    Marine sergeant accused of hazing goes to trial

    HONOLULU (AP) — A second Marine is going to trial for allegedly hazing a fellow Marine who later fatally shot himself in Afghanistan.

    Sgt. Benjamin Johns has been charged with a wrongfully humiliating and demeaning Lance Cpl. Harry Lew, who killed himself on April 3.

    Johns, a squad leader, also has been charged with dereliction for failing to supervise and ensure the welfare of Marines under his care.

    The general court-martial is set for Monday at a Marine base in Kaneohe Bay, the home of the 2nd Battalion, 3rd Marine Division, which the accused are assigned to. Proceedings will start with the selection of a jury.

    Johns' attorney said his client was only trying to save the lives of his squad as he tried to get Lew — who had repeatedly fallen asleep on watch and patrol — to stop dozing off. The base had been fired on before, and Johns was concerned Lew wouldn't spot Taliban fighters trying to attack their outpost again, Tim Bilecki said.

    "These aren't acts of hazing. They're simply not," Bilecki said. "These are actions of a Marine trying to take care of his other Marines."

    Another Marine in the squad, Lance Cpl. Jacob Jacoby, last week pleaded guilty to assault. He was sentenced to 30 days in jail and demoted to private first class. A third Marine will go to trial later.

    Lew, of Santa Clara, Calif., was a nephew of U.S. Rep. Judy Chu, D-Calif., who has called for congressional hearings on the military's efforts to prevent hazing.

    "This is a call for justice," Chu said at a press conference in Washington on Thursday. "Too many patriotic young people, who only want to serve our country, are being harmed."

    She also condemned Jacoby's sentence as "a slap in the face," noting he'll continue to serve in the Marine Corps because he wasn't discharged.

    In April, the squad was assigned to a small patrol base in a remote part of Helmand province where the U.S. trying to disrupt Taliban drug and weapons trafficking.

    By April 2, Lew had fallen asleep four times while either on patrol or watch duty in his 10 days at the base.

    His leaders referred him up the chain of command for punishment and took him off patrols so he could get more rest so he wouldn't fall asleep.

    A command investigation report on the incident said Johns, after discovering that Lew had dozed again, told other fellow lance corporals that "peers should correct peers."

    At about 11 p.m., he woke up another Marine who was due to relieve Lew two hours later and had him take over the job early. Johns also ordered Lew to dig a foxhole deep enough for him to stand in, so he would stay awake while on watch.

    The violence escalated after Johns went to sleep.

    Jacoby admitted in his court martial that he punched and kicked Lew, saying he was frustrated that the fellow Marine repeatedly fell asleep while on watch. He was also upset that Lew spoke to him disrespectfully.

    The third Marine, Lance Cpl. Carlos Orozco III allegedly put his foot on Lew's back, ordered Lew to do push-ups, side planks and poured sand into Lew's face. Orozco has been charged with assault, humiliating Lew, and cruelty and maltreatment. His court martial is pending.

      as a vietnam veteran--i understand completly the importance of keeping awake on watch--but what i cant understand-if this marine kept falling asleep--why did they keep putting him on watch----

        Good point he should have been given a general discharge long before it got to this. But once in the field someone else would have to stand his watch. I doubt he would have fared any better in that case. The officers should have been on top of this from the get go instead of worrying about kissing the CO's arse!

      This is another case where a politican releative has the power to cause harm to other (IE sleeping on guard duty in a combat zone) which can AND HAS caused injury or death to other. And if you do something about it as in the cases of these Marine. The Marine are punished. and when possible the relative of the politican would be rewarded or his misdeed would be hidden if not forgiven; or even given a promotion and moved to a more prestigous, less harmfull job/area

        In the military there is no please! you either do or punished so long as it is a lawfull command. The marine was risking the whole unit if not the entire USA. I think the sergent was in order.Politicians should not be allowed to interfier with military issues.

      It wasn't hazing, it was training. You don't fall asleep on watch in a warzone and not expect retribution from those whose lives you directly endangered.

      Lew was weak and got what he deserved. I'm sorry he's dead but his actions jepordized the safety of the entire unit.

      Lew put lives at risk. Falling asleep at work in combat is Not the same as falling asleep at a normal job. If that guy wanted a job where that would be ok, the military was an idiotic choice. If nothing would have been done about his constant sleeping on duty and Marines died as a result of an attack, that sergeant would be getting prosecuted for not doing enough...plus he would have to live with not doing enough. It is sad that the kid killed himself, but not prosecutable.

      There are people in this world that are afraid of their own shadow; and there are people that aren’t afraid of anybodies shadow. When the crap hit’s the fan the scared people have no problem hiding behind the warriors of the world. No one is asking them to volunteer or even to defend themselves. So why do they always persist in trying to dictate terms to the warriors. Those that go through life afraid and insecure should be grateful to the warriors and when they inadvertently stumble into the world of those that protect them; they should have the grace to back away and not persist in trying to be something they are not. Everyone can’t have a uniform or a medal it just doesn’t work like that!

      This is what the military has unfortunately come to, run by a bunch of man hating lesbians, male high brass who are sheep to the political rabble. I served in the Marine Corps in the 60's and was physically abused many many times and accepted it since it instilled discipline which a combat infantryman needs. The Sgt should be promoted to Staff Sergeant. A squad leader must be able to depend on his men under extremely uncomfortable conditions. Whats a little hazing compared to war. To hell with the female authoritarians and sheeplike male brass, the are destroying the integrity of our services.

      11 years in the USN in the 70s and 80s. 2 DDs, a CG and a CV. Hazing was what it was - and had limits. I earned my Crow (E6) and my Bluenose. I even earned my NJP. I had Chiefs who counseled me in leadership and chewed my butt if I gave less than 100%.First offense: I would dump 5 gallons of water on the offender I caught sleeping on watch. Then check his medical record and counsel the 'problem child'. It would get my point across and keep his record clean. Second offense was EMI and extra watchstanding - that started the paper trail. Third offense was NJP - more paperwork for all of the command. I never saw a fourth offense. In all that time I had one misfit who attempted suicide - that was a weak little kid who had walked off his watch station and fallen asleep in the head. When he was found UA from his watchstation we went to man-overboard looking for him and turned around an aircraft carrier during flight ops to search for him. The Capt gave him a BCD and chewed my butt (and the Master Chief's butt) for not 'getting his attention'.I have since encountered former shipmates who claim I was a royal %#% but fair. A couple even completed carreers that I 'helped along'. i wasn't there to make friends but I did. Gunny Ermy was my hero. Chew #$%$ and take care of your people. Solve problems at the lowest level and set the example.

      this guy lew should not have joined the military... I think if he chose different career instead, he would be still alive and being able to have peaceful sleep... believe me, I was in US military... it's no joke. The psychological bearings and effects are far greater than the physical and if you go to US military, BE PREPARED FOR ALL types of hazing, racial remarks, bullying... sadly that's how the US military is... they are training for you to KILL...

      How did this Marine made it out of "boot camp"? I wouldn't dare "sleeping on watch", it's in violation of U.C.M.J. Article 92. The Sgt. is merely trying to "remind this LCpl. of his duties and responsibilities". What's happening with our military system now???

        your right it would be a violation of Art 92 and also Art. 113 which during war time can be punishable by death. But since you like to use the UCMJ for your examples, the Sgt can also be punished by Art 92 for his actions failure to obey MCO 1700.28 Hazing), also Art 90, failure to obey a Superior officer, Art 93, Cruelty and maltreatment and those are just a few off the top of my head. Im sure he made some type of statement and more then likely lied to cover his #$%$ so that could be another charge. what happening to our military system now is there getting rid of the #$%$ who like to abuse there power. I spent 30 years in the Marine Corps and yes there was hazing when I was in. But nothing like the #$%$ they are doing now a days. That's why the MCO came out about hazing cause dumb #$%$ were taking it way to far and hurting people. If your a leader and you have to put your hands on someone to get them to do something, then your no leader at all. Your just someone who slipped through the cracks and got promoted and eventually like ever #$%$ out there you will eventually get caught doing something stupid and either get busted down or kicked out.

        He made it out of boot camp because his auntie is a congresswoman, and he was treated differently than any other Marine recruit. My Marines have a pretty good winnowing process, that gets rid of anyone who will not make a good Marine very early in boot camp. Unless, of course, that person is 'special' and needs to be kept in because some general does not want to have to explain to a congresswomen why her little nephew was kicked out of boot camp. Who knows, perhaps it was auntie's influence that marked this young Marine as 'different', lead to his isolation from his peers, and caused his eventual suicide. She really seems to be protesting a bit too much. All I know is, if every Marine who was hazed, harrassed, or otherwise mistreated went off and committed suicide, we would not have much of a Marine Corps left.

      These Marines shouldn't have even been charged. It's a shame that Lew killed himself, but its a bigger shame that he wasn't given some kind of treatment, obviouslly he was having issues. If I were in their platoon I would have had a big problem with him sleeping while the enemy schemed on us. This country has gone soft, worse things have happened in war that never saw a trial.

      My greatuncles who were Marines during WW2 told me that they both had sargents who were China Marines. These sargents carried a riding crop made of leather with a 50.cal. casing encased inside the riding crop. They told me you had better pray you never were a sleep on duty, had let down your guard, smoking on guard duty, not paying attention to your surroundings, etc. Hazing! Really!
