    Manila to China on spats: We'll go to UN tribunal

    MANILA, Philippines (AP) — The Philippines told China it plans to take their Spratly Islands dispute to a U.N. tribunal in trying to resolve their conflicting claims peacefully, the Philippine foreign secretary said Monday.

    At their meeting in Beijing last week, Chinese Foreign Minister Yang Jiechi did not respond on China's thoughts about the Philippine plan, Foreign Secretary Albert del Rosario said.

    "The Chinese position has not changed," del Rosario told a news conference. "Our position also has not changed. Our claims are based on international law."

    Both sides did agree the disputes should not damage overall relations, del Rosario said.

    President Benigno Aquino III plans to visit China in late August or early September. The nations are trying to cool tensions after the Philippines alleged Chinese forces repeatedly intruded into Manila-claimed Spratly areas since February.

    The chain of barren, largely uninhabited islands, reefs and banks in the South China Sea are claimed entirety or partly by China, Taiwan, Malaysia, the Philippines, Vietnam and Brunei. They are believed to be rich in oil and natural gas and straddle a busy international sea lane.

    The Spratlys are regarded as a potential flashpoint for armed conflict.

    In one of the most serious incidents, Philippine officials said a Chinese naval vessel allegedly fired to scare away Filipino fishermen from Jackson Atoll, near the Spratlys.

    In March, Chinese patrol boats threatened a Filipino oil exploration ship into leaving the Reed Bank, which the Philippine government has said is within its regular territorial waters and not part of the Spratlys.

    Yang said there were no intrusions because those waters belonged to China, del Rosario said. "Of course, we disputed their position," he said.

    Del Rosario did not elaborate on what the Philippines intends to raise before the International Tribunal on the Law of the Sea, which decides cases stemming from the 1982 U.N. convention ratified by both countries.

    Two Filipino diplomats said the Philippines intends to ask the U.N. tribunal if China's claim to the entire South China Sea conforms to the U.N. convention. That claim, which surfaced in 2009 as a map China submitted to the U.N., is rejected by the Philippines and other claimantsm.

    The Spratlys has a history of deadly territorial clashes. In the worst fighting, Chinese and Vietnamese navies fought at Johnson Reef in the Spratlys in 1988 in a fierce battle that sank several Vietnamese boats and killed more than 70 Vietnamese sailors.

      the philippines should stop talking to china regarding the disputes on spratly islands. the philippine government is just wasting time negotiating with china who don't want to listen to them. china believes that they could easily invade those disputed islands with their military power. china is just making fool of the philippines, vietnam, japan, and even the united states. china is the greatest liar in the world. asean countries should increase their military preparedness because war could break out anytime due to china's aggressive behavior and military posturing.

      Philippines practiced gunboat diplomacy with other smaller nations like Taiwan, accusing innocent fisherman of intruding into its territory when they are still in international waters and holding them for randsom. They did this for years and when they get a taste of their own medicine, they are crying about it? What comes around goes around.

      At this point, it is pointless that Pnoy visit to China should be thought of. Visits to other countries by our presidents could mean economic package and peace initiatives, but then with China, it's worthless; we will end up always on the losing end and corruption index will just go up some more.
      Pnoy could visit Japan, South Korea, Vietnam, Thailand, Indonesia, Brunei, New Zealand and Australia in exchange for the China Visit. The cummulative effect will be much greater as far as economy growth and corruption index being lowered are concerned.

      Sorry about my negative thoughts on Del Rosario et al's recent visit to China; re: the Spratlys.

      At a time when China complies with international laws which they became a part of by signing those laws, only then should a Philippine president think of visiting China. China thinks on it's own, they bully their ownselves and proves to the world how stupid they are. Imagine a co-signatory to UNCLOS and pretend not to know what you have signed and still insist on their own claim.....what a shame. IS THAT NOT BULLYING YOUR OWNSELF... pretending not to know or ARE THEY JUST STUPID!!!!!!
      One time I read that a Beijing University ranks in the top 5 in Asia in English learning and UP and Ateneo were ranked very much lower. So what happened with their representatives to the UN, they should still be tops and not embarrash their country as to the interpretations of the LAW OF THE SEAS. Even if we rank lower, we are still tops in our own rights, grassroots prevalent english medium of instructions in most of our schools proves we are more edu..than any of our neighboring Asians as far as I am concerned.

      Bring the informal settlers to the Spratlys ! Let them populate & occupy the area & that way we are solving 2 issues. We will help decongest Metro Manila of squatters & the occupation of the islands is a deterrent to foreign intruders. At least there's lots of seafoods there to eat & they will not go hungry.
      The gov't. then should create incentives to those who will live there to attract settlers to the Spratlys.

      Asking the UN for help is a waste of time. It takes them years to make a simple decision and when they do, they cannot back it up. Stand up to China and get some ships out to those islands. Yes, China may fire at them, but if you are not willing to take the risk you don't deserve the Islands. The rest of the world is clueless about what is going on with the Spartly's right now. Unfortunately it takes gunfire to wake up the world, no one is interested in diplomatic speeches. Did anyone hear the people of Eygpt, Syria, Libya, Tunsia, etc when they just 'talked' about freedom.

      Yan ang Pinakamagandang move na ginawa ninyo. Dalin natin ang Usapin sa U.N Tribunal, kc kung magmamatigas padin ang China sa BALUKTOT NILANG KATWIRAN hindi nalang Pilipinas ang makakalaban nila. I'm sure magkakaisa naman ang iba pang mga bansa na nakapalibot sa South China Sea. Ang Pilipinas ay hindi sakim na bansa, gusto lamang nito na maangkin kung ano ang talagang nasasakupan nito. Pero dapat nating isipin na hindi bibitawan ng China ang Claim nila sa spratlys ng ganoon na lang. Makakakuha naman tayo ng simpatiya sa iba pang mga bansa dahil tama lang naman ang pinaglalaban nating karapatan.

      Sa mga nagra-rally kontra VFA, sa mga kontra Joint Forces nasaan ba kayo? doon kayo mag-rally sa spratlys, kung ayaw nyo ng tulong ng ibang bansa KAYO ANG MAGTANGGOL SA SARILI NATING BANSA! puro kayo welga!

      Maintain lang natin ang good relationship natin sa China pero panindigan natin ang karapatan natin sa Spartlys.

      China really shows that they lack knowledge and logic, they really need to learn more and think more like responsible people do. They pretend to know more kahit nagmu-mukhang ignorant ang mga taong ito. Their contention that the Spratlys are theirs because it is in South China Sea, even if it is beyond the 200 nautical miles from their territorial baseline as allowed in the UN Convention on the Law of the Sea, is pure ignorance. Indian Ocean is a huge ocean named after the country India but it doesn't mean India owns it (Chinese people should learn about this). Likewise, South China sea is not owned by China, it is only named after their country. Ownership of the Spratlys is governed by the UN Convention on the Law of the Sea (UNCLOS). Maybe China doesn't understand the provision of this law (UNCLOS) or they just pretend to be ignorant or simply ignorant.
