    Marine gets jail time, reduced rank in hazing case

    KANEOHE BAY, Hawaii (AP) — A Hawaii-based Marine lance corporal will spend 30 days in jail and have his rank reduced to private first class for punching and kicking a fellow Marine who killed himself shortly afterward, a judge ruled late Monday, saying she found no evidence the abuse led to the suicide.

    Lance Cpl. Jacob Jacoby, 21, who pleaded guilty to assault, acknowledged he punched and kicked Lance Cpl. Harry Lew, of Santa Clara, Calif., out of anger and frustration that the fellow Marine repeatedly fell asleep while on watch for Taliban fighters.

    The case involves the actions of Marines at an isolated patrol base the U.S. was establishing to disrupt Taliban drug and weapons trafficking in Helmand province.

    Jacoby, one of three Marines accused of hazing, told a judge he wanted to talk to Lew to find out why he kept falling asleep and to help him stay awake. But Jacoby said he got angry when Lew spoke to him in a disrespectful manner, even though Lew was putting the lives of the Marines at their patrol base in danger by dozing off.

    Squad members and officers had tried different methods to get Lew to stay awake, including referring him up the chain of command for discipline and taking him off patrols so he could get more rest.

    But on Lew's last night, when he fell asleep again, those efforts escalated into alleged acts of violence and humiliation, according to the charges. The Marines were accused of punching and kicking him, making him do pushups and pouring sand in his face.

    A central issue in the case has been whether the Marines intended to humiliate and harm Lew or discipline him so he would stop falling asleep while on watch duty.

    Before Lew put the muzzle of his machine gun in his mouth and pulled the trigger, he scrawled a note on his arm: "May hate me now, but in the long run this was the right choice I'm sorry my mom deserves the truth."

    Navy Capt. Carrie Stephens, the judge in Jacoby's special court-martial on Monday, said she found no evidence that Jacoby's abuse of Lew caused Lew to kill himself. She said she didn't take the suicide into account when determining the sentence.

    As part of the plea deal, prosecutors withdrew charges that Jacoby humiliated and threatened Lew.

    Before sentencing, Jacoby said he was sorry and that he wanted to take responsibility for his actions.

    "I allowed my emotions and frustrations to get the best of me, and acted out against a fellow Marine," Jacoby said.

    He said he will never forget the pain and humiliation of being court-martialed and believes he can use his experience to help other Marines.

    Marine Capt. Jesse Schweig said the government was confident Jacoby is capable of rehabilitating himself.

    But the prosecutor asked the judge to sentence Jacoby with an eye on deterring similar behavior. Jacoby should be given a bad conduct discharge, he said.

    "If this is how you're going to approach and motivate your peers, then you do not need to be a part of the service," Schweig said in closing remarks at the sentencing hearing.

    Navy Lt. John Battisi, Jacoby's attorney, said Jacoby lost his temper and struck Lew. But Battisi argued Jacoby made sure to hit Lew on his body armor where he was best protected.

    Battisi also asked the judge to keep in mind the circumstances the Marines were in, and that the chain of command hadn't addressed Lew's sleeping problem and instead had left the issue in Jacoby's hands that night.

    "We're asking him to control his emotions and gain emotional maturity in the heat of battle," Battisi said in his closing remarks.

    Lew committed suicide April 3 at a patrol base in Helmand province, shortly after the abuse. The 21-year-old was a nephew of U.S. Rep. Judy Chu.

    Two other Marines also are accused of hazing Lew before he shot himself with his machine gun in his foxhole. Sgt. Benjamin Johns, the leader of the squad the Marines belonged to, and Lance Cpl. Carlos Orozco III will have their own separate courts-martial later.

    Both Marines watched the court proceedings Monday.

    Lew's father, Allen Lew, testified during the sentencing hearing that his son wanted to join the Marines because he felt it was "the best."

    He said was shocked to hear about his son's death, and his legs buckled when Marines came to his house at 7:30 a.m. with the news in April.

    "My son died — I have only one son," Lew said. He said he doesn't understand how Marines could do the things they did to their own.

    Chu, D-Calif., attended the hearing. "I want to make sure that there is justice for Harry. And I want to support these brave persons, his parents," she told reporters beforehand.

    The attorney representing Johns said he was concerned the presence of a politician will taint the process and interfere with justice.

    "How do I get a fair jury? What implicit message is she trying to send to those panel members?" said Tim Bilecki, a defense attorney who specializes in military clients.

    Chu said that wouldn't be the case. "I'm not going to be saying anything in the trial. All I'm doing is being here. I'm here for the family to support them," she said.

    In September, Chu testified about Lew's death at a House Armed Services hearing on the status of suicide prevention programs in the military. Leaders from the Navy, Army, Air Force and Marine Corps answered lawmakers' questions about identifying service members at risk and other steps they are taking to stop suicides.

    The military witnesses spelled out several steps — from sharing information with Veterans Affairs and working with the National Institutes of Health to focusing on peer-to-peer mentoring.

      Where was the NCO in Charge? He/She should have known that there was a Marine who was marginal at standing their post and made the proper correction. The Marine who screwed with him was out of line. They should have gone to the NCOIC first. When I went on watch, I was stoked on rotten Army coffee and had a hit of No Doz stashed somewhere in case it got THAT bad....

      The fault lies with the senior officers who did not take action against this Marine for sleeping on guard duty. I am "assuming" it was because of his political connections (believe me they all knew who he was), so he was left at his duty station. He should have been brought up on charges, and court-martialed. Sleeping on guard duty is a violation of the Uniform Code of Military Justice.

      This was not a hazing incident. It was a fear driven incident. These Marines, all of them, knew their lives were dependent on this individual. A slacker who should have been tried and dishonorably discharged.

      Unless you have served as a Marine in a war zone you can not understand. Your squad comes first and in a war zone you depend on each other. The story states that other squad members and officers tried to correct the problem. When this failed he could have been sent for a medical exam. Unless he had a medical problem, charges should have been brought against L/Cpl Lew and discharged. He was putting the lives of other members of his squad in danger. I have to question his mental status, I'll bet he had other problems. It is sad he took that way out but it does happen. I wonder if his mother had not been a Rep. would the concerns and news media be there. USMC ...Nam...68-69

        SOme people naturally have sleep disorders, your right, I know a Iron worker who was falling asleep on beam on highrises in Chicago in the days when there was no fall protection. The man is a friend of mine his disorder is so bad he sits in a meeting and bang out like a light. Yes and no if it had been anyone else noone would even know about this. Regardless the whole combat episode or situation has bigger implications.

      This is truly sad and I feel badly for the family of this young man but with all respect to them I need to say that this young man by his actions could have caused the death and or injury of his fellow marines just as easily . When sleeping becomes more important than the lives of your comrades and it happens again and again it becomes obvious this person simply does not have what it takes to be in that situation . Lance Cpl. Jacoby should be found guilty of nothing, Lance Cpl. Lew was in fact guilty of several things, all of them serious .

      Hazing? This is a perfect example of why the media needs to keep its #$%$ out of combat areas. The Marine kept falling asleep on watch duty, endangering the lives of his fellow Marines? In other places and times, he'd have been glad to get just kicked and slapped. That's life in a combat zone. And it's too bad the Marine hiearchy reacts like that to the media. Great support for their combat Marines, eh?

      I once found a Marine asleep on outpost watch in southeast asia.

      I came up behind him, covered his eyes, placed the blunt edge of my Kabar against his throat and pressed hard not saying one word.

      That was the last time this Marine ever fell asleep while 'on watch' while under my command again.

      If they had notified senior officers of Lew's continued failure to fulfill his duties and the senior officers failed to act. Then I hold the senior officers as responsible for the actions of their subordinates.

      How did he ever make it out of boot camp? When I went in to the Marines,75 trainees started the training cycle but only 32 of the original 75 finished it. I really don't understand how a turd like that can get trough. He earned the boot. They did not give it to him.

      as a vet, I have no problems with what the team did to this man; but his command should have sent him to the states for a medical condition review or to see if he was just plain lazy. Follow lifes are in danger here, you either cut it or not ... should have been shipped out of the corp. from the get go. Sorry for the family's lose, but in combat there are no excuses.

      It would have been a different story if that marine who fell asleep on guard would have gotten his post overrun by taliban and there were other casualties......getting punched and kicked is the least he should have gotten.....he has the responsibility of guarding everyone in his unit while they rest to fight another day and he failed in that which could could have cost alot of lives. He commited suicide because someone punched him and kicked him? doubtful, most likely was coming either way.

      Falling asleep on guard duty is one of the worst things a Marine can do. Better to just be a jerk or sloppy but falling asleep never on guard duty.
      He should have been removed form the squad and replaced with a real Marine, and then court martialed! This was NOT hazing, this was trying to get a point across to a Marine that did not get the gentle approaches to help him including reducing his duties so he could get more sleep OFF duty! No charges should have been brought against the Marines that tried to teach him personal responsibility!
      I have 3 boys that are active duty Marines and would not want Lew anywhere near them in combat or anywhere else.

      His falling asleep at odd time sound like Narcolepsy (sp?). When you fall asleep on watch you put every life on you base in danger. "I will quit my post only when properly relieved" is one of the rules they drill into you during boot camp.

      While this extreme is unusual, put yourself in the others' place. I have been there as a former Marine and I can tell you that a surprise attack without warning can kill your whole squad. Thirteen letters sent to survivors' is a poor substitute for a kick in the butt of the sleeping sentry.

      The UCMJ is pretty clear: “Any sentinel or look-out who is found drunk or sleeping upon his post, or leaves it before he is regularly relieved, shall be punished, if the offense is committed IN TIME OF WAR, VBY DEATH or such other punishment as a court-martial may direct…"

      in 68, August, Nam, one of fellow grunts fell asleep on watch, when we woke up, we talked to him that we are all trying to get back home, and many of the men did not want to talk to him, but I did, I told him that everyone at one time or another, has fallen asleep, but that the danger of continuing is as great as the night before............and no.........we all did not come home.

      You who criticize and chide have no clue. The young 20 something Lance Corporal, whom we thrust into Afghanistan, was doing his job, protecting the rest of his Marines from a weak link with no discipline and no heart. The Marine who killed himself, simply, was weak. We should not have to lower standards to accomodate him. I guarantee you our enemies do not lower their standards.
