetta.

      Hopefully on appeal, his sentence will be reduced so that he will be able to reconnect with his daughter. Shame on the court-appointed guardian for twisting the little girl's words.

      WHAT KIND OF FRUCKING IDIOT COURT would put this man in prison for so much as a week for having THAT kind of response !!?? Every good adult on the planet would do much the same! I hope God whips everyone of those prosecutors and jury members who wrongfully attacked this man and threw him in prison.

      I think this is a good case deserving an appeal....with a BETTER lawyer!

      Living with a crazy spouse is a "mission impossible"...add children and all you do is extend the risk from just the crazy spouse to the children as well (obviously).

      This guy should get "time served" on appeal...and regain custody of his daughter, so they can try to get on with life (without fear).
