    Miss. high court takes ex-gov pardons case

    JACKSON, Miss. (AP) — The Mississippi Supreme Court said Wednesday it will take up the legal challenge to the pardons ex-Gov. Haley Barbour gave out in his last days in office.

    State Attorney General Jim Hood, a Democrat, wants to invalidate dozens of the 198 pardons that Barbour, a Republican, handed out before his second four-year term ended Jan. 10. Ten of the people were still incarcerated when they received reprieves.

    Only about two dozen of the people pardoned followed the Mississippi Constitution's requirement to publish a notice about their reprieves in their local newspapers for 30 days, said Hood, who wants the others invalidated. Barbour has said the pardons are valid and that he gave them because he's a Christian and believes in second chances.

    Most of the people who could lose their pardons already served their sentences and have been out of prison for years. Some of them were convicted of comparatively minor crimes as far back as the 1960s and 1970s and have never been in trouble again.

    Five of the pardoned are being held on a temporary restraining order issued by Hinds County Circuit Judge Tomie Green. The Supreme Court extended that order until it can rule on the matter. It set a hearing for Feb. 9 and said it would try to rule quickly.

    Barbour had no comment on the case. Hood was pleased with the court's decision.

    "This is a good development that the Supreme Court will decide the seminal issue in this case regarding the 30-day publication," Hood said in a statement Wednesday evening.

    Hood said he will present the high court a brief on Tuesday showing that "numerous other courts have ruled consistent with our interpretation."

    Five men who worked as Governor's Mansion trusties, four convicted killers and man serving life for robbery, already were released by the time Hood sought the injunction. The judge told the trusties to contact corrections officials every 24 hours, but one of them missed a court hearing before he was served with a summons this week in Laramie, Wyo.

    Matt Steffey, a constitutional law professor at Mississippi College, said the high court's decision is not a surprise because it ultimately would be up to the justices to decide the constitutional issue.

    "This is a positive development. Fundamentally these are legal arguments, not factual arguments, so there's no reason the Supreme Court should not speak to it," Steffey said. "It has created so much turmoil and attention, so to have a final resolution sooner than later would be welcome by everyone involved, I would think."

    The case is unprecedented, Steffey said. It's a civil lawsuit, but five people have been ordered to remain in prison while others have been required to call corrections officials every day. Hood even sent his investigators all the way to Wyoming to serve a summons to convicted murderer Joseph Ozment, one of the former Governor's Mansion trusties.

    "It's a core question of separation of powers between the branches of government. It's an important question that the Supreme Court has to answer," Steffey said.

    Barbour granted some sort of reprieve to 26 inmates who were in custody — 10 full pardons; 13 medical releases; one suspension of sentence; one conditional, indefinite suspension of sentence; and one conditional clemency. Those being released for medical reasons or who received suspended sentences or conditional clemency did not need to publish notices in newspapers.

    The Supreme Court's ruling means a lower court hearing on the matter won't happen Friday. An attorney for some of the people who received pardons requested the Supreme Court to take the case.

      The notice requirement is not a technicality -- it's there to inform the public ahead of time, so there is a chance to react. In this case, it would have involved informing the family members of the murderer's victims of the impending pardon. Is it possible, maybe likely, that this would have set off a major controversy BEFORE the pardon and forced Barbour to reconsider.

        The law is there likely for the benefit of the public. A released prisoner has two choices, follow the law or challenge it in court. We can only consider ignoring the law in one manner, another violation of the law.

      Take Haley's #$%$ and shove him into the state penn. Make him Bubba's sweetheart then interview him about what a great thing he did to pardon all the murderers, rapists, and pedophiles.

        I think many of these pardons were politically foolish and some may prove unsafe for the public. Haley Barbour did not violate criminal laws in issuing these pardons so it would be inappropriate to send him to jail. These pardons could ruin his political career.

      This is a power that is being abused and should not be left to one person. These ex-governors do this and run. Look at what ryan from illinois did, then he went to prison. A criminal helping other criminals. These people were found guilty for thier crimes. What about the victims?

        Your point? You may want to Google the list of offenders Clinton pardoned hours before he left office. Oh wait, wasn't one Marc Rich, fugitive for tax evasion whose wife donated millions to Clinton's library & Hillary's campaign? Susan McDougal who was convicted of covering up Clinton's involvement in Whitewater? His brother Roger Clinton, for drug convictions? Dan Rostenkowski, the Democratic from Chicago who was convicted in the Congressional Post Office scandal?

        You are sort of making my point. Haley Barbour, as I recall, was very outspoken about the Clinton pardons. But I must point out you have a fact two slightly inaccurate.

        Marc Rich received a pardon for an offense related to the case against him, but not for the tax evasion charge. If he returns to America he will still have to face the central charge against him of tax evasion. It may sound like a small detail to you, but the donation to the Clinton library was made by his estranged wife. Rich lives in Europe and she lives in America.

        Susan McDougal was convicted of contempt of court for refusing to testify, not for covering up for any Whitewater offenses. Most of the testimony points to her husband as the guilty party. Her husband, by the way, was the only person who implicated Clinton and none of his implications were substaniated.

        But this is not the point. Barbour can easily be called a hypocrite and his hiding behind the notion his actions were the Christian thing to do only serves to heighten his hypocracy. I was, however, more interested in the idea Barbour might have sought nomination for the presidency from a party that typically does not believe in many pardons and here he gave out a slew of them.

      Some pardons may have been justified, but 4 were convicted murderers. For releasing them, Barbour should be arrested for recklessly endangering the citizens he's supposed to serve.

      The Governor has the legal right to pardon anyone. The main reason that this happens as they are leaving office is because of questions that could be raised and could hurt a re-election. The DA is fighting against a law. This should not stop the pardoned inmates from release. Why? Because if they choose which laws to obey and which laws to disobey, the are breaking the law, which is why the inmates are in there.
