    Mistrial declared in CA gay student killing trial

    LOS ANGELES (AP) — At the outset, prosecutors presented it as a slam-dunk case of murder: Brandon McInerney, driven by homophobic rage, shot a gay classmate in the back of the head during a school class.

    But ultimately, after an eight-week trial and six days of deliberations, jurors could not decide if the slaying was murder or manslaughter.

    A judge declared a mistrial Thursday after jurors failed to reach a unanimous decision on the degree of Brandon McInerney's guilt for killing 15-year-old Larry King.

    The nine-woman, three-man panel said they took a series of votes — the last one with seven in favor of voluntary manslaughter and five jurors supporting either first-degree or second-degree murder.

    Prosecutors must now decide whether to re-file murder and hate crime charges against McInerney, now 17 but 14 at the time of the killing, who was tried as an adult. They had offered a deal of 25 years to life if he pleaded guilty, but his lawyers passed. A first-degree murder conviction carried a maximum sentenced of more than 50 years in prison.

    King's family rushed out of the courtroom after the judge declared a mistrial. They looked horrified and confused and declined comment as sheriff's deputies escorted them to an elevator.

    Outside court, McInerney's friends said prosecutors tried to sensationalize the case by calling it a hate crime by a budding white supremacist.

    "This should have never gone to trial," family friend Craig Adams said. "The fact they pushed him to try him as an adult was the real crime."

    One juror, who identified himself only as juror no. 10, told The Associated Press that several members of the panel thought McInerney should never have been tried as an adult.

    "I don't think so," the juror said, when asked if the district attorney should have pursued an adult prosecution. "He was 14. Just trying to get in the head of a 14 year old (is hard.)"

    Ventura County prosecutor Maeve Fox did not comment after the trial. She contended McInerney embraced a white supremacist philosophy that sees homosexuality as an abomination. Police found Nazi-inspired drawings and artifacts at his house, and a white supremacist expert testified the hate-filled ideology was the reason for the killing.

    Fox also argued the attack was premeditated, noting at least six people heard McInerney make threats against King in the days leading to the shooting.

    She said McInerney told a psychologist hired by defense lawyers that he wanted to kill King after he passed McInerney in a school hallway and said, "What's up, baby?"

    "He's basically confessed to first-degree murder in this case," Fox said during her closing argument.

    Defense attorneys acknowledged McInerney was the shooter but explained that he had reached an emotional breaking point after King made repeated, unwanted sexual advances. McInerney snapped when he heard moments before the shooting that King wanted to change his name to Latisha, the lawyers said.

    The defense psychologist said he was in a dissociative state — acting without thinking — when he pulled the trigger at E.O. Green Junior High School in Oxnard, a city about 60 miles northwest of Los Angeles.

    McInerney's lawyers also said he suffered physical abuse at home from his father, who has since died, and didn't receive the proper supervision that would have kept him out of trouble. They said the Nazi imagery was part of a school project on tolerance.

    "He is guilty and he should be held responsible, but he is not a murderer. He is not a white supremacist," defense attorney Scott Wippert said during his closing argument. "He is a 14-year-old child who didn't know what to do and had no one to guide him."

    Outside court, Wippert said jurors had told him they weren't convinced by prosecutors' assertions the killing was a hate crime.

    "We are quite confident that none of the jurors believed this was a hate crime," he said. "This was a difficult decision for all of them."

    McInerney did not take the stand during the nine-week trial. To find McInerney guilty of voluntary manslaughter, jurors had to find him not guilty of first- and second-degree murder. They began deliberating last Friday.

    Some students' parents criticized the school for not doing enough to protect King, while others have said administrators failed to address how his behavior and dress — high heels, makeup and feminine clothing — affected other students.

    Wippert also said during his closing argument that school administrators should have intervened.

    The shooting roiled gay-rights advocates and parents in Oxnard. They wondered why school officials hadn't done more to stop the harassment against King by students, including McInerney.

    The case labored in the court system for more than three years as McInerney's lawyers sought numerous delays. Judge Charles Campbell was eventually persuaded to move the trial from Ventura County to neighboring Los Angeles County because of extensive news coverage that threatened to bias jurors.

    King's family sued the school district for failing to protect their son. The lawsuit is pending.

Hey CA let an illegal-child abusing-perjurying woman get a passport and citizenship while having arrest warrant from INS, and forced husband to pay HER 150 grand, while she abused him! What are these smoking? Or is it the sun hitting them in the head too hard? I hope the weather and other disasters -or somebody or something- get rid of these states!

        Texas would have let the killer go and dragged the corpse of the gay victim and put him on trial and then re-sentenced his juvenile, gay, latin self to death again.

        The shooter pointed a gun at the back of the guy's head and pulled the trigger WHILE IN SCHOOL. It was obviously planned carefully; otherwise the kid wouldn't have had a gun in school to shoot someone with. I don't understand how anyone could say that it wasn't murder.

      The young boy committed murder and a punishment must be deliberated or peer groups will see a consent by the law to forego self justification to singling out people for execution base solely upon their likes and dislikes! The jury had an obligation to render a verdict without regards to age, race, religion, or nationality. The jurisprudence and community has been served a blow of no accountability in this case.

      I firmly place the failure upon the Prosecution and Defense Attorneys. Both legal teams should have the community and law in mind when dealing with such explosive cases. A Defense Attorney should "never" go beyond his clients admission of guilt to build a case in hopes of winning his client's freedom at the cost of the community or integrity of the law! Both sides presented contributing factors and speculation, but the most valued goal is justice within the law not the Prosecution Triumph or the Defenses Vindication of Freedom!

      What is needed in our legal system is a Judicial Mediator who has the power to inter-vein just before closing arguments within the courtroom. The JM has the authority to impose a sentence upon either parties. This person should be outside the legal profession and an elected office with requirements as seen violable to serve his/her community.

      Then upon the reading of a jury verdict which declares a mistrial the JM is called and renders his/her sentences without appeal by either legal teams.

      This young man must understand actions have consequences and accountability will be imposed with a system which brings about closure.

        The issue here is that a 14year old boy was sexually molestedby a 15year old - and even one year's difference matters a lot at that age. The system not only failed him, but the senior teacher of the class, a lesbian, supported and encouraged it - and was rewarded for it with becoming a school principal! Rewarded for what? Driving a child to despair?

      It really scares me that most of you can vote. Our justice system has many flaws. But instead of doing anything about it..You rant and rave and say nasty things about people you don't even know. And to my fellow christians. God wants spirtual fruit..not religous nuts..Need I remind you of a pivotal teaching? Do not judge lest ye be judged? That's a mighty big rock you are holding while living in that glass house.
      I hope his second trip to the jury holds him responsible for his actions. Their are many ways to deal with harassment. It goes both ways. He chose to deal with it in the wrong way. Every action has a consequence.

      @Renaissance Man: You may be truthful in calling your opinion a theory, however - until you are gay, born that way or make a choice, how would you really know?

      There are instances where people honestly admit, generally women, who "make a choice" to be gay primarily because of too many negative experiences with men.

      There are documented instances of confusion, primarily in a person's youth - where the subject may have been molested and doesn't understand that the body's natural response to stimulation is excitement regardless of who the stimulator is unless there is violence or force involved.

      They are still studying this issue and opinions vary - one of them being that the gene is passed down through the mother. Your theory seems based primarily on being gay is a psychosis.

      So I ask again, until you are born gay (and it seems that you are not) how would you really know?

      How many gay people have you talked to about this? About their lives, when they knew, their actual life experiences leading up to the fact of their knowing?

      There are many so called straight men leading straight lives who actively seek out transgendered or gay men in their "off-time" leading double lives. They will shout it out from the roof-tops that they are "not gay" and will actively speak out about "gays" and it "not being right".

      There are so-called "straight men" who will participate in activities like circle (insert here) and think this is a "straight activity" and proclaim loudly that since they are talking about women that it is. I'm sorry, but in my opinion, if there is a room full of men with their genitalia out doing the same thing - well, you get my drift.

      Well its been real- but most of the commentators here a pure dumbasses- you cannot support a murderer who is blatantly guilty. Its wrong and he needs the book thrown at him- We are civil society and should act like it. If you are being harassed there are ways to stop it- but you cannot control others behavior. And for the ones that support the kid- dont ever call yourself a Libertarian, a Liberal or a Democrat.

      The jury did not find McInerney innocent, or not guilty. They found him guilty, but deadlocked on the degree of his guilt. NOT a single juror voted no guilty. Retrial with a smarter jury, and foresight by the prosecutor, should assure a minimum 50 year Prison sentence for this piece of garbage.

      The fact that he killed another child in such a heinous & hateful way would balance out him being tried as an adult I would think. Many 14 yr olds (that is a teenager,after all) in a big city cant lay much claim to child-like innocence in this day & age in the USA.
